The City's FY 2018 budget document has been recognized as the highest quality and presents the City's annual financial plan. The document contributes to enhanced accountability and management decision making . The City's FY 2017 Citizen's Financial Report has been judged as a recipient of GFOA's Popu lar Annual Financial Reporting Award. The report is prepared in an easily understandable format and is readily accessible to the citizenry and other parties interested in the City's finances. 3. Presentation regard ing the Complete Count Comm ittee for the 2020 Census (Mi ke Stark, San Juan County) Action Requested of Coun cil : Provide direction to staff. 4. Presentation regarding the naming and marketing of the water park to be located at Brookside Park (Tonya Stinson, Farm ington Convention and Visitors Bureau) Action Req uested of Council : Information on ly. 5. Reconsideration of the name of the water park to be located at Brookside Park (Mayor) --------------------------------------------------------------------------------------------------- 2 Action Requested of Council: Provide direction to staff. 6. Presentation regarding wayfinding signage (I saac Blue Eyes and Shana Reeves) ----3 Action Requested of Council : Approval to proceed with the wayfinding signage program. Background/Rationa le: City leadersh ip has begun to focus on identifyin g and highlighting local amen ities as part of the Outdoor Recreation Industry Initiative and has recognized that many individuals do not know how to navig ate to the various natural and developed outdoor recreational amenities present in the community. The wayfinding signage program will help to guide commun ity members and tourists to their outdoor, cu ltural or fam ily- oriented recreational destination. Staff Recommendation: Approval to proceed with the wayfinding signage program. Instructions Upon Approval: Staff wi ll ensure that the created signage meets State standards for traffic control devices and is compliant with the Manual on Uniform Traffic Control Devices (MUTCD) and will install the wayfinding signage. Budgetary Impact: The Farm ington Convention and Visitors Bureau will contribute $50,000 and the City will contribute $100,000 from the Commun ity Transformation and Economic Diversity Fund (204) for a combined total of $150,000. COUNCIL BUSINESS 2  CLOSED MEETING 7. To discuss acqu isition of real properties (MRA District and riverine tra il system), pursuant to Section 10-15-1H(8) NMSA 1978. DEPARTMENT HEAD REPORTS 8. Purchase Agreement between the City and Ruff Rhodes, LLC (Rob Mayes) -----------4 Action Requested of Council: Approve the purchase agreement. Background/Rationa le: The City wishes to acquire 5.71 acres of property located in Section 16, Township 29, Range 13 and Lots 1-8 in Block 2 of the Riverside Add ition Subdivision for health and safety reasons and for future economic development to benefit the Metropolitan Redevelopment Area . Staff Recommendation: Approve the purchase agreement. Instructions Upon Approval: Execute the purchase ag reem ent and proceed with closing of the property. Budgetary Impact: The purchase price is $660,000 to be paid from the Commun ity Transform ation and Economic Divers ifi cation Fund (204). The awards are prestigious and nationally recognized as noteworthy accomplishments by governmental units. Attaining the awards is an extraord inarily challenging task and requires a skilled staff with the commitment to meet the GFOA's standards criteria and submit the reports within the necessary time constraints. The reports exemplify the spirit of transparency and full disclosure of a governmental unit's financial planning and actual results. GFOA's Certificate of Achievement for Excellence in Financial Reporting is the highest form of recogn ition in the area of governmental accounting and financial reporting. Attainment of the award represents a significant accomplishment by a government and its staff. • The City of Farmington's Fiscal Year 2017 Comprehensive Annual Financial Report is the City's 24th consecutive award . • Less than 5% of U.S. local governments annually receive the Excellence in Financial Reporting award. • Farmington is 1 of 19 New Mexico local governments to receive the Financial Reporting Award. GFOA's Distinguished Budget Presentation Award is the highest form of recognition in governmental budgeting . The award recognizes exemplary budget presentation and documentation by state and local governments. The award reflects the commitment of the governing body and staff to meeting the highest principles of governmental budgeting. • The City's Fiscal Year 2018 budget document is the City's 21st consecutive award. • Less than 2% of all governmental entities annually receive the Distinguished Budget Award. • Farmington is 1 of 11 New Mexico local governments to receive the Distinguished Budget Award. GFOA's Award For Outstanding Achievement In Popular Annual Financial Reporting (PAFR) represents special recognition for a high quality annual report specifically designed to be readily accessible and easily understandable to the City's general public and other interested parties without a background in public finance. - 1.0 - Popular annual financial reports are reviewed and judged based on creativity, presentation, understandability, reader appeal, and the overall quality and usefulness of the report. The City of Farmington's Fiscal Year 2017 Citizen's Financial Report is the City's 8th consecutive award. • Less than .5% of all government entities nationwide recently received this honor. • Farmington is 1 of 6 local governments in New Mexico to receive the Popular Annual Financial Reporting Award. A committee made up of representatives from the Parks, Recreation and Cultural Affairs Department and the Farmington Convention and Visitors' Bureau requested by email possible names for the facility from City of Farmington employees. The desire is to create a name that has marketability and to support the themed component of the facility. A name that evokes adventure and distinguishes the facility as uniquely belonging to our region and community will help make the facility appealing to visitors. The committee reviewed names from the emai l call and chose four. The four names were Bisti Bay at Brookside Park, Enchanted Oasis at Brookside Park, Bluff Basin Water Park at Brookside Park, and Farmington Aquatic Badlands (FAB) at Brookside Park. These four names plus an option to suggest one were sent out for public survey. The survey received 570 responses with Bisti Bay at Brookside Park receiving the most responses. The survey results were presented to the Parks, Recreation, and Cultural Affairs Commission in August. The Commission was supportive of the Bis ti Bay at Brookside Park name; however, they wanted Brookside more prominent in the name. Staff reviewed the survey results and presented the name Brookside 's Bis ti Bay at the September Commission meeting for consideration. After discussion, the Commission unanimously approved recommending the name be Brookside 's Bis ti Bay for the new family aquatic center. In order to ensure fairness and consistency, naming or dedicating of municipal property, buildings and park elements will be named according to the following principles. The guidelines of the Parks, Recreation, and Cultural Affairs (PRCA) Commission is to name whole assets, parks, and facilities through an adopted process utilizing established criteria emphasizing community values and character, local history, geography, environmental, civics and service to the community ofFaimington. Naming Principles • Aid in the geographical identification of the municipal property, buildings and park elements to assist in emergency response situations. • Maintain long standing local area identification • Understandable to the majority of Farmington residents • Give a sense of place, continuity, and belonging; to celebrate distinguishing chai·acteristics and uniqueness of the community of Farmington, avoiding confusion, name duplication and similar sounding names • Not discriminatory, derogatory or political in nature • Municipal property buildings and park amenities will not be named after elected officials cmTently in office • Corporate names will not be used unless a significant financial or other contribution has been made to the City • City Council retains the right to change any name at any time without notice Criteria The following criteria shall be used in determining the appropriateness of the naming designation: • Geographic location (neighborhood, significant areas, etc.) • Natural features • A person (non-living) or place of historical or cultural significance - 2.5 -  • A group, or feature particularly identified with the land or facility • Conditions of property donation as agreed upon by the donor and the City shall be honored regarding the naming of the parks, recreation areas and facilities subject to these adopted policies. • Names that are similar to existing parks, properties or facilities in Farmington should not be considered in order to minimize confusion. • The City reserves the right to change the name to maintain consistency with these policies Purchased Naming Rights In the case of purchased naming rights the following additional considerations will apply: Criteria • The significance of the contribution made relative to the construction and/or operating costs of the item being named. • The significance of the contribution relative to the market valuation of the naming opportunity. • Results of a value assessment • The benefits to and obligations of both the purchaser and the City. • The duration of the naming including a specific sunset clause associated with the length of time that the name will be used. • Whether the naming agreement can be renewed if a further gift or sponsorship is received (Demonstrated public suppmt for the sale of naming rights of the facility). Commemorative Naming From time to time recommendations from the community may arise to show recognition of an individual or organization for service or support to a specific park or facility. Under this condition the PRCA Commission may entertain recommendations to recognize specific elements of a facility or park for the service or support of the individual or organization. Criteria • Must be perceived as a model citizen and open to close scrutiny relative to their character, integrity and values. • Community involvement must be positive and renowned. • The involvement will have had a dramatic influence/impact on the City/Residents over an extended period of time. - 2.6 -  • Contribution including length of service, level of commitment, level of responsibility assumed, or financial must be demonstrated. • In the case of service clubs, have they contributed through public service activities in Farmington over multiple years? PROCEDURE: Naming of PRCA assets, parks and facilities 1. A request for naming of a PRCA asset, park, or facility shall be submitted in writing to the Parks, Recreation, and Cultural Affairs (PRCA) Commission through the PRCA Department. 2. Those submitting a naming request should show how the proposed name is consistent with the criteria stated in this policy. When naming after a person or persons, the application (attached) will describe the contributions to the City. City staff will review the proposal for adherence to the stated criteria and authentication of statements relative to contributions in the case of an individual before forwarding to the PRCA Commission. If the request is incomplete, staff will contact the applicant, in writing, and provide them with the opportunity to resubmit a revised request. 3. The PRCA Commission will offer the opportunity for the public input on the proposed nammg. 4. The PRCA Commission shall vote for approval and forward their recommendation to City Council for final decision. 5. The PRCA Commission can initiate the naming process whenever deemed necessary and/or in the best interest of the City. 6. WHEREAS, Seller is the owner of certain properties in Farmington, New Mexico, set forth in the legal descriptions below; and WHEREAS, Seller is willing to sell and the City is willing to purchase the real property herein described. NOW, THEREFORE, in consideration of the mutual covenants and agreements herein contained, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties mutually agree as follows : 1. The Department previously identified Graves Oil & Butane, now NICO Oil & Gas Distributors, as the responsible party for the petroleum hydrocarbon contamination at the Graves O&G site, Release ID #927. NICO Oil & Gas Distributors is responsible for meeting all the applicable requirements under 20.5 NMAC. Pursuant to 20.5.12 NMAC, any corrective action activities performed at this site will be conducted through the responsible party listed above. Future property owners will not be held liable under the Petroleum Storage Tank Regulations for Graves O&G, Release ID #927. 3. The purchase price shall be a cash payment to the Seller in the amount of Six Hundred and Sixty Thousand Dollars and No Cents ($660,000.00). 4. Seller shall convey the property to Purchaser by good and sufficient warranty deed in proper form for recording so as to convey to Purchaser good and merchantable record title to the land affected by this agreement free and clear of all liens and encumbrances, other than any easements or restrictions in existence or of record. 5. Seller agrees to furnish Purchaser a good and sufficient title insurance policy binder in the form of the American Land Title Association, Form B, without exception, except as herein set forth, for the full purchase consideration hereof guaranteeing good and merchantable title to be vested in the Purchaser subject only to the conditions of this agreement. Should defects appear upon title for any reason, Seller shall have a reasonable time within which to cure any defect which affects merchantability of title. 6. Property taxes shall be prorated to date of closing. Seller warrants that all taxes and assessments against the premises prior to such time have been or will be paid. 7. Easements, restrictions, zoning and patent easements, if any, are to be assumed by the Purchaser unless otherwise addressed herein. 8. Purchaser agrees to make an escrow payment of One Thousand Dollars and No Cents ($1 ,000.00). 9. This agreement shall be closed at the offices of San Juan County Abstract & Title Company, 111 N. Orchard Avenue, Farmington, New Mexico, on or before October 31, 2018, unless the time is extended by mutual agreement of the parties. San Juan County Abstract & Title Company, is hereby designated, constituted, and appointed as Escrow Agent to act between the parties. The Escrow Agent is authorized to prepare and have executed the deed to the - 4.1 - property referenced above, upon payment by Purchaser to Seller the sum referenced in Paragraph 2 above, and shall deliver said deed to Purchaser after completion of the terms of this agreement at closing and recording of the deed with the County Clerk. The Escrow Agent shall not assume responsibility for the performance of, or the enforcement of, any of the covenants of this agreement, and shall not be required to act in any manner not specifically directed herein, and the parties hereto jointly and severally agree to indemnify and hold harmless said Escrow Agent from and against all costs, damages, judgements, attorneys fees, expenses, and liabilities of every kind which in good faith and without negligence it may incur and suffer in connection with or arising form this escrow. 10. Seller agrees to give possession of the property to Purchaser upon closing. 11. Time of performance under this contract is of the essence. 12.
