The Planning & Zoning Commission met in a regular session on August 12, 2021 at
3:00 p.m. in the City Council Chambers, 800 Municipal Drive, Farmington, New Mexico.

Call to Order
Chair Joyce Cardon called the meeting to order at 3:00 p.m. There being a quorum
present the following proceedings were duly had and taken.
Approval of the Agenda
The motion was made by Commissioner Sewell and seconded by Commissioner
Smouse to approve the agenda of the August 12, 2021 Planning & Zoning Commission
meeting. This motion passed unanimously by a 5-0 vote.
Approval of the Minutes
A motion was made by Commissioner Ragsdale and seconded by Commissioner
Sewell to approve the minutes of the July 29, 2021 Planning & Zoning Commission
meeting. This motion was approved unanimously by a 5-0 vote.
Swearing in of Witnesses
Elizabeth Sandoval, Administrative Assistant, swore in all parties that wished to speak
on behalf of the listed agenda items.
Petition No. FP 21-41 Discussion and Possible Action – Desert Rose Subdivision
Phase III; a request from Silver Ridge Development, Craig Stoabs, Property
Owner
Planning Manager Escobar presented the following:
Subdivision Information:
• A 14 lot, Class 1 subdivision
• 4.39 acre portion of an undeveloped parcel

• Preliminary Plan and Final Plat were approved in 2003.
• The plat has been amended.

• Property is zoned SF-7: Single Family Residential, 7,000 square feet minimum

Staff Recommendation:
• The Community Works Department recommends approval of Petition 21-41, a
request from Craig Stoabs of Silver Ridge Subdivision represented by Robert
Echols of Cheney-Walters-Echols, Inc. for a final plat of a Class 1, 14-lot
subdivision on a 4.39-acre portion of an undeveloped parcel located north at the
north terminus of Beckland Drive in northeast Farmington. The lot sizes for
Phase VII range from 7,000 square feet to 17,901 square feet.
1. All technical corrections to the plat and construction drawings will be finalized
and approved prior to submittal of the final plat for signature, including noted
issues in this report.
2. A subdivision agreement shall be required.
3. Infrastructure construction shall not commence without an approved
construction permit from the City. Inspections shall be required.
Discussion
Chair Cardon asked if the issue brought up by the Wastewater Division regarding the
pond was addressed.
Planning Manager Escobar stated that it was addressed through the new construction
plans.
Commissioner Swell asked if this was Phase 7 of the subdivision.
Planning Manager Escobar stated that this is Phase 3.
Craig Stoabs, 4800 College Boulevard, stated that he does own the property on Pinon
Hills Boulevard and the construction and plat issues have been reviewed with the
Engineering Department.
Chair Cardon asked if there was anyone who would like to speak regarding this petition.
There was noone.
Chair Cardon closed public comment and opened commissioner's discussion. There
was no discussion.
Motion
A motion was made by Commissioner Smouse and seconded by Commissioner
Ragsdale to recommend APPROVAL of FP 21-41 as recommended by staff. The
motion carried unanimously 5-0.

Discussion & Possible Action – Discussion & Possible Action regarding
Proposed Changes to the 2021 Unified Development Code regarding Adult Use
Cannabis
Beth Escobar, Planning Manager, presented the following presentation:
Local Jurisdictions May:
• Adopt time place and manner rules that do not conflict with the Cannabis
Regulation Act or the Dee Johnson Clean Indoor Act;
• This includes rules that reasonably limit density of licenses and operating
times consistent with neighborhood uses
• Allow for smoking, vaporizing and ingesting cannabis products within an indoor
or outdoor cannabis consumption area if:
• Unless licensed pursuant to the Lynn and Erin Compassionate Use Act,
access to the cannabis consumption area is restricted to persons twenty-
one years of age or older; and
• The cannabis establishment or microbusiness is located at a minimum
distance from a school or daycare center as determined by the local
jurisdiction- minimum distance cannot be more than 300 feet from a
school or a daycare that is in existence at the time the business is
licensed
Local Jurisdictions Shall Not:
• Prevent transportation of cannabis products on public roads by a licensee
transports cannabis products in compliance with the Cannabis Regulation Act
• Completely prohibit the operation of the licensee
• Prohibit or limit signage attached to or located on licensed premises that
identifies the premises as a cannabis establishment
• Require a licensed premises or a cannabis consumption area to be any more
than three hundred feet from a school or daycare center that was in existence at
the time the cannabis establishment or integrated cannabis microbusiness was
licensed
• Require an existing licensee at a licensed premises to relocate
• Prohibit a person from producing homegrown cannabis as provided in the
cannabis regulation act
• Which means 6 plants per a person over 21 in the household with a
maximum of 12 plants total
General Provisions of the Law
• A person can possess from 2 ounces up to 8 ounces
• A person can only have 2 ounces physically on them the rest must be kept in a
private location not viewable to the public if they are 21 or older
• Marijuana drug paraphernalia is legal to possess
• A person can have 6 plants in their house out of public view if they are 21 or
older and if two or more people who are 21 or older reside in the house there is a
maximum of 12 plants total
• Prohibits the consumption of marijuana on sidewalk streets and public places
Proposed Revisions to Municipal Ordinances
• Possession of Drug Paraphernalia to reflect that if a person is 21 years of age or
older that it is legal to possess marijuana drug paraphernalia
• Possession of Marijuana to reflect the allowance of 2 to 8 ounces of marijuana
under the law
• No smoking in public places- propose a new ordinance limiting where marijuana
can be smoked either in a cannabis consumption area or in the privacy of
persons house. Would prohibit the smoking of marijuana in a car, the street, the
sidewalk, public places or outdoor areas
Proposed Revisions to the Unified Development Code
• Allow retail sales in GC: General Commercial only
• Allow production and manufacturing in GC and Industrial Districts with a Special
Use Permit
• Cultivation not allowed within the City
Areas colored in blue are GC (general commercial), where retails sales would be
allowed and production would be allowed in industrial zoning.
Proposed Revisions to the Unified Development Code
• Specifically exclude cultivation for retail use in RA: Rural Agriculture
• Cultivation of cannabis and manufacturing of cannabis/cannabidiol products for
retail sales are not permitted as a Home Occupation.
• Prohibit sale of cannabis products from Mobile Food Units
• Limit number of retail sales facilities to 25
Conclusion
• These recommended revisions balance support for this new economic segment
while protecting public health and safety.
• Proposed revisions are consistent with existing zoning regulations.
Discussion
Commissioner Sewell asked why the verbiage is “legal possession from 2 ounces up to
8 ounces” and not just "up to 8 ounces".
Planning Manager Escobar stated that she would ask.
Commissioner Swell asked, with the limiting of the number of sales facilities, how will
those be allocated.
Planning Manager Escobar stated that it would be on a first come first serve basis. The
applicants would go through the State of New Mexico to be licensed and then obtain a
business license with the City of Farmington.
Chair Cardon asked if changes could be made to the UDC as the process starts and
could variances be issued.
Planning Manager Escobar stated that was correct and special use permits would allow
us to bring applications forward to the Planning & Zoning Commission.
Commissioner Smouse asked Planning Manager Escobar if the reason this is being
brought to the Planning & Zoning Commission's attention is because the commission
could be seeing some petitions regarding cannabis.
Planning Manager Escobar stated yes, as well as for a recommendation to move these
recommendations forward to City Council.
Commissioner Smouse asked if these recommendations are coming from staff or from
City Council.
Planning Manager Escobar stated the recommendations are coming from staff and this
presentation has been made to City Council, other than adopting the limit, council had
very little input.
Chair Cardon stated that she is fine with the recommendations as long as they are open
ended.
Commissioner Smouse stated that with this just being brought forward he does feel
uneducated.
Planning Manager Escobar stated that the discussion could be brought back if there is
something the commission would like her to explore; action does not need to be taken
today.
Commissioner Smouse stated that he would like a little more time to educate himself on
the subject.
Commissioner Sewell asked what types of special use permits the commission would
hear regarding cannabis.
Planning Manager Escobar stated production and manufacturing in industrial and
general commercial zoning.
Commissioner Sewell asked how delivery of cannabis would be handled and can
access be regulated to public roads.
Planning Manager Escobar stated that the State of New Mexico will license the
cannabis transporter, licensed transporters can deliver anywhere and access cannot be
regulated.
Commissioner Sewell asked if transporters would only deliver bulk or if they could
deliver personal amounts of cannabis.
Planning Manager Escobar stated that they can deliver bulk and personal amounts and
it will be the responsibility of the transporter to verify the age of the person that the
cannabis is being delivered to; the transporters would have to go through training and
also be insured.
Planning Manager Escobar asked the commission if there were any specific questions
that they would like to see addressed and brought back to at the next meeting.
Chair Cardon stated that there are vital commissioners not in attendance and she would
like to get their input on the discussion.
Commissioner Lockmiller stated that she agrees with Chair Cardon and that what is
being presented today is all that she has heard on the topic of cannabis.
Commissioner Smouse asked if any of the recommendations being heard today are
based upon any other jurisdictions.
Planning Manager Escobar stated that jurisdictions in Arizona and Colorado were
looked into; discussions were had with the Community Development Director of Aztec
and with San Juan County.
Commissioner Smouse asked if the State of New Mexico allows municipalities to opt
out.
Planning Manager Escobar stated no, the State of New Mexico is all in.
Planning Manager Escobar stated that she would send the commissioners that are not
in attendance today and email and also email all commissions some links on general
information regarding today’s discussion.
Planning Manager Escobar reminded the commission that each commissioner should
only email her and not to the entire commission to keep in line with the Open Meetings
Act.
Commissioner Sewell asked what the consequences are for smoking cannabis outside.
Planning Manager Escobar stated that the prohibition of smoking cannabis outside
follows state law.
Planning Manager Escobar stated that the retail areas are only allowed in general
commercial zoning areas, but will not be allowed downtown which is zoned as central
business. Planning Manager Escobar stated that it was intentional to exclude downtown
due to the public input that was received from over a hundred citizens, as time goes on
the exclusion could be reevaluated.
Commissioner Smouse asked if the commission could get some insight on how the City
Council feels regarding the cannabis recommendations.
Planning Manager Escobar stated that she would email the link to the City Council
meeting where this topic was discussed.
Commissioner Smouse stated that he would like to make sure that any
recommendations made by the commission are not creating any additional hardships on
law enforcement.
Planning Manager Escobar stated that the proposed recommendations have also been
shared with the Police and Fire Department and their input has been received and they
support the recommendations that are being brought forth.
Commissioner Lockmiller asked how many retail medical marijuana outlets are there in
the city and what happens to their licenses.
Planning Manager Escobar stated that there are three and if the business is in good
standing, they will become a retailer.
Commissioner Lockmiller asked if any of the three businesses did cultivation of
cannabis.
Planning Manager Escobar stated that not that she knows of, but if they do, then their
business would become legal non-conforming.
Planning Manager Escobar stated that the State of New Mexico has also not allowed
the restriction of cannabis facilities near churches, which was a restriction with medical
marijuana.
Commissioner Lockmiller stated that in her opinion she does understand that there does
need to be regulations and rules regarding cannabis, but because marijuana is now
legal does not mean everyone is going to go out and smoke marijuana and does not
think that there is going to be an influx.
Commissioner Smouse asked if the City Council has made a decision about the
transportation of cannabis and the consumption and possession of cannabis in a
vehicle.
Planning Manager Escobar stated that she believes that there are still councilors that
are not in consensus, but the City Attorney is working to get documentation together to
present to get consensus from City Council.
Chair Cardon stated that she feels that from what she has heard today and with the
absence of several commissioners, she feels that more time is needed to make a
recommendation. Chair Cardon asked for more information to be presented by staff at
the next Planning & Zoning meeting.

of the Comp Plan as well. Planning Manager Escobar asked the commission to please
take time to read the Comp Plan.
Adjournment: With no further business and a motion to adjourn was made by
Commissioner Ragsdale and seconded by Commissioner Sewell. The motion carried
unanimously 5-0 and the meeting was adjourned at 3:58 p.m.

GENERAL INFORMATION
The petitioner is requesting final plat approval for the Mesa Vista #8, a Class 1, 77-lot
subdivision on a 20-acre portion of an undeveloped parcel located south of Wildflower
Mesa Drive. Farmington. Lot sizes for Phase VII range from 7,240 square feet to 1,106
square feet. The plat also includes a drainage pond located in the southwest corner.
The proposed subdivision is an addition to previous Mesa Vista Subdivisions developed
on properties to the west.
Phase VII, No. 1 is the first stage of Phase VII, which received preliminary plan approval
from the City Council on January 26, 2021. This phase includes one, non-buildable lot
(#4). A 60-foot wide gas line right-of-way transects the northern portion of the plat.
ISSUES IDENTIFIED DURING INITIAL REVIEW

The City has not received documentation that the detention pond area of 0.241 acres is
sufficient for the required drainage.
Sakura provided a watershed model schematic with a hydrograph summary report.
This report is not sufficient for engineering staff to do our reviews for drainage detention
pond sizing. What I need and what I have asked for multiple times is for the engineer
(Sakura) to provide a written statement of what these calculations mean. I specifically
need the engineer (Sakura) to make a written statement with the following information:
1) What is the required pond sizing/detention for this development?
2) What are the dimensions of the pond to be placed?
3) Is the lot size of 0.241 acres (proposed on Final Plat), large enough to accommodate
the pond area and volume required for this development?
In the original submittal, Sakura's calculations, stated on their plans, showed a required
volume for detention that was 3 times greater than the proposed pond. The revised
calculations need to show that the pond is equal to or greater in size and volume
capacity than the requirement for the development. I have yet to receive plans from
Sakura that show calculations and ponding size that correlate with required detention
for development. Without correct information from Sakura, regarding drainage, I am
unable to determine if the 0.241 acre lot proposed in this subdivision for the detention
pond is sufficient.
Staff Comment: These issues have been addressed through submittal of a
revised Drainage report.
Per Section 8.8.4 of the Unified Development Code, all subdivisions shall comply with
the following minimum standards:
A. Design and improvement standards. All subdivisions shall be designed and
constructed in accordance with applicable requirements of:

(1) Article 5, development standards; and
(2) Article 6, subdivision design and improvements.
Staff Comments: Through staff review, the plat as presented meets, or will be
required to meet through stipulations of approval, development standards and
design and improvement requirements.
The developer shall be obligated to construct and dedicate the extension of
Wildflower Mesa Drive through to Andrea Drive.
B. Waivers. The commission may recommend and the council may approve,
approve with conditions, or deny waivers of the standards in section 6.4,
subdivision design standards, during the platting process.
Staff Comments: No waivers are requested for this application.
C. Zoning consistency. All subdivisions and the resulting lots shall be consistent
with the requirements of the applicable underlying zone district.
Staff Comments: All lots conform to the minimum standards of the MF-M: Multi-
family Low Density residential zoning district.
D. Comprehensive plan consistency. All subdivisions shall be reviewed for
consistency with the comprehensive plan, and every plat approved by the city
shall constitute an amendment, addition or a detail of the comprehensive plan or
part thereof adopted by the commission.
Staff Comments: The proposed single-family use is consistent with the
Comprehensive Plan Land Use map which designates this area as Residential
Single Family Suburban.

STAFF CONCLUSION
Staff concludes approval of Petition 21-50, Mesa Vista #8, is appropriate, subject to
technical and corrective changes as enumerated in this report.
STAFF RECOMMENDATION
The Community Works Department recommends approval of Petition 21-50, a request
from Mike Hamilton, represented by Paul Martin of Sakura Engineering, for a final plat
of a Class 1, 77-lot subdivision on a 20-acre undeveloped parcel located south of the
terminus of Wildflower Mesa Drive.
1. All technical corrections to the plat and construction drawings will be finalized
and approved prior to submittal of the final plat for signature, including noted
issues in this report.
2. The Summary Plat for Amended Cecil’s Subdivision No. 2 Replat A dedicating
the right-of-way for the extension of Wildflower Drive shall be recorded prior to
recording of the final plat for Mesa Vista No. 8.
3. A subdivision agreement shall be required. The subdivision agreement shall
include the obligation of the developer to construct to City standards and
dedicate the extension of Wildflower Mesa Drive to Andrea Drive.

Subject: 2040 Comprehensive Plan – Navigating Farmington’s Future
Background
A comprehensive plan provides a vision for the community on how to guide development for the
next twenty years. It provides a long-range, high-altitude view, of strategies to ensure that the
City is moving in the right direction.
The Comp Plan is not a regulatory document, like the Unified Development Code. The Comp
plan identifies the community assets that should be strengthened and preserved, and what
components we want to bring to the City to make it an even better place to live.
September 2019 was the kick off date for the Comprehensive Plan update. Working with our
consultant, Logan Simpson, a series of meetings were held with a Technical Committee, made
up of staff, and a Steering Committee, made up of stakeholders from the community. These two
committees identified the important topics. Through these meetings, the framework maps and
vision statements in Part 3 of the plan were developed.
Public input was solicited early on in the process, including information booths at the Downtown
4 x 4 Takeover, San Juan County Health Fair and Booapaloza in 2019. A website was setup
dedicated to the Comp Plan with the ability for the public to submit comments and complete
surveys.
On January 30, 2020 the City hosted the Jolt Your Future event at the Civic Center. This
catered event was open to the public and presented speakers on four topics identified as critical
to Farmington’s future:
1. Outdoor Recreation
2. Becoming a retirement friendly community
3. Broadband connectivity
4. The Film Industry
Over 200 people attended the event and provided feedback that has been incorporated into the
plan.
After correlating input from the committees and public, a draft plan was created and made
available in December 2020. Because of the health restrictions related to the pandemic, the
Council decided to postpone additional public outreach regarding the plan until restrictions
eased. This lead to a 30-day intensive outreach public outreach process to gather comments on
the draft plan from July 6 through August 6, 2021.
What is in the plan?
In Chapter 2, the plan provides a snapshot of where Farmington is at today, including population
and economic information. It also includes information on internal and external transportation
networks, and provides a visual of land ownership surrounding the Farmington metropolitan
area.
Chapter 3 provides a framework for moving forward within several segments, including housing,
land use, transportation, downtown, parks and recreation and economic development. The
goals identified for each segment will guide future development.
Chapter 4 includes the Future Land Use Plan. This map does not change the zoning of any
individual properties, but provides a vision the best locations for types of future development
such as retirement communities and mixed use commercial and residential developments.
What happens after the plan is adopted?
This will not be a sit on the shelf plan. Staff is currently working on sorting through the Strategic
Action Plan in Part 5 and identifying those actions that should and can be addressed within the
next five years.
A copy of the Implementation Strategies, with those projects highlighted that will require
Commission input, is attached with this report.
The plan will be evaluated every five years to gauge progress and the implementation plan will
be adjusted to ensure priorities are being addressed.
In addition, the updated comprehensive plan will provide recommendations to guide
Farmington’s governing bodies in decision-making, such as evaluating zone change requests,
and to move policy and development forward in an intentional and productive way.
From conversations we’ve had with the community, we know that there are an array of
challenges and opportunities with the potential to transform Farmington into a healthy and
sustainable economy for the future. The 2040 Comprehensive Plan will serve as our guidebook
to get us there.

Background
Staff first presented proposed changes to the UDC in response to the recent legalization
of recreational marijuana at the August 12, 2021 Commission meeting.
Use Table
Staff is recommending retail sales of marijuana be permitted in GC: General
Commercial zoning districts only. (Section 2.4.41)
The General Commercial District is defined as:
Sec. 3.13 - General commercial (GC).
3.13.1 Purpose. The general commercial (GC) district is intended to
accommodate commercial uses. The GC district is not a neighborhood-oriented
district and is not generally appropriate for application within residential areas.
It is intended to be used to accommodate existing commercial uses along
thoroughfares. It may also be used to accommodate new development
proposals. In all cases, new development in the GC district should be adequately
served by infrastructure.
The GC district is intended to implement the planning policies of the
comprehensive plan's "Commercial" land use designation.
3.13.2 Allowed uses. Uses are allowed in the GC district in accordance with the
use table of section 2.3.
3.13.3 Density and dimensional standards. All development in the GC district is
subject to the density and dimensional standards of section 2.8.
3.13.4 District standards. District standards applicable in the GC district include
the following:
A. Utilize architectural styles and building materials for all structures that are
commonly used in the surrounding neighborhood. The architectural style and
materials used for all structures shall be complementary to that of other
structures in the area or vicinity.
B. Exhibit a unity of design for buildings within multi-building complexes
through the use of similar elements such as rooflines, materials, window
arrangement, sign location, and details.
Staff has been contacted regarding retail marijuana sales in the Central Business
District.
3.14.1 Purpose. The central business (CB) district is primarily intended to
accommodate the moderate to high intensity business activities that
characterize the city's cultural and business center. The CB district is
appropriate for application in the downtown neighborhood as described in
the comprehensive plan.
The CB district is intended to implement the planning policies of the
Comprehensive Plan's "Commercial" land use categories, as further qualified
by Chapter 13, downtown neighborhoods.
The vision for the downtown area, per the 2019 MRA plan, is as a destination place for
residents and tourists alike with an emphasis on retail sales, activities and events and
recreation. The recent large investment in the outdoor streetscape by the City reflects
and supports this vision.
Allowing cannabis sales in the Central Business area appears to be in conflict with this
family and tourist friendly vision.
Production and Manufacturing
The extraction of cannabis and cannabidiol oil from plants involves the use of various
solvents, including ethanol, carbon dioxide, propane and butane. Because of the
flammable nature of these products, staff is recommending production be allowed within
the GC and Industrial Zoning Districts with a Special Use Permit. (Section 2.4.42)
Home Occupation
Per the new state law, residents may grow up to a maximum of 12 cannabis plants at
their homes. In order to reinforce that these plants are only to be used for personal
consumption, staff is recommending language be added to Section 2.5.9
Agriculture
Agriculture is permitted in the RA (Rural Agriculture) District only. Staff is suggesting
that language prohibiting the cultivation of cannabis as an agricultural use in the RA

Food Trucks
Staff is also recommending adding language prohibiting the sale of cannabis products
from mobile food trucks (Section 2.4.66).
With these recommended revisions, staff is hoping to balance support for this new
economic segment while protecting public health and safety.
Council Input
The code changes noted above have been presented to Council and received
consensus.
A list of the recommended red line changes is included with this report.
Action
At the August 12 meeting, the Commission asked for more time to review the proposed
revisions. Staff is hoping that the changes are ready to forward to Council.
