Commission Member Present: Chairman Jon Ricciutti, Mary Whitney, and Andy Roy, David Madigan Absent: James McGrath Others Present: Gary Withington, Amy LeBlanc, Nate LaRose, Eric Maynard, Judy Jollimore, Beth LeBlanc and Jim Lattanzi. Meeting opened with the Pledge of Allegiance, led by Andy Roy Minutes of the Meeting: A motion was made by Mary Whitney and seconded by Andy Roy to accept the September 01, 2015 Board minutes be accepted. Motion 4-0. Community Planning Department Report: See attached report. Friends of Coggshall Report A motion was made by Mary Whitney and seconded by Andy Roy that this report be tabled. Motion 4-0. Riverfront Parks and Trails Update Commissioner Roy during the discussion told members present the Commissioner David Madigan was not able to attend the meeting because he was in Maine. He was asked to relay the message to the Park Commissioners Board that he was 100% in favor of approving the new draft agreement that was presented to the Board members from City Solicitor John Barrett. (draft agreement is attached) 1|Page Attorney John Barrett went over the change in the draft that excluded paragraph 4 section D and changed it with the current paragraph 4 section D (Old paragraph 4 section D is attached) Also, Attorney Barrett when over the changes in the Memorandum of Understanding dated 06/10/2015 (MOU) to the new Memorandum of Understanding. (Both MOU’s are attached) A motion made by Jim McGrath and seconded Andy Roy to accept the current agreement for judgement dated 06/26/2015 and to have Attorney John Barrett finalize and end the civil action with the common wealth of Massachusetts by and through its division of capital asset management and maintenance, on behalf of Fitchburg State University. Motion passed 3-0 (see both attached drafts; old 06/10/2015 and approved 06/26/2015) Adjournment: The meeting was adjourned by Jim McGrath and seconded by Andy Roy.
