REPORTS OF COMMITTEES Appointments Committee: Oral report on the following Matters: New Appointments: Treasurer and Collector of Taxes for the City of Fitchburg (Term to expire December 23, 2016) Mr. Calvin D. Brooks 147 Elm St. Gardner, MA 01440 Board of Parks Commissioner (Term to expire April 1, 2014) Mr. Dave Madigan 42 Pierce Farm Rd. Fitchburg, MA 01420 Council as a Whole Committee: 158-2012. Fitchburg Historical Commission to enact the attached proposed by-law entitled, “The Preservation of Historically Significant Buildings”. (Be Tabled) 201-2013. ORDER: Pursuant to Section 3-57 of the Code of the City of Fitchburg, John B. Barrett, City Solicitor be authorized to engage Petrini and Associates as special counsel to represent the City in contractual related legal matters. (Be Given Leave to Withdraw) 243-2001. Jeffrey A. Bean to increase the Mayor’s yearly salary to $65,000 as of January 1, 2002. (Be Given Leave to Withdraw) 306-2001. Patrick Magnan, 33 Longedge Ave. to increase the Mayor’s salary to $55,000 as of January 1, 2002. (Be Given Leave to Withdraw) 46-2002. Robert J. LaFountain and Donald R. Christian, 1251 Water St. to vote “No” on the conversion of Rt. 12 from a 2-lane to a 4-lane highway and on the taking of property along Rt. 12 by eminent domain; and to seek other avenues that would connect Downtown Fitchburg to Rt. 2. Mr. James Connors, Esq., Fitchburg School Committee Vice-Chairman, Ms. Lisa Moison and Mr. Glenn Capone to adopt and enact a $6 million debt exclusion for the Fitchburg Public Schools. ORDER: Transfer $1500 from Mayor Personal Services to Fire Personal Services overtime. A separate Ordinance will be submitted to reduce the Mayor’s salary to accommodate this transfer. AN ORDINANCE: Amending Sec. 10 of Chapter 44 of the Code of the City of Fitchburg by reducing the salary of the Mayor from $60,000 per year to $58,500 per year eff. July 1, 2008 contingent upon the adoption of an Order transferring in the budget the sum of $1500 from Mayor-Personal Services to Fire Personal Services overtime. Councillor Norman Boisvert to take under consideration the possibility of all future appointments to any boards or departments to be residents of the City of Fitchburg, unless otherwise authorized by the City Council. Councillors at Large Marcus DiNatale and Dean Tran to enact a resolution and signed by the Mayor to revoke library borrowing privileges to residents of any city or town that has rescinded library privileges to Fitchburg residents. Anna M. Farrell, City Clerk to review the Mayor’s salary and the City Councilors’ salary, in accordance with Chapter 3-43 0, of the Code of the City of Fitchburg. Wong to appoint a Tax Increment Finance Board to consider and negotiate a Tax Increment Financing Agreement with MassChem, LLC as outlined in the enclosed petition. HEARING 284-13. Special Permit Petition of Carrol F. Nelwan, to petition the City Council for a special permit to own and occupy the property located at 66 Pacific St. Fitchburg, as a two family residence. Property has been used as a 2 family since 1902. VIII. ORDERS 290-13. AN ORDER: Appropr. the sum of $10,767, same to be credited to FIRE EQUIPMENT AND REPAIR and charged against AVAILABLE FUNDS. 291-13. AN ORDER: Appropr. $200,000, same to be charged against AVAILABLE FUNDS and credited to accounts as follows: $10,000 to DPW-SNOW AND ICE PERSONAL SERVICES OVERTIME and $190,000 to DPW-SNOW AND ICE EXPENSES. IX. ORDINANCE 289-13. AN ORDINANCE: Amending Chapter 3 of the Code of the City of Fitchburg, entitled, “Administration” by adding thereto ARTICLE XXXV, Agricultural Commission as outlined in the enclosed Ordinance. (Final Reading) X. SPECIAL PERMIT 292-13. Petition for a Special Permit from the City Council for the Sedona Realty Group, LLC, to use the property at 13-15 Chestnut St. as a five unit building as outlined in the enclosed application. (Public Hearing January 21, 2014) XI. PETITIONS 293-13. Ron Bouchard’s Dodge, to petition the Class II Dealer’s license currently held at 347 Lunenburg St. be transferred to the location at 288 Lunenburg St. 294-13. Larry Casassa, DPW Business Manager, to pass the attached ORDER authorizing the Commissioner of Public Works to execute and discharge loan documents made under the Community Development Block Grant Program and other Community and economic development programs as may become available. Larry Casassa, DPW Business Manager, to pass the attached ORDER authorizing the Department of Public Works to submit an application for and implement a Section 108 Loan guarantee for the economic development project known as Fitchburg Commons at Main, North and Snow Sts. (Finance Committee) 296-13. Jay D. Bry, Vice President of Finance and Administration, Fitchburg State University, to request the City of Fitchburg to declare the parcel of property map 32, lot 128 at 0 “52” Clinton St., surplus and sell. (City Property Committee, Public Works Committee, Planning Board) 297-13. Hon. Lisa A. Wong, Mayor, that Article XXIV, s. 3-210C of the Code of the City of Fitchburg entitled “Purchasing Procedures” be amended so as to allow for the purchase of items costing less than $10,000 by an employee having delegated authority from the Chief Procurement Office as outlined in the enclosed petition. EXECUTIVE SESSION Executive Session with Attorney John Barrett, City Solicitor, to report and discuss strategy in negotiations with PPE/Casino Resorts MA, LLC, concerning the slot parlor project in Leominster.
