INVOCATION & PLEDGE OF ALLEGIANCE Mayor Glancy called the meeting to order at 4:00 p.m. and read the Executive Session Agenda Items B.1 and B.2. Trey Dowdy from Strasburger & Price was also in attendance. Presiding: 1 - Mayor William P. Glancy Present: 5 - Deputy Mayor Pro Tem Kirk Connally, Council Member Ben Robinson, Council Member Harold Froehlich, Council Member Ana Reyes and Mayor Pro Tem Jeff Fuller Staff: 6 - Gary D. Greer City Manager, Peter G. Smith City Attorney, Angela Kelly City Secretary, Tom Bryson Communications Director, Charles Cox Managing Director - Administration and John Land Managing Director - Operations The City Council may convene into closed Executive Session for the items listed below: B. EXECUTIVE SESSION The City Council convened into Executive Session at 4:02 p.m. B.1 Discuss pending litigation - Texas Government Code Section 551.071(1): Consultation with City’s attorneys regarding the case styled Villas at Parkside Partners d/b/a Villas at Parkside, et. al. v. City of Farmers Branch, Texas, and Valentin Reyes, et. al. v. City of Farmers Branch, Texas, Case No. 3:08-CV-1551-B (consolidated with Case No. 3:03-CV-1615) in the United States District Court for the Northern District of Texas (Dallas Division). B.2 Discuss contemplated litigation - Texas Government Code Section 551.071(1): Consultation with City attorney regarding Town of Addison water rights permit for Farmers Branch Creek. THE CITY COUNCIL RECONVENES INTO OPEN SESSION Consider necessary action on items discussed in the Executive Session. Mayor Glancy called Open Session to order at 4:47 p.m. Consider approving Resolution No. 2014-053 approving the terms and conditions of the Memorandum of Settlement relating to the plaintiffs' attorney's fees and costs for the Reyes Plaintiffs and the Villas Plaintiffs against the City of Farmers Branch, in Case No. 3:08-CV-1551-B, styled villas at Parkside Partners d/b/a Villas at Parkside, et al. v. City of Farmers Branch, Texas, and take appropriate action. Consider and take appropriate action regarding matters discussed in closed Executive Session. Motion by Council Member Robinson, seconded by Council Member Froehlich, to approve Resolution No. 2014-053 approving the terms and conditions of the Memorandum of Settlement relating to the plaintiffs' attorney's fees and costs for the Reyes Plaintiffs and the Villas Plaintiffs. The motion passed unanimously. D. ADJOURNMENT A motion was made by Deputy Mayor Pro Tem Connally, seconded by Council Member Froehlich, that this Meeting be adjourned.
