by Craig Yoshimoto, for a variance to the maximum allowable wall sign for a
façade of the Village Shopping Center in the GC General Commercial District
at 3030 E. Main Street Suite W2. The petitioner intends to reuse an existing
sign that measures 38 square feet from a previous location. This sign exceeds
the allowed size of a commercial sign for this space by 8 square feet. (Sam

5 Petition No. ARB 15-06 - a request from Shawn Adams, represented by 19
James Dennis, for variance to allow a 14’7” side yard setback on the south, a
16’6” front yard setback on the west, and a 17’4” side yard setback on the
north of the building located at 410 N. Auburn Avenue in the LNC Local

ADMINISTRATIVE REVIEW BOARD
May 21, 2015 – 6:00 P.M.
The Administrative Review Board met in special session on Thursday, May 21, 2015 at 6:00
p.m. in the City Council Chamber, 800 Municipal Drive, Farmington, New Mexico.

Call to Order
The meeting was called to order at 6:01 p.m. by Chair Cooper and there being a quorum
present the following proceedings were duly had and taken.
Approval of the Agenda
A motion was made by Board Member Martin, seconded by Board Member Dennis, to approve
the agenda. The motion passed unanimously by a vote of 4-0.
Approval of the Minutes from the April 9, 2015 Regular Meeting
Board Member Martin made a motion to approve the minutes of the April 9, 2014, regular
meeting. The motion was seconded by Board Member Scott and passed unanimously by a vote
of 4-0.
Swearing in of Witnesses
All parties that wished to speak on behalf of any agenda item were sworn in by Karen Walker.
Petition No. ARB 15-05
A Variance to the Front, Rear and Side Yard Setbacks
1425 Tory Avenue
Discussion of ARB No. 15-05 on May 21, 2015
Associate Planner Sam Montoia presented the staff report, a request from Cesar Loya for
property located at 1425 Tory Avenue, for a variance from the requirements of the UDC for a
reduction in the front and rear setback requirements to be allowed to place a mobile home in the
MF-L SMHA Multiple-Family Special Mobile Home Area District. The setbacks require a 20 foot
front yard setback and a 25 foot rear yard setback. The petitioner is requesting a variance to 15
foot setbacks in both the front and the rear.
Mr. Montoia added that the mobile home the petitioners wish to place on the lot is 16 feet wide
and 77 feet long. The lot is 60 feet wide and 106.5 feet long. Newer mobile homes are built

longer and safer. Mobile homes are no longer built to fit the size of this lot. Mr. Montoia
showed pictures of the property from 2012 and the present showing cleanup to the property.
Mr. Montoia stated there were two corrections to the staff report. These corrections were the
petitioner’s mobile home is 16 feet wide instead of 14 feet wide, and zoning is MF-L SMHA
instead of SF-7 SMHA.
Staff recommends approval of Petition ARB 15-05 for a variance to allow a 15 foot front and
rear setback in the MF-L SMHA district for property located at 1425 Tory Avenue.
Board Member Dennis asked if the mobile home on the property to the north was the same size.
Mr. Montoia said it was approximately the same size. Mr. Dennis asked if the owners of the
adjacent property were required to get a variance. Mr. Montoia said they were not required to
get a variance because the neighboring property is legal non-conforming. Board Member Scott
commented that several mobile homes in the area appeared to be in that same category.
Claudia Loya, a petitioner for ARB 15-05, stated she and Cesar Loya had come to the Planning
& Zoning office prior to purchasing the property and was told by Staff the setbacks were 15 feet.
When Ms. Loya came back to get a permit, she was informed by Staff the setbacks were 20 feet
and 25 feet.
Administrative Review Board Action of May 21, 2015
Following consideration, a motion was made by Board Member Dennis and seconded by Board
Member Scott to approve Petition No. ARB 15-05, a request from Cesar Loya for a variance
from the requirements of the UDC for a reduction in the front and rear setback requirements to
15 feet in the MF-L SMHA Multi-Family Low Density District with a Special Mobile Home Area
Overlay.
AYE: Chair Cooper, Board Members Dennis, Martin, and Scott.
NAY: None
ABSTAIN: None
ABSENT: Board Member Soukup
MOTION TO APPROVE 4-0
