The Planning and Zoning Commission met in a regular session on May 14, 2015 at 3:00 p.m. in
the City Council Chambers, 800 Municipal Drive, Farmington, New Mexico

Call to Order
Chair Cardon called the meeting to order at 3:01 p.m. There being a quorum present the
following proceedings were duly had and taken.
Presentation of the Agenda
There were no changes to the agenda.

Approval of the Minutes
A motion was made by Commissioner Langenfeld and seconded by Commissioner Davis to
approve the minutes of the April 30, 2015 P&Z Meeting. This motion was approved
unanimously by a 6-0 vote.
Swearing in of Witnesses
All parties that wished to speak on behalf of any agenda item were sworn in by Karen Walker.
COMMUNITY DEVELOPMENT PETITION REPORT
Petition SUP 15-02 – Special Use Permit for outdoor storage for
Wal-Mart, W. Main
Planning & Zoning Commission Discussion of Petition SUP 15-02 on May 14, 2015
Associate Planner Saavedra presented the staff report for SUP 15-02, a request from Wal-Mart,
located at 1400 W. Main Street and represented by Heather Carter for a Special Use Permit for
an additional area of outside storage. This petition was brought back to the Planning & Zoning
Commission due to the petitioner requesting to utilize an area of approximately 30 existing
parking spaces rather than the previously proposed 4 parking spaces for their outdoor storage.
The parking lot has over 1,000 parking spaces. The current proposal will consist of over 6,400
square feet.
Director Holton stated that she was able to meet with Wal-Mart representatives last week and
confirmed with them today the location they wished to use for their outdoor storage.
Mr. Saavedra stated that staff recommends approval of Petition SUP 15-02 for additional area
of outdoor storage for property located at 1400 W. Main St.
Commissioner Cardon asked if there was any difference in this petition from the last time other
than the size of the requested storage area. Mr. Saavedra stated there was not and that
Community Development learned after the April 30, 2015 Planning & Zoning meeting that Wal-
Mart wanted more space.
Ms. Holton stated that the petitioner is requesting to be able to utilize this area annually
between the months of April and August. This is not a concern as Black Friday and Christmas
Eve are the critical times when Wal-Mart would need that area for parking.

Commissioner Cardon asked if Wal-Mart will have to come back every year for this Special Use
Permit. Ms. Holton stated that staff recommends allowing the Special Use Permit annually so
Wal-Mart will not need to come back each year.
Heather Carter, a representative of the 1400 W. Main Street Wal-Mart, stated that she was
satisfied with the recommendation. Ms. Carter stated that Wal-Mart may not utilize the
parking lot area this year because it is the end of the planting season.
Ms. Holton stated that a Temporary Use Permit (TUP) was issued to Wal-Mart so they can use
the parking lot area while the petition was progressing to the City Council. That Temporary Use
Permit will expire on May 26, the date of the City Council meeting.
Genevieve Werito, a representative of the 1400 W. Main Street Wal-Mart, stated that she
wished to apologize for the miscommunication on the original request of 4 parking spaces.
Commissioner Langenfeld asked if the fencing and screening that had originally been discussed
would stay the same. Ms. Holton stated that it will be the same as previously proposed. The
purpose of the fencing is to keep the area safe and to keep people from parking in the
proposed area while it is being used for storage. While this screening proposal would not be
adequate for other situations, it is typical for an area located inside a retail parking area.
Planning & Zoning Commission Action of Petition PP 15-02 on April 30, 2015
A motion was made by Commissioner Langenfeld and seconded by Commissioner Jaques
to approve Petition SUP 15-02 as recommended by staff.
AYE: Chair Cardon, Commissioners Davis, Jacques, Langenfeld, Ragsdale, and Waldroup.
NAY: None
Abstained: None
Absent: Commissioners Freeman, Thompson, and Washburn.

COMMUNITY DEVELOPMENT PETITION REPORT
Petition ZC 15-04-Zone Change from R-4, Office and Professional
District under the City’s Zoning Ordinance Prior to the UDC to GC,
General Commercial, LNC, Local Neighborhood Commercial, and SF-
10, single-Family Residential, Districts under the UDC
Planning & Zoning Commission Discussion of Petition PP 15-03 on May 14, 2015
Senior Planner Lopez presented the staff report, a request from the City of Farmington, Socono,
LTD, and Mike English, represented by Mary Holton and Gary Howlett, for a zone change from
R-4 to GC General Commercial, LNC Local Neighborhood Commercial and SF-10 Single-family
Residential for 24.35 acres of vacant land located across Main Street from the Animas Valley
Mall and south of Beckland Drive. The property is an undeveloped/vacant parcel of land that,
prior to the adoption of the Unified Development Code, was zoned R-4, Office and Professional
District. This zoning classification allowed office uses and multi-family uses. When the UDC was
adopted in 2008, the R-4 district was no longer in existence. The City was able to rezone all of
the R-4 parcels in 2008 and 2009. City staff has worked closely with the property owners to
bring this property into compliance with the new UDC for zone change. This area is a mixed
district with commercial use close to Main Street and Single Family Residential to the west. The
dividing line between the proposed GC General Commercial District and the proposed SF-10
Single Family District would be the top of the hill.
Staff recommends approval of Petition ZC 15-04 for a zone change from the R-4, Office and
Professional District to GC General Commercial, LNC Local Neighborhood Commercial along E.
Main Street and Beckland Drive, which is similar to Enterprise Car Rental, and SF-10 Single-
Family Residential, which is similar to the homes along Country Club Drive.
Commissioner Davis asked what was used for the delineation between the GC General
Commercial District and the SF-10 Single-Family District. Ms. Lopez stated that Community
Development worked with Cheney-Walters-Echols on a legal description and used the top of
the hill as the dividing line.
Commissioner Langenfeld asked if that delineation will work without any transition zone. Ms.
Lopez stated it would be difficult to build downhill. Commercial buildings would have to do
some leveling. The topography will work as a buffer for the transition zone.
Ms. Holton stated that Community Development has worked with the property owners. The
English family is represented by Socono LTD and Craig Stoabs. Ms. Holton has also worked with

Mike English and his representative Gary Howlett. The English family agreed that the back side
should be residential because of the sharp slope on the back side. There were also trees on
that side which would be a good buffer for residents. Ms. Holton added that Mr. Howlett and
Mr. English were pleased with the LNC Local Neighborhood Commercial zone to match what
Enterprise Car Rental currently has. Ms. Holton pointed out that although the original thought
was that this property was the last R-4 that needed to be rezoned, Associate Planner Sam
Montoia found another R-4 parcel that will need to be rezoned.
Gary Howlett, a Century 21 agent who uses the address P.O. Box 779, Farmington, NM, is a
representative for Mr. English. Mr. Howlett stated that Mr. English is agreeable to the
proposed rezoning. Mr. Howlett also stated that he may have a perspective buyer for the
parcel north of Enterprise Car Rental.
Planning & Zoning Commission Action of Petition ZC 15-04 on May 14, 2015
A motion was made by Commissioner Langenfeld and seconded by Commissioner Davis
to approve ZC 15-04 as recommended by staff.
AYE: Chair Cardon, Commissioners Davis, Jacques, Langenfeld, Ragsdale, and Waldroup.
NAY: None
Abstained: None
Absent: Commissioners Freeman, Thompson, and Washburn.
Motion passed 6-0
Business from the Floor: There was no business from the Floor.
Business from the Chair: Chair Cardon stated that she went to the Commissioners Training in
Albuquerque on May 7, 2015. The training discussed several areas of interest to Board
Members. Ms. Cardon said the training was very beneficial and she recommended it to the
other Commissioners.
Business from the Members: There was no business from the Members.
Business from Staff: Senior Planner Lopez stated at the May 26, 2015 City Council Meeting
Petition PP 15-03, a preliminary plan for Van Belle Subdivision passed on consent. PP 15-02, a
preliminary plan for Sunrise Subdivision, was approved after some discussion.

Ms. Lopez stated that Blue Zones is coming back May 15-19. A photo montage will be
presented to give ideas on what can be done with downtown Main Street. The Saturday
workshop is from 9:00 am-12:30 pm at the Civic Center. Ms. Lopez said they will be pulling out
maps and ‘rolling up their sleeves’ to help design Main Street. The closing meeting is Monday
evening at 6:00 pm at the Civic Center. Ms. Lopez asked Commissioners to come to as many
meetings as possible.
