City Property Committee Minutes 7-16-18 Meeting called to order at 6:06pm Committee Councilors Present: Zarrella, Beauchemin, Fleming, Squailia (Green absent) • 193-2018 Taken First (Out of Order) Steve Curry, BOH speaking in support of the petition. Also present and speaking in support: Tom Murray Senior District Manager WWM responsible for Fitchburg Landfill, Jason Ianuzzo WWM Gas Tech, Joe Murphy National Grid 9 Poles to be affected with new Verizon communication wires through easement to improve the wiring on the existing poles to help with communication to existing Councilor Beauchemin concerned about Verizon’s work, compared to Rollstone Rd, questioned how high will poles be: 40’ poles, to add wire for communication to plant, remove and replace Fleming motion to accept, Squailia Second, Approved (unanimous) • 315-2017 & 316-2017 Elisha Erb, Attorney, speaking in support Client has sold portion of parcel along John Fitch Highway (parcel marked 1). Amended petition 316-2017: Key Fitchburg, LLC. Represented by Elisha Erb, Legal Counsel, to petition the City of Fitchburg Conservation Commission to accept a gift of two parcels of land located on the East side of John Fitch Highway and at the corner of intersection of Proctor Avenue with Woodbury St. Approved as amended (unanimous) Michael Donnelly, Conservation Commission present. Fleming motion to accept to approve both petitions, Squailia Second. Approved (unanimous) • 7-2018 Councilor Beauchemin moved to Hold in Committee, Squailia Second. Hold (unanimous) • 127-2018 Matt Fournier, Westminster St LLC & Elite Construction speaking in support Councilor Beauchemin questioned easement for public access to the bridge, noted tractor trailers maneuverability to loading docks. Councilor Zarrella questioned sufficient turning availability for vehicles in parking lot design Matt Fournier noted he plans on cleaning up the landscaping along 431 Westminster St, including along the City Property (Steamline trail parking lot). Councilor Squailia questioned ownership of Parcel’s 1 & 2 of land currently owned by Westminster Pond LLC. Matt Fournier noted an ANR plan for division of existing Parcel with planning and is now requesting easements on that property for 431 Westminster St and the City of Fitchburg for drainage purposes. Notes intent to donate Pond property (Parcel 2) to City of Fitchburg. Councilor Beauchemin questioned the parking lot area (shown on plan), the MS4 program requirements (unknown impact by present parties), the maintenance of the property (noted in easement agreement paperwork) Squailia moved to Accept, Fleming Second. Approved, unanimous • 157-2018 Anne Cervantes, Treasurer spoke in support Noted that Joshua Naughton owns multiple properties adjacent to 67-69 Myrtle Ave. and can use this for parking for either property once accepted. Councilor Beauchemin noted to request that owner cut the grass. Fleming motioned to accept, Beauchemin second. Approved, unanimous Michael Donnelly, 883 Mt Elam Rd, expressed his support of an increased value placed on side-yard sales properties. Believes $300 is an insufficient value to place on this property. Submitted records of previous property he has purchased for example at $500 in 1983 with Ron Ingemie presiding. Notes the tax bill he pays today. • 178-2018 Anne Cervantes, Treasurer spoke in support Noted that 14 gage street property will be divided between the two abutters and split the cost of paving and any grading required with mutal easements as required. $300 paid by each abutter. Noted intent to use this property for parking. Councilor Fleming noted she knows Ian Brennan and that he has fixed up properties very well in the past. Beauchemin motion to accept, Squailia Second. Key Fitchburg, LLC, represented by Elisha Erb, Legal Counsel, to petition the City of Fitchburg Conservation Commission to accept a gift of land located on John Fitch Highway and at the corner of intersection of Proctor Avenue with Woodbury St. 7-2018. Councillor Paul Beauchemin, to look at the possibility of putting in roadway that connects to Crawford/Airport Road area to the Summer Street area, via land or right of way to be acquired) to alleviate traffic backups that occur in the Bemis Road area. 127-2018. The City of Fitchburg, to grant 431 Westminster, LLC an ingress/egress and parking easement on certain city land, as outlined in the petition, Westminster Pond, LLC, to grant the City a drainage easement as outlined in the enclosed petition. 157-2018. ORDERED THAT: the City of Fitchburg sells 67-69 Myrtle Ave. to Joshua Naughton, as trustee of the 137 Green St. Realty Trust, as approved by the City’s Side Yard Sales program. 178-2018. ORDERED THAT: the Mayor is authorized to execute a deed of conveyance of the 14 Gage Street parcel to abutters Ian Brennan and Kelly Arvidson. 193-2018. Stephen Curry, BOH Director, to allow Resource Control, Inc. permission to grant Verizon New England, Inc. and MA Electric Co. the exclusive right to maintain and operate the “overhead system”, not limited to 9 poles, on City property located at the Fitchburg/Westminster landfill on Cody Road (a private way).
