CITY OF FITCHBURG MASSACHUSETTS CITY COUNCIL CALENDAR March 6, 2018 7:00PM Memorial Middle School Library 615 Rollstone Street Fitchburg MA 01420 WELCOME TO THE FITCHBURG CITY COUNCIL! This is intended to help you understand the meeting format and assist you with the rules of the Council as they pertain to your participation. All meetings of the Fitchburg City council are open to the public. This does not mean that the public participates in all aspects of the meeting. It simply means that the meeting itself, including all discussions and votes, is open for public view. Executive Session The only time a Council meeting can be closed to the public is when the Council votes for Executive Session in order to discuss sensitive matters in private, such as pending litigation. Any votes taken however, must be taken in open session. OPPORTUNITIES FOR THE PUBLIC TO SPEAK DURING A COUNCIL MEETING: Public Forum The Public Forum occurs immediately following the Pledge of Allegiance. The President will ask if anyone in the audience wishes to speak on any matter appearing on the Agenda. If you wish to address the Council, you must stand and be recognized and follow these rules before speaking: 1. State your name and address. 2. Approach the center table and either stand or sit. This allows you to be seen and heard clearly by everyone in attendance. 3. You may speak only on items appearing on the agenda for no more than (2) minutes. Copies of the agenda are available on the center table prior to the meeting. 4. Please state the petition, order, ordinance, or resolution number to which you refer. Public Hearings Public hearings are held on various issues such as Special Permits and Zoning changes. The same rules apply with the following exceptions: 1. You must stand and be recognized either “in favor” or “in opposition” when asked by the Council President. 2. You need not refer to the petition number. If you have any questions or comments either before or after the meeting, any Councillor would be happy to assist you. Thank you for your interest! I. PUBLIC FORUM II. Bellofatto IV.COMMUNICATION FROM HIS HONOR THE MAYOR Community Development Block Grant Program Year 44 V.COMMUNICATION Pension Reserves Investment Management Board VI.ANNUAL REPORT 042-18. ANNUAL REPORT: Fitchburg Fire Department for the year 2017. VII.REPORTS OF COMMITTEES Finance Committee Meeting of February 27, 2018, 6:00 PM 018-18. ORDERED THAT: There be and hereby is transferred from within the sum of THIRTY THOUSAND AND 00/100 DOLLARS ($30,000.00) same to be transferred from ASSESSOR, PERSONAL SERVICES, DEPARTMENT HEAD and credited to ASSESSOR EXPENSES, CONTRACTED SERVICES. (Be Adopted) 028-18. ORDERED THAT: The City Council, by majority vote pursuant to G.L. c. 4, §4, adopt the provisions of G.L. c. 64N, §3 to impose a local sales tax on the sale or transfer of marijuana or marijuana products by a marijuana retailer operating within the city or town to anyone other than a marijuana establishment at the rate of up to three (3%) percent of the total sales price received by the marijuana retailer as a consideration for the sale of marijuana or marijuana products, the rate to be specified by City Ordinance. (Be Adopted) 029-18. ORDERED THAT: The Honorable Mayor Stephen DiNatale is authorized on behalf of the City of Fitchburg to facilitate and execute the attached Community Host Benefit agreement with Atlantic Medical Partners located at 774 Crawford Street, Fitchburg, MA. (Be Adopted) 030-18. ORDERED THAT: The City of Fitchburg accepts a deed in lieu of foreclosure for municipal charges and taxes for the real property located at 116-118 Day Street. (Be Adopted) Legislative Affairs Committee Meeting of February 27, 2018 024-18. Stephen Curry, Board of Health Director, to amend that attached Petition #165-13 (Intermunicipal Agreement between municipalities participating in the Montachusett Public Health Network, 11 cities and towns, desiring to share key public health services and the costs associated with these services) to include language to add additional municipalities in the agreement. (Be Granted) 025-18. Stephen Curry, Board of Health Director, to approve the attached Intermunicipal Agreement between municipalities participating in the Montachusett Public Health Network desiring to share key public health services and costs associated with these services. This agreement will be utilized for new municipalities approval to participate. (Be Granted) 226-17. Councillor Dean A. Tran and Councillor Angelo Bisol, to establish guidelines and requirements for the City Council involvement in Mayoral appointments under City Code chapter 3-4. (Be amended to: Amend the language of the City Code and be granted as amended) 319-17. Jeffrey Wolfgang, co-chair, Disability Commission, to Petition City Council to amend Fitchburg Ordinance Chapter 3 Article XXIV Section 3-267. (Be Granted) VIII. ORDERS-FINANCE 043-18. ORDERED THAT: The City of Fitchburg hereby approves the expenditure of funds from the Massachusetts Executive Office of Public Safety and Security grant in the approximate amount of $55,000.00 (FIFTY-FIVE THOUSAND AND 00/100 DOLLARS) for the purpose of said grant, which is to support the Domestic Violence Advocate position within the Police Department. IX. ORDER-OTHER 050-18. ORDERED THAT: The City of Fitchburg discontinue and abandon any and all public interests in a portion of Westminster Hill Road as outlined in the enclosed Order. (Reference Petition #114-17) X. ORDINANCE 051-18. A stop sign shall be installed at the intersection of Vernon and Sanborn Street. Section 169-76 of the City Code, titled “Stop intersections” shall be amended by striking the word “South” under the “Direction of Travel” column in the line beginning “Sanborn Street” in regards to its intersection at “Vernon Street” and inserting in its place “Both.” (Reference Petition #297-17) (First Reading) XI. PETITIONS 044-18. Councilors Squailia and Zarrella, and David Thibault-Munoz, to postpone the listing of the 116-118 Day Street property to the side yard sales program in order to explore the possibility of creating a Pocket Park to honor Abolitionist Benjamin Snow. (City Property Committee) 045-18. Councilors Elizabeth Walsh and Marcus DiNatale, along with resident Mary Fritz, to install electronic speed signage or electronic yield/go slow signage at the intersection of Rollstone Road and Brittany Lane, facing traffic coming from Fifth MA Tpke. (Public Safety Committee) 046-18. Councilors Joel Kaddy and Marcus DiNatale, to preferably install stop signs at the intersection of Fifth Mass Tpke. and Franklin Road. However, in the event stop signs are not deemed to be necessary, re- installation of the traffic mirror at this intersection must be done. (Public Safety Committee) 047-18. Councilor Marisa Fleming, to remove the “Do Not enter” sign at the corner of Myrtle Ave. and Main Street. Also put a “No Left Hand Turn” on Main Street onto Myrtle Ave. in front of the old Harper furniture building. (Public Safety Committee) 048-18. Councilors Elizabeth Walsh and Marcus DiNatale, along with resident Mary Fritz, to erect jersey barriers at the corner of 400 Rollstone Road (intersection of Rollstone road and Brittany Lane) to mitigate frequent motor vehicle accidents occurring on this resident’s property. Existing boulders placed there previously are not effectively mitigating encroachment. (Public Works Committee) 049-18. Evan Corrigan, to request that a section of Water Street be repaved.
