BOARD OF LICENSE COMMISSIONERS City Hall, 718 Main Street FITCHBURG CITY CLERK Fitchburg MA 01420 (978) 829-1820 Jan 04 2022 9:55 am Daniel Sarefield, Chairman Richard Boscardin John Zarrella MINUTES OF MEETING A regular meeting of the Board of License Commissioners was held on December 20, 2021 over the Zoom meeting platform, and called to order by Commissioner Sarefield at 6:03 PM. Commissioner Boscardin was also present at the meeting. Commissioner Zarrella was absent. FPD Liaison Lieutenant Howe and Provisional City Clerk Amanda Alford were present. I. REVIEW AND APPROVAL OF MINUTES OF PRIOR MEETING(S) The minutes of December 6, 2021 were approved by unanimous consent 2/0 II. NEW APPLICATIONS: Monday through Saturday Entertainment Permit Horizon Christian Fellowship, for live acoustic music and live amplified music at downtown common from 6PM to 7PM on December 23, 2021. Ms. Kana Small was present at the meeting. Commissioner Sarefield asked Ms. Small to briefly describe the event. Ms. Small stated that they have joined with local churches to bring different events to the City. This event will be hosted by local churches and they plan to sing Christmas carols on the upper common. The permit they are applying for is due to the fact that they will have an amplified speaker and microphone setup outside the gazebo. Lt. Howe noted that when there are events in this area, the police department’s primary concern is for the safety of the pedestrians because many do not use the designated crosswalks. He requested that Ms. Small indicate in their advertising a notice for the attendees to use these sidewalks. Ms. Small agreed to incorporate this messaging. Application approved by unanimous roll call vote 2/0 Automatic Amusement Device 1. FunStuf Party Place, 791 Water Street, for one (1) video game, one (1) crane, and one (1) redemption machine. Mr. Ethan Deslauriers was present at the meeting. He explained the addition of these machines was to enhance the experience of customers. Application approved by unanimous roll call vote 2/0 Page 1 2. Game On Fitchburg Sports Center, 100 Game On Way, for nine (9) videos, one (1) basketball machine, and three (3) dart boards. Mr. Sangermano was present at the meeting. Commissioner Sarefield asked where these devices would be located. Mr. Sangermano explained that the video games and basketball machine would be located in an 18x15 area on the right hand side as you walk in the front door. He stated that the dart boards would be located in an excluded area in the upstairs bar and would only be utilized by dart leagues. Commissioner Sarefield noted that section 11.6 of the License Commission Regulations requires the applicant to submit a diagram of the location of the dart boards to the Commission for approval. Mr. Sangermano stated that they hadn’t placed the dart boards yet, but would supply the Commission with a diagram hopefully by the end of the week. Application approved subject to receipt of a diagram depicting the location of the dart boards by unanimous roll call vote 2/0 Change of Officers Global Montello Group, Corp., d/b/a Alltown Fitchburg, 129 Whalon Street, for a change of officers. Mr. Jon Aieta, Attorney for McDermott Quilty & Miller was present at the meeting. Mr. Aieta explained that due to recent resignations and retirements, the application before them was to request a change in officers. He noted the positions in which changes are occurring were for the treasurer, secretary, and chief financial officer. Mr. Aieta explained that there would be no operational changes. Commissioner Boscardin asked if there was any change to the stockholders. Mr. Aieta stated that these changes would not affect the ownership interest of the corporation. Application approved by unanimous roll call vote 2/0 Change of Stock Ownership Upper Common Inc., d/b/a The Boulder, 880 Main Street, for change of stock ownership (Monica McNamara) Ms. Monica McNamara and Mr. Chris Bujold were present at the meeting. Ms. McNamara confirmed that she would be taking ownership of the corporation. She explained that she had a soft opening already, but plans to have a grand opening in the beginning of February to correspond with the birthday of the bar. OTHER Discussion regarding the temporary expansions of outdoor premises due to expire on April 1, 2022. Ms. Mary Jo Bohart, Director of Economic Development, was present at the meeting. Commissioner Sarefield noted that he had communication with Ms. Bohart and the Building Commissioner, Mr. Barbadoro, regarding the process for establishments that were approved for a temporary extension to make the change permanent. He explained that when these temporary extensions were granted, zoning requirements were not taken into consideration. He noted that this process will take place when Mr. Barbadoro rolls these over to patio licenses. Ms. Bohart stated that she plans to reach out to the establishments that received approval for temporary extensions to make them aware of the upcoming expiration to these permits and provide assistance to those who wish to make the changes permanent. She noted that she wants them to start the process now since the ABCC may take a while to review and approve the applications. Page 4 V. NEW BUSINESS Provisional City Clerk Ms. Alford stated that there were two renewal entertainment permits signed off by the Fire Department and Building Department that were received in her office after the agenda had already been posted. 1. Log Cabin, 135 Westminster St, for live acoustic music and live amplified music. 2. South Fitchburg Social Club, 47 Duckmill Rd, for live acoustic music and live amplified music. Approved by unanimous roll call vote 2/0 Provisional City Clerk Ms. Alford made the Commissioners aware of correspondence she received from a constituent regarding the noise and traffic associated with events taking place at Hollis Hills Farm. Commissioners stated that they understood the neighbor’s concern but acknowledged that Hollis Hills Farm was a wonderful asset to the City. Ms. Alford mentioned that she had reached out to Building Commissioner Mr. Barbadoro for explanation on the zoning requirements as this seemed to be the neighbor’s primary concern. She stated that she would keep the Board informed of any further communication. It was agreed that the item would be placed on the next agenda as a correspondence.
