Tuesday, September 10, 2024 in the Council Chamber, City Hall, 800 Municipal Drive,
Farmington, New Mexico. . .
1. Roll Call and Convening the Meeting:

4. Business from the Floor: Comments are accepted in person, limited to three (3)
minutes and to items that are not listed on the agenda. No formal action will be
taken at this meeting relating to comments provided from the floor.
5. Acceptance of Consent Agenda: Those items on the agenda that are marked
with an asterisk (*) have been placed on the Consent Agenda and will be voted
on without discussion with one motion. If any item proposed does not meet
with approval of all Councilors or if a citizen so requests, that item will be heard
in regular order.
6. *Approval of Minutes for:
(a) the Regular Work Session of the City Council held August 20,

7. *Approval of Bid for the civil construction of the Bergin Substation (Electric) being
awarded to Adamah LLC as the sole bid is deemed to be fair and reasonable
and meets specifications ($350,160.20). Bids opened August 20, 2024. --------- 1
8. *Approval of Bid for the purchase of concrete, sand and gravel (Community Works)
being awarded to a primary, secondary and tertiary bidder per category after
application of the Resident Business preference (refer to the memorandum
and abstract schedule contained in the agenda materials); and to reject
certain lines from Mesa Sand and Gravel and Four Corners Materials for
being non-responsive for no bid. Bids opened August 20, 2024 with three

(1) Acknowledgement of the Department of Finance and
Administration’s approval of the City’s Fiscal Year 2025 Budget,
as required by Section 6-6-5 of New Mexico State Statutes. ---------------- 4

-approving the first revision to the FY2025 budget and requesting

(3) Consideration of cancellation of the September 17, 2024 City
Council Work Session.
(d) City Attorney
(1) Proposed Ordinance – Permission to Publish
-authorizing the execution and delivery of a Water Project Fund
loan/grant agreement by and between the New Mexico Finance
Authority (“NMFA”) and the City of Farmington, New Mexico (the
“borrower/grantee”), in the total amount of $20,000,000, including
a loan in the amount of $8,000,000 evidencing an obligation of the
borrower/grantee to utilize the loan/grant amount solely for the
purpose of financing the costs of construction of Water Treatment
Plant 1 upgrades, and solely in the manner described in the loan/grant
agreement; providing for the pledge and payment of the loan amount
and an administrative fee solely from the net system revenues of the
water utility system of the borrower/grantee; certifying that the
loan/grant amount, together with other funds available to the
borrower/grantee, is sufficient to complete the project; approving
the form of and other details concerning the loan/grant agreement;
ratifying actions heretofore taken; repealing all action inconsistent
with this ordinance; and authorizing the taking of other actions in
connection with the execution and delivery of the loan/grant
agreement (Final Action October 8, 2024). -------------------------------------- 6
