UDC 8.7.4 – Issues For Consideration
A. Is the proposed zoning consistent with the Farmington Comprehensive Plan?
The proposed zoning shown in the Comprehensive Plan is Mixed Use Village, which promotes
redevelopment of older structures or vacant land along arterial corridors that introduces a mix of
residential development types and commercial services.
B. Is the proposed zoning and land use(s) compatible with the present zoning?
The proposed zoning is compatible with the present zoning and the character of the
neighborhood. General Commercial zoning exists at the north and south ends of Iles Ave.
Properties directly to the west along E Main St. are zoned General Commercial. A rezone to GC,
General Commercial is compatible with the surrounding area.

C. Will there be adverse impacts; and/or can they be adequately mitigated?
No immediate adverse impacts are noted. Any future commercial development on the property
shall comply with the residential protection requirements of Section 5.10 of the Unified
Development Code.

Any future commercial development shall comply with the regulations of the GC: General
Commercial District.
E. Is the site physically suitable for development of uses and density permitted by the
proposed zoning district?

The site provides easy access and favorable topography for commercial development along a
major arterial thoroughfare, located in the direct vicinity of other existing commercial uses.
F. Are adequate public facilities and services available to serve development for the type
and scope suggested by the proposed zone? If utilities are not available, could they be

reasonably extended by the applicant?
All utilities are either existing or directly accessible.
G. Does the proposed change constitute “spot zoning” as defined in Article 11,
definitions?
UDC Article 11 defines spot zoning as ‘where a particular tract within a larger area is specifically
zoned so as to impose upon it restrictions not imposed upon the surrounding lands, or grant to it
special privileges not granted generally, not done in pursuance of the Comprehensive plan’. The
proposed Zone Change does not constitute spot zoning by this definition.

In staff’s opinion, the zone change request is appropriate for the neighborhood. It will revitalize

a dilapidated area and is supported by the general character of the neighborhood.
Staff Recommendation
The Community Development Department recommends approval of Petition ZC 25-03, a
request from Carl and Wanda Cordell, property owner, for a zone change from SF-7: Single
Family Residential to GC: General Commercial, to allow for commercial development on the
property at 3315 Iles Ave.

1. How does General Commercial deal with outside storage?
2. Has there been a final determination if there needs to be an additional fire hydrant
installed at this property?

Staff Replied:
1. Regardless of the zone change, the petitioner is still required to clean up the property to
address the orders from Code Compliance. The zone change does not preclude the
property being cleaned up.
Staff had considered putting a condition on the zone change that the petitioner would
need to have his property cleaned up by a certain date or the zoning would revert back
to Single Family – 7. Staff decided not to add that condition because if the property was
reverted back to Single Family – 7 it would not benefit the city or the petitioner.
2. If the property gets approved and developed, if an additional fire hydrant is required it
would be decided on at that time. It would depend on how the property was developed.
3. There is a large empty lot to the east that is zoned Residential and General Commercial.

4. According the Land Use Plan, that is the goal.
Petitioner Carl Cordell, 5207 Hubbard Rd., Farmington NM
Mr. Cordell stated that he has owned this property for about 40 years and used to run a nursey
there. He talked about how this lot and a lot that he owns down the road have been used for
storage and other things over the years and how it ended up in the state it is on now.
The Commission Asked Petitioner:
1. What is the reason behind this zone change request?
2. The current violations regarding the Code Compliance issues, are they under appeal? If
not, how long has it been since the appeal process was concluded?
Petitioner Replied:
1. He is considering selling this lot and believes that he can sell it for more money if it is
zoned General Commercial.

2. No, it has been six to eight months since the appeal process was concluded. He stated
that he knows he needs to clean up his properties.

1. How long does Mr. Cordell have to follow the UDC Sec 5.10 residential protection
regarding the fencing on that lot?
2. At what point will the City go in and clean up residential properties?
Staff Replied:
1. That is part of the development stage. If Mr. Cordell develops the property, the required

residential protection would be part of the permitting process.
2. It is usually at the point where the property becomes a health or environmental hazard. If
the City does clean up the property a lien would be placed on that property for the amount
of the cleanup.

The Commission had a discussion regarding setting conditions giving Mr. Cordell a time frame
to get this lot cleaned up.

recommend APPROVAL of Petition ZC 25-03 as recommended by staff and adding the following
condition of approval:
1. The property will be cleaned up to comply with the orders from Code Compliance within

• The 2040 Future Land Use Map designates this area as Mixed-Use Village. This
designation supports mixed-use development such as Commercial uses. The zone
change to General Commercial will align with the 2040 Future Land Use designation.
B. Is the proposed zoning and land use compatible with the present zoning and
conforming uses of nearby property and the character of the neighborhood?

• The proposed General Commercial zoning and land use is compatible with the current
conforming uses and character of the neighborhood. There are also General Commercial
zoning districts to the north, west and south of the subject property. The zone change to
General Commercial will bring into compliance the existing use.
C. Will there be adverse impacts; and can any adverse impacts be adequately mitigated?
• The use is expected to have a similar average daily traffic count as the existing use and
surrounding uses. Iles Avenue is classified as a local street according to the City Major
Thoroughfare Plan well suitable for the already existing use.
D. Is the proposed density and intensity of use permitted in the proposed zoning district?
• Per UDC Section 2.8, the proposed General Commercial zoning district allows an office
and equipment and vehicle storage yard. There is no minimum lot size under the GC
zoning district. The change from Single-Family 7 to General Commercial will bring the
current existing use into compliance allowing the intensity of the use to be appropriate for
the zoning district.

PRESENT SITUATION: The subject property is a 48.95 acre parcel situated between Dustin
Ave and Butler Ave, south of E. 30th St. The property is developed as the Civitan Golf Course,
Civitan Park, Worley Field, and Farmington Fire Station 5.
PROPOSED CHANGE OR REQUEST: The applicant is requesting a zone change for the
parcel from Single Family – 7 to Mixed Use. As part of this petition, a Special Use Permit is
requested to allow for a possible eating establishment serving liquor at Civitan Golf Course. The
golf course currently sells various prepackeaged foods and does not plan to add a restaurant to
the site, only to serve prepackaged alcoholic beverages.

STAFF ANALYSIS
UNIFIED DEVELOPMENT CODE COMPLIANCE
UDC Section 8.7 Zoning Map Amendment (rezoning)
The Unified Development Code states that the City shall consider whether the proposed zoning
and land use are compatible with the conforming zoning and land use of nearby properties and
with the character of the neighborhood. Section 8.7.4 of the Unified Development Code (UDC)
outlines issues for consideration in determining a proposed zone change as follows:
A. Is the proposed zoning consistent with the Farmington Comprehensive Plan?
The 2040 Future Land Use Map designates this area as “Parks”. This designation
supports outdoor recreation activities which include the existing uses on the property (golf
course, park playground, and sports fields). The Mixed Use district is consistent with the
Comprehensive Plan designation as it allows said uses, while allowing for the expansion
of existing facility services.
B. Is the proposed zoning and land use(s) compatible with the present zoning and
conforming uses of nearby property and the character of the neighborhood?
North: Multi-Family Medium Density & Single-Family 10 – Residential & Apartments.
South: Local Neighborhood Commercial – Retail & Service Businesses.
East: Single-Family 7 – Residential.
West: Single-Family 10 & Multi-Family Medium Density – Residential, High School,
Apartments.
The golf course, park and other uses will remain, the change to the Mixed Use district
accommodates low-intensity uses with a strong residential character, appropriate for the
proposed area with adjacent neighborhoods and neighborhood commercial uses.
C. Will there be adverse impacts; and/or can any adverse impacts be adequately
mitigated?
No adverse impacts are anticipated with this zone change request. As mentioned, the
subject parcel is already developed. The existing uses are compatible with the
surrounding area as is the proposed Mixed Use district. The most intensive use on the
property is the golf course, with possible future expanstion of services which is located
on the south end of the property nearby more intensive commercial uses- by which the
proposed/existing use is highly compatible. Any adverse impacts related to the use of
‘eating establishment serving liquor’ is described in the next section, special use permits.
D. Is the proposed density and intensity of use permitted in the proposed zoning
district?
The intensity and density of use allowed under Mixed Use zoning are appropriate, as the
golf course and recreational facilities are already established and compatible with the
surrounding area.
E. Is the site physically suitable for development of uses and density permitted by
the proposed zoning district?
The 48.95-acre property far exceeds the minimum lot size for a Mixed Use district and is
physically suitable for the proposed zoning change.

F. Are adequate public facilities and services available to serve development for the
type and scope suggested by the proposed zone? If utilities are not available,
could they be reasonably extended by the applicant? Is the applicant willing to
pay for the extension of public facilities and services necessary to service the
proposed development?
The property has direct access from Dustin Ave, a Minor Arterial street, ensuring
sufficient traffic capacity. Public services (water, sewer, emergency services) are already
in place and sufficient for the site.
G. Does the proposed change constitute “spot zoning” as defined in Article 11,
definitions?
Section 11.1 of the Unified Development Code defines spot zoning as: Where a
particular tract within a larger area is specifically zoned so as to impose upon it
restrictions not imposed upon the surrounding lands, or grant to it special privileges not
granted generally, not done in pursuance of the Comprehensive Plan.
The proposed Zone Change does not constitute spot zoning by this definition because
it is in compliance with the Comprehensive Plan. T
UDC SEC. 8.9 – SPECIAL USE PERMITS
8.9.1 Purpose: Allows for City Council discretionary approval of uses with unique or widely
varying operating characteristics, neighborhood compatibility uses, or unusual site
development features, subject to the terms and conditions set forth in this UDC.
8.9.2 Applicability: Special Use Permits may or not be appropriate in a given zone district
depending upon the nature and compatibility of surrounding uses, and mitigating site-specific
conditions or requirements. Such uses require individual review of their location, design,
configuration, density, and intensity, in order to determine whether or not a use should be
allowed; and may require the imposition of additional conditions in order to ensure the
appropriateness and compatibility of the use at a particular location.
o Special use permit approvals attach to the property and are transferable to
subsequent owners.
8.9.3 Special use application process: The Special Use Permit application process shall be
followed per UDC Sec. 8.9.3
Pursuant to UDC 8.9.3(H) the Special Use Permit may be revoked by this section
whenever:
It is determined that a use of property for which a special use permit has been
granted is not being conducted within the terms of the special use permit including
[section] 8.9.4 special use criteria; that such use has been allowed to accumulate
litter or debris, to be a public nuisance, to an attractive nuisance to children, or to
attract vagrants, criminals or public intoxication; or is otherwise detrimental to the
public health, safety or welfare.
Before the special use has commenced, and it is determined that such special use
is not in the public interest; or
The owner of the property affected petitions for revocation.

8.9.4 Special use review criteria: Special use permits may be approved where it reasonably
determines that there will be no significant negative impact upon residents of surrounding
property or upon the public.
As part of this Special Use Permit application review, staff has considered the following
criteria:
A. Effect on environment:
The proposed use of a eating establishment serving liquor will have no detrimental
effect on the environment, nor will it be permanently injurious to the neighboring
properties.
B. Site compatibility with surrounding area:
The subject property currently consists of a golf course, play field, and park. The public
facing building at Civitan Golf Course is approximately 1,984 square feet in size, built
in 1980. The existing site, vehicle circulation, buildings and archetectual designs are
harmonious with the character of the surrounding area with relationship to scale,
height, landscaping, screening and density. Adding the use of ‘eating establishment
serving liquor’ to the site will not impact the site compatibility. Any future expansion of
buildings would be complimentary to the existing uses.
C. External impacts mitigated?
An eating establishment serving liquor has the possibility of creating adverse impacts
on the surrounding area:
Traffic & Parking Demand- The added service provided at the golf course may lead to
increased vehicle trips to and from the golf course during peak hours and increase the
parking depand for the facility. Civitan Golf Course is only accessed from Dustin Ave
which is classified as a Minor Arterial street, adequate for the use. The peak usage of
the golf course is on the weekends and during summer months, which Farmington
High School is not in session- as such the use is not expected to significantly contribute
to school peak time traffic volumes. 9-hole golf course requires a minimum of 27
parking spaces. The site currently provides approximately 53 parking spaces (two of
which are ADA/Van accessible), more than adequate for the expansion of serving
liquor.
Noise & Lighting- Liquor service, more specifically the consumption of alcoholic
beverages outdoors may result in an increase in noise levels. Civitan Golf Course does
not plan on amendeding the hours of operation, which are currently 8:30a-dusk (during
Winter months) and 7a-9p (during summer months). Increased noise during these time
frames are not expected to have a significant impact on surrounding uses. The
Farmington City Code (FCC) has established maximum permissible sound levels,
which for the Mixed Use district is 65 dBA. For reference, a Yale University study on
decibel level comparisons is found in Exhibit E. Civitan Golf Course is a day-time use
facility and has limited outdoor lighting. The only outdoor lighting is on the west side of
the property at the golf course building and horse shoe area. The property is well
screened with dense vegetation along many of the property boundaries which provides
noise and light buffering between the golf course and residential uses to the north and
east.
Public Safety- Alcohol service near a high school and residential neighborhood may
lead to concerns about public intoxication, loitering, or DUI incidents. There are
systems in place or proposed in order to prevent alcohol related disturbances. The golf

course is completely fenced with controlled entry on Dustin Ave. Liquor service will be
restricted to consumption on site only, following all federal and state requirements.
Staff members handling liquor service are required to obtain a servers permit through
the State of New Mexico and keep current with all necessary training. Civitan Golf
Course utilizes security cameras strategically placed on the property and are
monitored at the main building by staff and is connected to FPD’s Real Time Crime
Center system.
The proposed use is expected to operate similarly to the Pinon Hills Golf Course which
also serves liquor.
D. Infrastructure impacts minimized
No infrastructure impacts are anticipated with the proposed use.
E. Consistent with the UDC and comprehensive plan
Eating establishments serving liquor are subject to the approval of otherwise required
liquor license(s). The Comprehensive Plan designates this area as “Parks” which
specifically allows golf courses. A eating establishment serving liquor is a
complementary use to the golf course.
F. Parcel size
The subject property is approximately 48.95 acres in size, more than adequate for the
proposed use.
G. Site plan
The applicant has submitted a site plan in conformance with the UDC.
PUBLIC COMMENTS
This petition has been properly noticed. Letters were sent to 60 surrounding property
owners. At the time of this report staff has received one inquiry from an affected property
who was issued a public notice letter. The affected property owner requested more
information on the change, afterwards stated that they did not have a concern. Any further
public input will be provided at the time of the staff presentation.
STAFF CONCLUSION
The proposed zone change to Mixed Use is supported by the “Parks” designation of the
2040 Comprehensive Plan.
The proposed zone change and use is compatible with the zoning and uses within the
surrounding area.
The proposed use complies with the Unified Development Code density standards
outlined in UDC Sec. 2.8.
The proposed use meets the standards of the UDC for a Special Use Permit.
STAFF RECOMMENDATION
The Community Development Department recommends APPROVAL of Petition ZC 25-10, a
request from the City of Farmington represented by Natalie Spruell, for a zone change from Single
Family – 7 to Mixed Use and Special Use Permit to allow for a eating establishment serving liquor
on site with the following condition of approval:
1. One Accessible parking space will be added to the Civitan Golf Course parking lot, for a
total of three.
