CITY OF FITCHBURG MASSACHUSETTS CITY COUNCIL CALENDAR December 4, 2018 7:00PM Memorial Middle School Library 615 Rollstone Street Fitchburg MA 01420 WELCOME TO THE FITCHBURG CITY COUNCIL! This is intended to help you understand the meeting format and assist you with the rules of the Council as they pertain to your participation. All meetings of the Fitchburg City council are open to the public. This does not mean that the public participates in all aspects of the meeting. It simply means that the meeting itself, including all discussions and votes, is open for public view. Executive Session The only time a Council meeting can be closed to the public is when the Council votes for Executive Session in order to discuss sensitive matters in private, such as pending litigation. Any votes taken however, must be taken in open session. OPPORTUNITIES FOR THE PUBLIC TO SPEAK DURING A COUNCIL MEETING: Public Forum The Public Forum occurs immediately following the Pledge of Allegiance. The President will ask if anyone in the audience wishes to speak on any matter appearing on the Agenda. If you wish to address the Council, you must stand and be recognized and follow these rules before speaking: 1. State your name and address. 2. Approach the center table and either stand or sit. This allows you to be seen and heard clearly by everyone in attendance. 3. You may speak only on items appearing on the agenda for no more than (2) minutes. Copies of the agenda are available on the center table prior to the meeting. 4. Please state the petition, order, ordinance, or resolution number to which you refer. Public Hearings Public hearings are held on various issues such as Special Permits and Zoning changes. The same rules apply with the following exceptions: 1. You must stand and be recognized either “in favor” or “in opposition” when asked by the Council President. 2. You need not refer to the petition number. If you have any questions or comments either before or after the meeting, any Councillor would be happy to assist you. Thank you for your interest! I. PUBLIC FORUM II. VI.REPORTS OF COMMITTEES Appointments Committee Oral Report Meeting of December 4, 2018, 6:45 PM New Appointment: (Held from November 20, 2018) Human Rights Commission Member (Term to expire November 1, 2021) Ms. Glendaly Lopez Re-Appointments: Trustees of Public Burial Grounds (Term to expire January 1, 2022) Mr. Andrew Hawthorne (Term to expire January 1, 2022) Ms. Judith Perla Finance Committee Meeting of November 27, 2018, 6:00 PM 290-18. ORDERED THAT: The City of Fitchburg hereby approves the expenditure of funds from the MEMA Emergency Management Performance grant in the approximate amount of $13,760.00 (THIRTEEN THOUSAND, SEVEN HUNDRED SIXTY AND 00/100 DOLLARS) for the purpose of said grant, which is to purchase a SCBA fit Tester and specialized ballistics protection equipment for an active shooter or hostile environment event. (Be Adopted) 291-18. ORDERED THAT: The City of Fitchburg hereby approves the expenditure of funds from the Massachusetts Executive Office of Public Safety and Security, State 911 Department Training Grant in the approximate amount of $23,840.52 (TWENTY-THREE THOUSAND, EIGHT HUNDRED FORTY AND 52/100 DOLLARS) for the purpose of said grant, which is to train both Fire and Police Department dispatchers in medical and 911 emergency procedures. (Be Adopted) 292-18. ORDERED THAT: The City of Fitchburg hereby approves the expenditure of funds from the Department of Justice, Office of Community Oriented Policing Services, School Violence Prevention Program grant in the approximate amount of $185,692.00 (ONE HUNDRED EIGHTY-FIVE THOUSAND, SIX HUNDRED NINETY-TWO AND 00/100 DOLLARS) for the purpose of said grant, which is to improve security at schools and on school grounds. (Be Adopted) 293-18. ORDERED THAT: The City of Fitchburg hereby approves the expenditure of funds from the Department of Justice Programs, as provided to the Commonwealth of Massachusetts, Executive Office of Public Safety and Security grant in the approximate amount of $18,918.38 (EIGHTEEN THOUSAND, NINE HUNDRED EIGHTEEN AND 38/100 DOLLARS) for the purpose of said grant, which is to purchase police equipment, including radios, tactical helmets and shields. (Be Adopted) 294-18. ORDERED THAT: The City of Fitchburg hereby approves the expenditure of funds from the Massachusetts Executive Office of Public Safety and Security VAWA grant in the approximate amount of $57,983.31 (FIFTY- SEVEN THOUSAND NINE HUNDRED EIGHTY-THREE AND 31/100 DOLLARS) for the purpose of said grant, which is to support the Domestic Violence Advocate position within the Police Department. (Be Adopted) VII. PUBLIC HEARING 301-18. Doug Pope, TJA Pope Solar, LLC, to petition for approval to install a conduit from the land of Matt Fournier of 900 Fisher Road to the land of Jim and Alison Lattanzi of 885 Fisher Road as outlined in the enclosed Petition. VIII. ORDERS-FINANCE 303-18. ORDERED THAT: The City of Fitchburg hereby rescinds the unissued balance of Loan Order #019-08 for wastewater treatment improvements and water pollution abatement projects in the amount of $334,561.00 (THREE HUNDRED THIRTY-FOUR THOUSAND, FIVE HNDRED SIXTY-ONE AND NO/100 DOLLARS). 304-18. ORDERED THAT: The City of Fitchburg hereby rescinds the unissued balance of Loan Order #170-09 for the Crocker School feasibility study project in the amount of $400,000.00 (FOUR HUNDRED THOUSAND AND NO/100 DOLLARS). 305-18. ORDERED THAT: The City of Fitchburg hereby rescinds the unissued balance of Loan Order #047-11 for the school system data infrastructure upgrade project in the amount of $2,870,000.00 (TWO MILLION, EIGHT HUNDRED SEVENTY THOUSAND AND NO/100 DOLLARS). IX. ORDER-OTHER 306-18. ORDERED THAT: The Honorable Mayor Stephen DiNatale is authorized on behalf of the City of Fitchburg to facilitate and execute the attached Community Host Benefit agreement with Green Era, LLC, located at 371 John Fitch Highway, Fitchburg, MA. X. PETITION 307-18. Councillors Green and DiNatale, on behalf of resident Timothy St. Jean, to inspect and find a remedy to a water run-off issue beginning at 113 Payson Street that is causing a recurring ice beds to form during cold weather on remainder of the street.
