The first one is the meeting time and that's at 7:30 on third Wednesday....Opportunity to be heard residents of the Town are required to have a reasonable opportunity to be heard at any meeting….Council Guidelines…. Mayor Martin decided to move her State of Town address up on the agenda. CM White asked for and motioned that Ordinance 2023-1 amendments to the Town of Fairmount Heights Personnel policy be added to the agenda. CM Waiters questioned are you asking for a motion to amend CM Barnhardt second Mayor Martin inquired if any questions on motion. CM Waiters discussed and specified we just received this and had no opportunity to read the five paragraphs. Don't have enough information on Personnel policy that no one has taken the opportunity to review. Mayor Martin stated we have to get better information. CM White explained there are several versions of Personnel Policy 2003, 2014 revised. CM Waiter debated it is not an agenda item CM White explained why adding Personnel Policy to the agenda because of multiple copies being distributed. CM Waiters asked if this is a new ordinance being added tonight.CM Oscar inquired any reason you want to expedite this tonight. CM White disclosed it is a loophole that has been here for a while. Mayor Martin advised it is not fair because everyone not prepared this evening. CM Wood-Dodson proposed can we vote on this in the same manner as minutes and queried if it is possible to be done in a special meeting. Mayor Martin indicated she thinks Thursday is much better and asked everyone if Thursday is ok for an Executive session. CM Oscar replied yes to Thursday CM White responded No. CM Barnhardt instructed to come back to her. CM Wood Dodson resolved can we do now since we have a full council. CM Waiters reiterated we are discussing an ordinance and we have not added it to the agenda. CM White discussed and detailed more about the ordinance CM Oscar no. CM Stewart concurred why can't we do tonight CM Wood Dodson informed it has been lingering and agreed therefore do it tonight. Mayor Martin had further discussion on Personnel Policy and interjected meetings have been going over time on Zoom. Mayor recommended do ordinance on Thursday CM Barnhardt determined to do ordinance tonight. Mayor Martin concluded we can insert ordinance in the agenda and need a motion. THE STATE OF THE TOWN ADDRESS BY MAYOR LILLIE THOMPSON MARTIN A good blessed evening to us all as we gather together and thankfulness For the grace provision and favor of God it warmth our hearts we have come Through one of the hardest times in history sparked by the covid-19 occurrences and the ensuing Fallout where we remain here f or a reason we give thanks for all the hands that remain with us to get the work done one of our most TOWN OF FAIRMOUNT HEIGHTS TOWN MEETING MINUTES JANUARY 24, 2023  2 dedicated group of workers were our Public Works employees who created a clean safe environment that kept the covid-19 virus under much better control our trash was always collected and food Was delivered door to door for residents that were unable to come for pickups To all of our staff regardless of Your Capacity we thank you at this time I Would like to have our staff members please stand so that the cameras can capture you as we say thank you for the work that was done during covid-19 and throughout your time here at the town of Fairmont Heights would all please give him some employees Thank you thank you very much as we move forward we have a great deal To look forward to one of our first major projects is the completion of our Net Zero homes on 60th place these homes have been a work in progress For a few years but our eyes are focused on their completion and a great opportunity that will be presented for additional well-constructed housing within our town we are happy to report that through various funding sources we will now have a micro grid included with our Net Zero homes on 60th place and that was done through a major Pepco and other entities contributions several similar micro grids throughout the town would be extremely helpful in case of major power outages our passive home on Addison Road remains a landmark in our community and as we break ground for our net zeros our future shines brighter than before in 2022 we also added an electric charging station to the rear of our town facility on Jost Street this station enables all owners of electric vehicles to keep them fully charged in their capacity to charge at home is not available in years to come since most of the major automobile companies are converting a large portion of their stock to Electric Run vehicles this project was moved forward as a community service to all the residents of our town our Police Department is again up and flourishing under the leadership of our chief Stanford Moore Jr would you stand chief and let the people see you would you give him some Applause Thank you Chief Moore has outlined his Visions for a department that reflects the best Interests of every resident within our borders he was officially sworn in on October 11, 2022 and is working on two new police vehicles two full-time police officers updated equipment and new ideas of implementing safety and accountability for all of us here in our town our public works department has been operating with one major vehicle for various job assignments throughout the town so as of this Thursday we will make a concrete decision in obtaining one additional Public Works vehicle so that work assignments can be evenly distributed and the beautification of our community can be easier to accomplish speed humps the discussion of speed humps has been an ongoing issue for quite some time as a speed deterrent within our town and it is very much they are very much needed all of our proposals for Speed humps are now complete so that by Thursday this week we will move until the official choice of a speed hump vendor there are several notifications and procedures that are included and weather it would be one of those and these things are necessary before the humps are installed but they are close to finalization under the ARPA funding proposals electronic signs for citizen notification are forthcoming the location of these digital signs are to be determined all town stop signs will be replaced with updated ones and all of these additions will increase the safety for all of our residents. Our summer youth program sponsored by the county will be one that we will continue to benefit with our youth within our town and our surrounding areas we accepted four views for the program this in the year 2022 and they were on the direction of our town manager Mrs. Sarumi and with the help of our town clerk Mrs. Joanne Tucker and I must also include Mr. James Pinkney our code enforcement officer who always was here to meet our workers first thing in the morning. any parents with high school students please ask your young people to sign up in their guidance office and work right here within our town for the summer this program is funded by the county and has been beneficial to many students throughout the years Fairmount Heights has been accepting students for many years and we feel proud of how it has contributed to their well-being and general outlook on life. grants we're extremely fortunate to have had the assistance of our town manager who did an extra fast turnaround and applied for a ten-thousand-dollar Grant from Pepco through sustainable Maryland and we were awarded that $10 000 to design and Implement a walkable livable pathway with special lighting to an area off 60th Avenue that leads to our parking at least to our parking pocket park and creates a connective route to our town library thank you Mrs. Sarumi. Our grant money has been received and the connective work must begin we have also been deeded a County property it's on K Street off of Addison Road that has now been cleared for usage of overflow parking and parking for the historic Hargrove house as it is a historic site these are also on K Street the paperwork to our Senator Benson has been submitted for a bond Bill to come out of this General Assembly the request and paperwork have all been finalized the bond bill would be to repair this building from top to bottom and to give it a totally new facelift and make sure that it's ADA Compliant because as of now it is not. Another major grant called the raised Grant has come to my attention by email this grant will allow us to repair all of our towns streets and sidewalks this grant is due by February 28 2023 and is greatly needed since our streets have never been completely redone only patched Our Town manager has received the paperwork on this Grant and is working on research and preparation this grant can be of great service to our town Our circuit Rider program our town and the town of Capitol Heights have been submitted to the Department of Housing and Community Development for approval of a circuit Rider who will assist us with grants and other management work within our town word has been received that formal announcement about funding and placement is forthcoming in March of 2023. We are looking forward for the opportunity to work with Capitol Heights and have already begun the building of those bridges we have also been working with delegate Jazz Lewis on the blue line Corridor development and that plan would be for Capitol Heights seat Pleasant and Fairmont Heights their next meeting is this Saturday at one o'clock P.M Meeting with the treasurer our first meeting to discuss the new budget for this year with the treasury has been done with myself and Mrs. Walker several meetings will take place before I present to the council the budget for 2023 and then the budget will be presented to the community and all of the community work that I have completed throughout my tenures as a public servant for the town of Fairmont Heights I've done it in a spirit of love it has been filled with loads of trials and tribulations but I can truthfully say that this town our town is so much better because of my 32 combined years of service to our community we have come from zero balances to well above and with an excellent Spirit of stewardship we can maintain with the faith of God and a pledge to work as a united front our goals are endless each and every one of us must keep digging our heels hands and hearts in as we march valiantly to our Mark of a higher calling may peace dwell Among Us and may God continue to show us favor God bless the town of Fairmont Heights thank you all very much. TOWN OF FAIRMOUNT HEIGHTS TOWN MEETING MINUTES JANUARY 24, 2023  3 Police Dept.: Chief Moore reported as of 24th activity 27 for calls for service. Loitering domestic gunshot sounds on eastern ave 3 recovered stolen vehicle recovered impound. Carjacking’s in PG County. Hyundai Sonata is the easiest car to steal. A fire report submitted to all the mayor and council has 30 days to respond to the violations the fire department highlighted. Fix Take signs out of the sprinkler room company be there Friday, hang fire extinguisher, exit signs exposed wires. Need to be lit up. CM Stewart inquired what room capacity is. Chief Moore explained Fire Chief Tiffany Green sent fire department personnel. Chief Moore pointed out Went to court on previous cases and will be going for another court case. He mentioned he spoke with 3 seniors based on CM Wood Dodson recommendations. Any questions according to the fire safety inspection. The Chief informed he is taking on some of the responsibilities himself. The Chief announced he will see if Public works can hang them. CM Stewart asked a question about alarms and sprinklers. Chief remarked we can get our own smoke detector. He revealed the sprinkler system was last expected in 2015 according to the company. He announced the two vehicles are here at the dealership in Penn. We make payment and vehicles will be delivered here. CM White asked what the status of carbon monoxide detectors is. Chief informed the results of the alarm system have to be sent to the fire dept. (FULL REPORT ON FILE POLICE DEPT.) Code Enforcement: Mr. Pinckney reported January 23 line of 3 properties 1023 58th ave $1000 3 civil citation 2 building permit No new. Areas to install new stop signs 59 & Veteran’s Parkway East and West. Jost St and Balsamtree 30 x 30 signs with 8 lights the company is Eco Signs 1 sign is $1,371 for stop signs with flashing lights and they are solar. DO NOT ENTER SIGNS Eastern 61st and 60th and Jost 30 x 30 and would take two to three weeks to do the signs. Most don’t do solar would have to be electric. CM Barnhardt all dog bags empty no bags. Mrs. Sarumi responded. CM White read from zoom about excessive flow of dump trucks. Mr. Pinkney, they are building house on 1003 60th Ave but coming down 61st Ave, they have rocks for construction. Public Works is seeking supervisor as of today have 2 resumes. Public works will start painting curbs. Received $5000 art grant. Citizens are encouraged to apply for grants up to $60K. HIP Groundbreaking for February or beginning of March. BOND BILL FINANCING submitted a form to the Senator's office for a bond bill that can be used for lead-based paint abatement, asbestos abatement, and update door replacement. Update bathroom. Window and door replacement. The form was sent to Claudette Sherman of the Office of Policy Analysis and they are working on it. Economic Community Development met last week. For funding opportunity. We need consultant for a MASTER PLAN. Example property house up 708 about to be foreclosed they are taking best bid on February 7 deposit of $15,000 is needed to take advantage of those opportunities. US Dept. of Transportation published $1.5 billion for Rebuilding America Infrastructure with Sustainability and Equity. She suggested project could be named the Fairmount Heights Safe Street Sidewalks and African Community Trail. Have analysis of census data. CM Waiters asked about other loan assistance program don’t see the information $650,000 funding through Dept. of Housing Community Dev. CM Stewart inquired via Zoom, whose responsibility is it to be sure building is inspected yearly. Mrs. Sarumi responded with my responsibility I cannot make any excuses. CM Stewart emphasized going forward must make sure yearly inspections and when people come into building, we must make sure not safety code violation. Mrs. Sarumi agreed. Paperwork on those done on Thursday when treasure here. 2-Stop signs Mr. Pinckney talked about earlier in his report and will be done through ARPA funding 3-Digital Town Signs TOWN OF FAIRMOUNT HEIGHTS TOWN MEETING MINUTES JANUARY 24, 2023  4 NEW BUSINESS CM White read ordinance 2023-1 Personnel Policy section 12.2 through Section 12.4 Proposed By: Briana White Ordinance 2023-1 Personnel Policy Section 12.2 through Section 12. 4 An ordinance whereby the Town of Fairmount Heights amends the Town of Fairmount Heights Personnel Policy to include Quorum decision regarding employee dismissals. WHEREAS, Local Government Article § 5-202(1), (2) & (5) of the Maryland Code grant to municipalities the power to adopt ordinances to assure the good government of the municipality, to protect and preserve the municipality’s rights, property, and privileges, and to protect the health, comfort, and convenience of the residents of the municipality; and WHEREAS, Article 3, §1-12 of the Town Charter grants to the Town Council the power to pass all such ordinances, resolutions, and laws not contrary to the Constitution and laws of the State of Maryland or our Charter as it may deem necessary for the good government of the municipality in order to promote health, safety, comfort, convenience, welfare, and happiness of the residents of the Town and visitors thereto and sojourners therein; and WHEREAS, the Town deems it to be necessary and appropriate to revise the Personnel Policy as to better serve the employees of the Town of Fairmount Heights and provide employees with a fair chance evaluation consisting of full Town Council input. WHEREAS, pursuant to Article 3, §1-12 of the Town Charter the Mayor and Council have authority to enact legislation by the affirmative vote of a majority of the members of the Council. This ordinance shall be passed immediately after passage. Section 1. NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Fairmount Heights in regular session assembled that Section 12.1 through Section 12.4 of the Town Personnel Policy be and is hereby amended to enact the following language: Dismissals 12.1 Dismissals because of reorganizational change or reduction in service, The Mayor -on recommendation of the Town Council, Town Manager or Chief of Police of the Town shall give the employees at least ten (10) days written notice. If the employee is dismissed without the minimum notice he shall receive equivalent pay, in lieu of notice, in addition to payment of accrued annual leave. 12.2. DISMISSAL BECAUSE OF INCOMPETENCE OR MISCONDUCT: The Town Council, Town Manager or Chief of Police shall give five (5) days notice for such dismissals, except during the probationary period, when zero (0) days notice may be given. The Town Council, Town Manager or Chief of Police reserve the right to dismiss without minimal notice and the employee shall be paid for the full time of such notice. 12.3 DISMISSALS OF EMPLOYEES WITH PROBATIONARY STATUS: If it is found that the probationary employee does not display the qualifications for reemployment, the Town shall give the probationary employee zero (0) days termination notice after three hundred and sixty-five (365) days probationary period. 12.4 Responsibility FOR DISMISSAL Dismissal of the Town Clerk is direct responsibility of the Town Council. The dismissal of all other employees is the responsibility of the Town Council, Town Manager, or Chief of Police. Mayor L. Martin Councilmember P. Waiters Councilmember J. White Mayor Martin accepted motion approval of the ordinance....CM Waiters questioned there were references to sections not in front of me. It is not before us. If you have it should be before me. CM White pulled the information up so that you can see it and explained it is her duty to the Town to be sure they have it. She stated she will read it for clarity CM Waiters wants ordinance presented before us as a part of packet. Mayor Martin said her concern is the Town Attorney has not had chance to see or review it. We have recommendations from the attorney. Her concern is to make sure it is done correctly. CM Oscar comfortable with having to have the attorney to revise it. The attorney is legality is to have the attorney Mayor Martin we have no motion on floor yet. CM Wood Dodson are we making a motion for 2023-1. CM Waiters want to be sure she hears whole conversation on Zoom. MM just expressing concerns about Stated she is breaking up. CM White asked CM Wood to repeat. CM Wood Dodson asked if we are at the point of making a motion to approve ordinance 2023-1 if so, I would like to make a motion to pass this forward Mayor Martin can I get a second on the motion CM Barnhardt second Mayor Martin asked are there any questions on the motion. Mayor Martin asked clerk to council to call roll on Ordinance 2023-1 motion Mayor Martin NO, CM Waiters abstain do not have the additional information I asked for, CM Stewart Yes, CM White Yes, CM Wood-Dodson Yes, CM Barnhardt Yes, CM Oscar No Mayor Martin thanked everyone and announced the Ayes have it. And stated There are 2 no’s and 1 abstention. It passes. CM Waiters asked what next steps and asked CM White are to state next steps to public for clarity. Mayor Martin responded it still probably need to be reviewed and it is already approved CM White interjected it is effective immediately. CM Waiters asked TOWN OF FAIRMOUNT HEIGHTS TOWN MEETING MINUTES JANUARY 24, 2023  5 isn’t there is a notification process. Mayor Martin replied this one took another route and thinks it has a certain number of days. CM White read from Charter Section 1–12. Ordinances. An ordinance may be passed at the meeting at which it is introduced and shall become effective twenty (20) days after passage unless otherwise specified in the ordinance. Council member white further stated this ordinance shall be effective immediately after passage. Sorry active but we can always do change for that and this it says under the fourth line whereas pursuant to article three section 1-12 other town charter of the mayor and council have authorities to enact legislation by affirmative vote of the majority of the members of the Council. Mayor Martin reiterated so it is passed. CM Waiters stated she would like the next steps. New Business Mayor Martin utility resolution update I do have the monthly meeting summary reporting data. CM Stewart stated we have spent 7,260.42 We may have to pause the program we are running into a problem when we mail in the utility some utilities companies have not given credit to the applicants. We are going to look into that to determine what the problem is. WSSC do not accept checks from a third party. We may have to pause the program at the beginning of February. We will still be accepting applications. We will not be processing applications until we resolve the issue with bill payments not being posted. Council member Stewart asked Kim to gladden if there was anything she missed. Kim Gladden stated we are getting a pretty decent turn out and we have been communicating with applicants. CM Barnhardt inquired do you know the length of time the program will be paused. CM Stewart responded about two weeks because to give an opportunity for the first batch of checks to clear our account. But we'll still be receiving applications and will keep them in chronological order on first come first serve basis. The 2023 raise grant program which we talked about extensively. Item number 3 the Maryland General Assembly legislative bond initiative we talked about that extensively. Item number 4 the holiday calendar the days of their town holidays you may have heard that it is mandatory that we observe 14 holidays in the town and those are listed. Everyone had them in their boxes. The Clerk to the Council stated she can go get the copies. Mayor martin read off the 14 holiday closing datesMayor will sign it and hand it over. CM Stewart asks if Juneteenth was listed Mayor Martin verified June 19th. The mayor accepted a motion for adoption oh holidays for 2023 CM Oscar and CM Stewart 2nd to have the calendar of holidays. Mayor Martin asked if there are any questions on the motion and ask Clerk to the council to call the roll Mayor Martin yes, council member waiters yes, councilmember Stewart yes council member white yes council member with Dodson yes council member Barnhart yes council member Oscar yes mayor Martin said the Ayes have it so our official holiday calendar. Item number 5 reallocation of art funds to create a new role media role within the town this was proposed by council member white would you like to make a comment on that. CM White informed we can push that back. CM Waiters asked if this is in reference to what art fund. CM White replied the $5000 and we are allowed to reallocate them with a vote. CM Waiters declared Mrs. Sarumi has represent it in her report after report, after report. CM White stated they were not discussed specifically and creating a new role. CM Waiters stated we have been talking about the art funds for quite some time period we have proposed a use of the art funds. Mrs. Sarumi gave a report of what we have done with the art funds. Mayor Martin said we have to remember to put it on the February work session. item number six bulk mail reinstatement Council member wood Dodson stated that is what I would like to have reinstated it is just a matter of paying so the bulk mail can go out. Seniors are not computer savvy and they are complaining that's the wind takes the Flyers and a lot of people are getting information by word of mouth. Seniors a lot of them are inbound and a lot cannot get out and if the information was mailed out. Mayor Martin said the first thing is to verify with the Postal Service the procedure to reinstate. CM Wood- Dodson will check on the payment of $250 to reinstate by the next work session to eliminate papers blowing up and down the street. CM Stewart said if you could provide me with a list for the utility assistance program, I will deliver to the residents for the utility assistance program. CM Wood Dodson replied OK. Mayor Report she mentioned the inauguration of Governor Wes Moore on January the 18th down in Annapolis. She informed went to the gala. She then asked Online CM Stewart does not have anything further than what she reported on earlier. CM Wood Dodson reported as well as plan to do something community wide a lot of sin wait until the weather is more favorable. Something in regard to my TOWN OF FAIRMOUNT HEIGHTS TOWN MEETING MINUTES JANUARY 24, 2023  6 Fairmont heights state we did go feed in Thanksgiving. A mass of something that we can come into the building. Waiting until the weather is favorable. Tea or for a breakfast or something community oriented where everyone can come in and fellowship together. Is what the seniors I'm looking for. That's what is expected for me and the clothes closet will be open next month. Mayor Martin stated normally I would do the black history and Women's Day celebration maybe in March go do a Women's Day celebration we have not had one because of COVID. Maybe this time we can cut back on the food aspect because we have so much food leftover. Because people in the community did not really come and the majority of the people who did come were invited guests or people you knew in the family. Will do in the month of March at a smaller capacity and we'll discuss during the February work session. CM Waiters reported economic development she passed out the same list of items from last month or review and restate they have been meeting and discussing we have gotten to a point where we have created a wish list to move the town forward it has gotten to the point that we have to present to the mayor and council a wish list and we are looking for we mentioned the 4.4 acres we've been talking a long time and there is no action. It is important for the committees to collaborate Syphax stated in Mrs. Sarumi report she encouraged the Council to hire someone work strategic plan and we missed out on funding on a house that's going up for foreclosure that is the 2006 2007 time frame the time insert a strategic plan and it was a very foundational report to you said we're going to be developing 4.4 acres and it is on the record now by more than just me that in order to do adequate property economic development that's going to move the town forward it needs to be done in a comprehensive strategic matter and we need to hire a professional that can do that. And to follow up on mayor Martin's comment to at the governor's gala I ran into former governor Parris Glendening and I asked him if he would be willing to work with the town of Fairmount Heights to developing a strategic plan and he said yes, CM Oscar asked if it is like a community cleanup day. Question from CM Wood Dodson in front of 702 where the drain is what can cover the drain to keep debris from going down because when the water backs up it backs up all the way down the street past my house is there anything that can cover the great the when it rained the debris from Eastern Ave. comes down the hill and it blocks the drain and is there anything that can cover that manhole a screen or something near the monument from a public works perspective. CM Oscar replied it's the natural flow of the water we can't control we can see what we can do with it. CM Barnhardt stated we can get a catch basin mayor martin we can investigate theat. CM White informed she has been taking grant and legislative writing classes to better help the town. Also got in touch with Mr. Ruffin from Pepco so we can get the streetlamps and the lights behind the building and the streetlamp mentioned in the previous meetings not working correctly. I took the initiative Friday Saturday and Sunday night to drive around to see which lights were messed up the problem that I observe that the streetlamps will work for about an hour and then flicker and go out. CM Waiters mentioned our emergency response and we can in the future work on a community emergency response team. CM Oscar spoke about the Public Work equipment.
