PLANNING AND ZONING COMMISSION
June 27, 2013
The Planning and Zoning Commission met in a regular session on June 27, 2013 at 2:00
p.m., in the City Council Chambers, 800 Municipal Drive, Farmington, New Mexico.

Call to Order
The meeting was called to order at 2:00 p.m. by Chairman Ivie and there being a
quorum present the following proceedings were duly had and taken.
Presentation of the Agenda
Senior Planner Cynthia Lopez stated there were no changes to the agenda.
Approval of the Minutes
A motion was made by Commissioner Cardon and seconded by Commissioner Ziesmer
to approve the minutes of the June 27, 2013 P&Z Meeting with a correction to Chairman
Ivie’s title in the section “P&Z Members Present:”. This motion was approved
unanimously by a 7-0 vote.
Swearing in of Witnesses
All parties present wishing to address these petitions were sworn in by Dee Dee Moore.

COMMUNITY DEVELOPMENT PETITION REPORT
ZC 13-03 – 5601 Mickey Drive
SF-10 to SF-A PUD
Planning and Zoning Commission Discussion of ZC 13-03 on June 27, 2013
Senior Planner Cynthia Lopez presented the staff report reminding the Commission that
this petition was postponed from the June 13, 2013 P&Z meeting. She stated that the
petitioner plans to place four townhomes on this site, which meets the SF-A Single-
Family Attached district requirements for the width and depth of the lots. This is a
Planned Unit Development because of the existing private drive off of Mickey Drive. Ms.
Lopez stated that a stop sign would be required at the corner of Mickey Drive and the
private drive and the area adjacent to Mickey would be open space with low profile
landscaping so there is no interference with the sight triangle. Staff is recommending
approval.
Anthony Montoya of 1611 Hwy 170, La Plata stated that he had no questions for the
commission or staff.
Ms. Shaun Bishop of 5710 Mickey Drive stated that she was speaking on behalf of a
majority of the neighborhood community. She assured the commission that she was not
there to oppose the proposal, and felt it would be an improvement to the area. However,
she wanted to provide a big picture of the Mickey Drive area. She voiced concerns
about the traffic problems along Mickey, especially when Mr. Farnsworth’s development
is completed. She felt that the yield sign at the intersection of Carl and Mickey was
ineffective because of the drop off; oncoming traffic is not able to see this intersection.
Planning and Zoning Commission Action of ZC 13-03 on June 27, 2013
A motion was made by Commissioner Cardon, seconded by Commissioner Buchanan,
to approve Petition ZC 13-03, a request from Anthony Montoya for a zone change from
the SF-10 Single-Family Residential District to the SF-A PUD Single-Family Attached
Planned Unit Development District, for 0.68 acres located at 5601 Mickey Drive, as
recommended by staff.
AYE: Chairman Ivie, Commissioners Buchanan, Cardon, Freeman,
Langenfeld, Ragsdale, and Ziesmer
NAY: None
ABSTAINED: None
ABSENT: Commissioners Jaques, Thompson, Arnold (Alt) and Washburn (Alt)
Motion passed 7-0.

ZC 13-06 – 1899 W. Navajo Street
RE-20 to IND

Planning and Zoning Commission Discussion of ZC 13-06 on June 27, 2013
Associate Planner Fran Fillerup presented the staff report, a request from Jesse Beard
for a zone change to 0.57 acres of property located at 1899 W. Navajo, “behind the
fence” on the southwest side of the airport. There is currently an airplane hangar
located on this property. Mr. Fillerup said that Todd Gressick stated that any change of
ownership or construction on this property would need to receive approval from the
Federal Aviation Administration (FAA). Mr. Gressick approves staff recommendation for
approval.
Assistant City Manager Bob Campbell answered questions regarding FAA’s scope of
approval. He stated that as far as construction goes there are certain distances from the
centers of runways that must be met. He added that the National Guard Armory on W.
Navajo Street, the well-site development in the Glade to the east, and even the water
tanks at Navajo and Municipal needed to be reviewed by the FAA.
Petitioner Jesse Beard stated that he has enjoyed that property for the last 49 years and
has owned multiple airplanes that were stored in those hangars. He added that he
finally quit flying at the age of 87. He stated that he just found out a few months ago that
this property was zoned residential and is requesting approval for the zone change to
Industrial. Mr. Beard added that he understood the “behind the gate” requirement from
the FAA and had already spoken with a representative in Ft. Worth, Texas.
Commissioner Langenfeld asked if this zone change request could be looked at as spot
zoning and is an Industrial use appropriate at the airport. Mr. Fillerup stated that an
Industrial use is in line with the Comprehensive Plan. He added that the Airport Master
Plan calls for Industrial zoning. Commissioner Langenfeld also asked if any allowed
industrial use could be on that property. Mr. Fillerup stated that yes, any industrial use
permitted by right could be in place on that property, and however, they would need to
meet all the guidelines and setbacks, which are 30 feet in the front, 20 feet in the rear
and 5 feet on the sides. Mr. Fillerup added that this property is grandfathered and can
stand as it is right not, any new construction would benefit by the IND district.
Planning and Zoning Commission Action of ZC 13-03 on June 27, 2013
A motion was made by Commissioner Freeman, seconded by Commissioner Buchanan,
to approve Petition ZC 13-06, a request from Jesse Beard for a zone change from the
RE-20 Residential Estates District to the IND Industrial District, for 0.75 acres located at
1899 W. Navajo Street, as recommended by staff.
AYE: Chairman Ivie, Commissioners Buchanan, Cardon, Freeman,
Langenfeld, Ragsdale, and Ziesmer
NAY: None
ABSTAINED: None
ABSENT: Commissioners Jaques, Thompson, Arnold (Alt) and Washburn (Alt)
Motion passed 7-0.
Business from the Floor: Ms. Bishop stated that her neighborhood is very active and
added that right now the traffic from the mall is slight, buy when the restaurant opens up
she feels it will generate a lot of traffic. She spoke with the restaurant owner and added

that the restaurant will be open for breakfast, lunch and dinner. Ms. Bishop closed her
comments by stating that this neighborhood is really just a 300 home cul-de-sac, which
proves difficult at times because of the traffic. She thanked the Commission for listening
to her concerns.
Business from the Chairman: There was no business from the Chairman
Business from Members: Commissioner Freeman asked staff for clarification
regarding the use of acceleration and de-acceleration lanes in the area around Mickey
Drive and if the state would need to be involved because it is a State Highway. Ms.
Lopez stated that yes; the State does make that determination. She added that any
large development generally requires a Traffic Impact Analysis (TIA) to review traffic
patterns and provides recommendations and requirements for the effected stretch of
road. Chairman Ivie added that there is a planned north/south tie-in (Lakewood) to the
east of these developments and plans for several existing road to connect.
Business from Staff: Ms. Lopez stated that there were no petitions forwarded to City
Council on June 24, 2013.
