CITY OF FITCHBURG MASSACHUSETTS CITY COUNCIL CALENDAR October 16, 2018 7:00PM Memorial Middle School Library 615 Rollstone Street Fitchburg MA 01420 WELCOME TO THE FITCHBURG CITY COUNCIL! This is intended to help you understand the meeting format and assist you with the rules of the Council as they pertain to your participation. All meetings of the Fitchburg City council are open to the public. This does not mean that the public participates in all aspects of the meeting. It simply means that the meeting itself, including all discussions and votes, is open for public view. Executive Session The only time a Council meeting can be closed to the public is when the Council votes for Executive Session in order to discuss sensitive matters in private, such as pending litigation. Any votes taken however, must be taken in open session. OPPORTUNITIES FOR THE PUBLIC TO SPEAK DURING A COUNCIL MEETING: Public Forum The Public Forum occurs immediately following the Pledge of Allegiance. The President will ask if anyone in the audience wishes to speak on any matter appearing on the Agenda. If you wish to address the Council, you must stand and be recognized and follow these rules before speaking: 1. State your name and address. 2. Approach the center table and either stand or sit. This allows you to be seen and heard clearly by everyone in attendance. 3. You may speak only on items appearing on the agenda for no more than (2) minutes. Copies of the agenda are available on the center table prior to the meeting. 4. Please state the petition, order, ordinance, or resolution number to which you refer. Public Hearings Public hearings are held on various issues such as Special Permits and Zoning changes. The same rules apply with the following exceptions: 1. You must stand and be recognized either “in favor” or “in opposition” when asked by the Council President. 2. You need not refer to the petition number. Mr. Glenn Fossa, as a member of the Fitchburg License Commission for a term to expire April 1, 2024. 2. Ms. Donna Pawlak, as a member of the Fitchburg License Commission for a term to expire April 1, 2024. 3. ORDERED THAT: There be and hereby is appropriated the Mayor’s Supplemental Fiscal Year 2019 Operating Budget for the General Fund in the amount of FOUR HUNDRED SIXTY-NINE THOUSAND, FIVE HUNDRED SEVENTY-TWO AND NO/100 DOLLARS ($469,572.00) as follows: School Expenses: $400,000.00 Police, Building Maintenance, Custodian 1,320.00 Health, P.S., Inspectors 27,144.00 Public Health Nurse P.S. 2080.00 Building P.S., Inspectors 26,728.00 Council on Aging P.S., Custodian 1,248.00 Library Maintenance, Custodian 1,052.00 Library P.S., Professional 10,000.00 (Be Adopted) Finance Committee Meeting of October 9, 2018 263-17. ORDERED THAT: The City agrees to execute a revised PILOT agreement with NEW ENGLAND SOLAR GARDEN CO. AND MATTHEW FOURNIER as outlined in the enclosed Order. (Be Adopted) Legislative Affairs Committee Oral Report Meeting of October 16, 2018, 6:00 PM 246-18. Councillor Amy Green, on behalf of the Fitchburg Historical Society, to remove the deed restriction in place for said deed book 2142 page 178. The parcel/parcels located at Grove St. & Vine St. 247-18. Councillor Marcus DiNatale, to amend the City Code where applicable by striking from it the $1,500.00 annual stipend paid to the Chairperson of the Board of Assessors. 265-18. Councillor Marisa Fleming, to request the City Council vote on a Resolution pertaining to PAS (Physician Assisted Suicide).  V. ORDERS-FINANCE 266-18. ORDERED THAT: The City of Fitchburg hereby approves the expenditure of funds from the Massachusetts Department of Transportation, Aeronautics Division, Design and Permitting grant in the approximate amount of $33,500.00 (THIRTY-THREE THOUSAND, FIVE HUNDRED AND 00/100 DOLLARS) for the purpose of said grant, which is to pay for the design and permitting phase of the airport runway reconstruction project. 267-18. ORDERED THAT: There be and hereby is transferred the sum of THIRTY THREE THOUSAND, FIVE HUNDRED AND 00/100 DOLLARS ($33,500.00) same to be charged against RESERVE FOR OTHER MUNICIPAL PURPOSES, CAPITAL EXPENSES and credited to AIRPORT CAPITAL, RUNWAY DESIGN AND PERMITTING for the design and permitting phase of the airport runway reconstruction project. 268-18. ORDERED THAT: The City of Fitchburg hereby approves the expenditure of funds from the Department of Justice, Office of Justice Programs grant in the approximate amount of $27,976.00 (TWENTY-SEVEN THOUSAND, NINE HUNDRED SEVENTY-SIX AND 00/100 DOLLARS) for the purpose of said grant, which is to purchase community policing equipment, portable radios, and tactical equipment, as well as support community policing mobilizations. 269-18. ORDERED THAT: The City of Fitchburg hereby approves the expenditure of funds from the Department of Justice, Office of Justice Programs, STOP School Violence, Category 5 grant in the approximate amount of $57,364.00 (FIFTY-SEVEN THOUSAND, THREE HUNDRED SIXTY-FOUR AND 00/100 DOLLARS) for the purpose of said grant, which is to support individualized physical security assessments and trainings for each Fitchburg public school. 270-18. ORDERED THAT: The City of Fitchburg hereby approves the expenditure of funds from the Department of Justice, Office of Justice Programs, STOP School Violence, Category 5 grant in the approximate amount of $13,300.00, (THIRTEEN THOUSAND, THREE HUNDRED AND 00/100 DOLLARS) for the purpose of said grant, which is to purchase and manage anonymous tip reporting software.  VI. RESOLUTION 271-18. RESOLUTION: BE IT RESOLVED that the Fitchburg City Council is resolute in its support of the amendment to H4617, proposed by Representatives Hay and Higgins, that requires medical centers to maintain essential health services as defined in 105 CMR 130.020 in order to apply for Community Hospital Reinvestment Trust Fund ("CHART") funding as outlined in the enclosed Resolution. VII. PETITIONS 272-18. Anne M. Cervantes, City Treasurer, to declare 116 Day Street, Parcel 32-3-0,as surplus property and designate to the Side Yard Sales program. (City Property Committee) 273-18. Marc Dohan, Executive Director, NewVue Communities, for the City Of Fitchburg to include in its annual budget a line item requiring payment to MassDevelopment of an amount equal to 15% of any Economic Benefit to the Municipality derived from the redevelopment of land at 62 Academy Street as further detailed in the petition. (Finance Committee) 274-18. Attorney Andrew J. Couture representing Saurabh Patel, owner and operator of Wine World located at 381 John Fitch Highway in Fitchburg. Mr. Saurabh Patel requests the City Council to petition the legislature for an additional Section 14, all alcohol retail license, above quota. Said license must be specific to the present location of the existing establishment. (Legislative Affairs Committee) 275-18. Donald J. Cordio, dba Performance Auto Annex, at 1022 Main St., Fitchburg, to reinstate the Automobile Dealer’s License as the conditions required by the City Council and the Building Department have been met, as outlined in the enclosed Petition.
