FESTUS CITY COUNCIL
MEETING MINUTES
November 20, 2023
The City Council of the City of Festus, Missouri met in regular session on November 20,
2023 at 6:00 p.m. The following Council members were present for roll call in the
Council chambers: Boyer, Collier, Wehner, Venz, Dennis (via Zoom), Templeton, Cook
and Tinnin; Absent – None. Mayor Samuel F. Richards presided over the meeting. Also
present in the Council chambers were City Administrator Greg Camp, Finance Director
Michelle Vaughn, City Clerk Kerry Patek, Police Chief Doug Wendel, Fire Captain Jeff
Broombaugh, Parks Director Josh Whaley, Public Works Director Matt Unrein and City
Attorney Brian Malone.
Council, staff, etc. then said the Pledge of Allegiance.
Approval of Consent Agenda
Mayor Richards asked for a motion to approve the consent agenda. Mayor Richards
announced the bills were in the amount of $282,166.44. Motion to approve the consent
agenda, the bills and minutes of the Council Meeting of October 10, 2023 was made by
Councilman Cook, seconded by Councilman Boyer and approved by the following votes:
Ayes – Boyer, Collier, Wehner, Dennis, Templeton, Cook, Tinnin and Venz; Nays –
none.
Mayor Richards introduced new Finance Director Michelle Vaughn.
Mayor Richards presented the Festus High School Boys Cross Country team with a
proclamation for being the state champions in their division.
Officer Rachel Bailey gave a presentation to the Mayor/Council/Staff regarding the
homeless coalition she is participating in to address homelessness in Festus and the
surrounding areas.

Bids
Street Department – Fencing/Automatic Gate Public Works
Street Foreman Shain Dollar requested that Council approve the quote from J&M
Construction & Fencing LLC for $30,089.66. Sealed bids were opened on October 31,
2023 for bids to replace the fence and automatic gate at the public works building.
Public Works Director Matt Unrein gave a staff report. Councilm an Venz m ade a

approved by the follow ing votes: Ayes – Boyer, Collier, W ehner, Tem pleton,
Venz, Dennis, Cook and Tinnin; Nays – none .
HVAC at 410 West Main Street
City Administrator Greg Camp requested that Council allocate funds from the 400 West
Main Street improvement budget for replacement of the HVAC system at 410 West
Main. Three bids were received as follows: Pioneer Mechanical $9,576.00; Crystal
Heating and Cooling $9,889.00; and Trane $17,851.00. Greg Camp gave a staff report
and recommended accepting the low bid from Pioneer Mechanical. Councilm an

Fire Department – Three Garage Door Openers
Fire Chief Jeff Broombaugh requested permission to purchase three garage door
openers from Edelen Door and Window for $5,400. Chief Broombaugh provided a staff

Fire Department – Ice Machine
Fire Chief Jeff Broombaugh requested permission to purchase an ice machine from
Session Fixture Company for a total bid of $5,933.70. The department also is
requesting to purchase the water filtration system for $311.85. Chief Broombaugh

Fire Department – Five SCBA Comms Masks
Fire Chief Jeff Broombaugh requested permission to purchase five (5) C5 SCBA
Bluetooth communication masks. Two bids were received from the only authorized
dealers of Scott Safety SCBA products: Feld Fire $7,061.25 and Leo M. Ellebracht
Company $7,445.00. Chief Broombaugh provided a staff report and recommended
purchasing the masks from Feld Fire. Councilm an Collier m ade a m otion to

Fire Department – Fire Hose
Fire Chief Jeff Broombaugh requested permission to purchase twenty (20) sections of
2.5” fire hose and twenty (20) sections of 1.75” fire hose from Banner Fire Equipment.
Captain Spradling requested and received five bids. After review of all bids staff
recommend purchasing from Banner Fire Equipment for $8,740.00. Staff also is
requesting to purchase an additional eight (8) sections of 1.75” hose for $1,960. Chief

Park Department – Snow Plow and Brush Hog for John Deere
Park Director Josh Whaley requested that Council allow the purchase of a snow plow
and brush hog for the John Deere Tractor. Josh Whaley gave a staff report asking to
purchase a cutter $9,875.00 and a snow plow $3,525 from McCoy Construction and

Park Department – Zero Turn Mowers
Park Director Josh Whaley requested that Council allow the purchase of two (2) Ferris
ISX330 zero turn mowers in the amount of $33,998.00 from Scott’s Power Equipment.
Josh Whaley stated that two bids were received from local vendors. Josh Whaley gave

Bill No. 4749 - An Ordinance of the City Council of the City of Festus, Missouri;
awarding a bid for certain products and services to the lowest and best bidder as
reflected in the responses to the request for proposals for on-call landscaping services;
authorizing the Mayor and City Administrator to enter into and execute an agreement
with All Seasons Maintenance Services, LLC; authorizing certain other documents and
actions in connection therewith; repealing all Ordinances or parts of Ordinances in

Bill No. 4750 - An Ordinance of the City Council of the City of Festus, Missouri;
authorizing the Mayor to enter into and execute a Water Disconnection Agreement with
Rock Creek Public Sewer District; incorporating said Agreement as a part of this
Ordinance and establishing an effective date; and establishing an effective date. Mayor
Richards called for discussion. Public Works Director Matt Unrein gave a staff report.

authorizing certain other documents and actions in connection therewith; repealing all
Ordinances or parts of Ordinances in conflict herewith; and establishing an effective

connection therewith; repealing all Ordinances or parts of Ordinances in conflict

improvements to publicly maintained roads; incorporating said Agreement as a part of
this Ordinance; prescribing the conditions thereto; and establishing an effective date.

report that this request was recommended for approval by the Planning and Zoning

Appointments
Mayor Richards requested to appoint Clarence Tucker to the Planning and Zoning
Commission. Councilm an Venz m ade a m otion to approve these requests,
seconded by Councilm an Tinnin. M otion carried unanim ously .
Liquor License for 214 Main Street
Courtney Wisely, owner of the Green Room at 214 Main Street requested a full liquor
license. Chief Wendel stated he had reviewed the application and was fine with the
request. Ms. Wisely provided her state liquor license for this location. Councilm an
Cook m ade a m otion to approve this request, seconded by Councilm an Venz.

Old Business - none
Reports
Councilman Boyer – Congratulated Michelle Vaughn on becoming the new Finance
Director for the City. Asked Chief to watch speeders near 712 S. Mill Street. Wished
everyone a Happy Thanksgiving.
Councilman Wehner – Commented on the residents of Edgewood Lane still experiencing
water problems and asked for better communication between the City and those
residents. Asked City Administrator Camp for an update on where we are at with
resolving the water issues the residents are having.
Councilman Cook – Stated that tents should not be allowed in the City and that the City
needs to be more aggressive in removing them when seen. Stated the mural in
Schneider Park looked awesome. Asked about replacing water mains. Asked that
Council have no more one meeting a month as it puts too much on one agenda. Stated
that MoDOT is proposing to fund driver education in the public schools again. Stated
he would once again be running in the St. Jude’s Marathon.
Councilman Collier – Congratulated Michelle Vaughn on becoming the Finance Director.
Councilwoman Templeton – Congratulated Michelle Vaughn on becoming the Finance
Director. Commented on another successful “Ladies Night Out” on Main Street. Asked
the City to check the light on the mural next to Pogolinos and if they could take it over.
Councilman Venz – Congratulated Michelle Vaughn on becoming Finance Director.
Councilman Tinnin – Asked if there had been a discussion with the homeowners on
Edgewood Lane about the pipes in their homes. Greg Camp stated he and Matt Unrein
were discussing the matter. Congratulated Michelle Vaughn on becoming Finance
Director and wished everyone Happy Thanksgiving.
Mayor Richards – Congratulated Michelle Vaughn on becoming Finance Director and
thanked her for her years of dedication to the City. Wished everyone a Happy
Thanksgiving and even though the City had a good year this year to have an even
better one next year.
CLOSED SESSION
Mayor Richards asked for a motion to go into closed session pursuant to Missouri Law
for the purpose of dealing with matters relating to RSMo. 610.021 (1) legal, (2) for
leasing, purchase, or sale of real estate, and (12) documents related to a negotiated
contract. Councilman Boyer made a motion to go into closed session, seconded by
Councilman Collier. Motion was approved as follows: Ayes – Collier, Boyer, Wehner,
Templeton, Venz, Dennis, Cook and Tinnin.
Adjournment
Councilman Cook made a motion to adjourn, seconded by Councilman Boyer. On a call
by the chair the motion carried unanimously. Meeting adjourned.
