FITCHBURG CITY CLERK BOARD OF LICENSE COMMISSIONERS Oct 04 2022 5:36 pm Fitchburg City Hall, City Clerk’s Office 718 Main Street, Fitchburg MA 01420 Daniel Sarefield, Chairman Richard Boscardin John Zarrella MINUTES OF MEETING A meeting of the Board of License Commissioners was held on September 19, 2022 in the Fitchburg City Hall, 3rd floor Conference Room, Fitchburg, and called to order by Commissioner Sarefield at 6:00 PM. Commissioner Boscardin and Commissioner Zarrella were present, and FPD Liaison Lieutenant Howe was present. I. REVIEW AND APPROVAL OF MINUTES OF PRIOR MEETING(S) The minutes of September 7, 2022, Commissioner Zarrella abstained, minutes were approved by roll call vote 2/0. II. NEW APPLICATIONS Special One Day License Katherine Marsh and Zach’s Goal Organization for Special One Day all alcoholic beverages license for a fundraiser from 12:00 p.m. to 5:00 p.m. on October 2, 2022 for approximately 120 people in the designated area of the parking lot at 68 Airport Road. Ms. Marsh was present, this is the 7th year of annual event held outside in the parking area. Officer Howe had no concerns. Application approved by unanimous roll call vote 3/0 Monday - Saturday Entertainment Permit Fitchburg Blacksmith Festival, by Achla Madan, for live acoustic music at Riverfront Park from 12:00 p.m. to 4:00 p.m. on October 1, 2022. Mr. Madan was present, Commissioner Sarefield noted that if the music would continue till 4:00 PM, the time should be amended. The amended hours would be 12:00 PM to 5:00 PM. Officer Howe had no concerns. Amended application approved by unanimous roll call vote 3/0. Page 1 Sunday Entertainment Permit Katie Marsh, Legends Bar & Grill LLC., 68 Airport Road #10, for live amplified music in parking lot from 12:00 Pm to 5:30 PM on October 2, 2022. Ms. Marsh was present, Commissioner Sarefield noted that if the music would continue till 5:30 PM, the time should be amended. The applicant stated they are completed by 5:00 PM. Application approved by unanimous roll call vote 3/0. Late Closing Permit (12AM) POS Food Services, LLC, 100 Game on Way (Sunday through Saturday) Mr. Sangermano II was present, requesting late closing Sunday through Saturday till 12:00 AM. Officer Howe had no concerns. The application approved by unanimous roll call vote 3/0. Application for amendment – Change of Ownership Interest POS Food Services, LLC, 200 Game on Way Mr. Sangermano II was present, he resigned as a member. New Members in the LLC are: LJ investments LLC. and Dean Hirtle. The application to move to a Public Hearing October 3, 2022 was approved by unanimous roll call vote 3/0. New Restaurant, All Alcohol Beverage License Munchies to Go, LLC, 27 Airport Road Ms. Gomez-Serrano and Ms. Gomez were present, requesting an All Alcohol Beverage License, stated they are losing customer, not being able to provide spirits with meals. The application to move to a Public Hearing October 3, 2022 was approved by unanimous roll call vote 3/0. III. PUBLIC HEARING New Restaurant, All Alcohol Beverage License L & L Restaurant Two, Inc., 170 Whalon Street Commissioner Sarefield opened the public hearing at 6:22 PM. Alex Kin was present at the meeting. Commissioner Sarefield asked if they had legal counsel review the application, the applicant did. Commissioner Sarefield stated that license requirements from the City have been meet by the applicant. Page 2 Mr. Kin was TIP certified and is reapplying for the TIP certification. Lieutenant Howe had no concerns. Public Hearing declared closed at 6:18 p.m. Commissioner Sarefield ask if any public comment for or against the application. Ms. Jackson has concerns with the cars that park in the empty parking lot during late evening hours. She has notified the police and property owner DiGeronimo Group with her concerns several times. Lieutenant Howe advised this is the first he is hearing of this concern and will share this information with the night police shift supervisor. Lieutenant Howe and the commission feel that having a business back open utilizing the parking area, will hopefully resolve parking vehicles during late night hours. The commission has amended the application for the All Alcohol Beverage License hours to be 11:00 AM to 1:00 AM Sunday through Saturday. Motion to approve the amended application for an All Alcohol Beverage License was approved by unanimous roll call vote 3 /0. IV. CORRESPONDENCE Finnish Center at Saima Park tabled discussion till October 3, 2022 meeting. V. NEW BUSINESS Lieutenant Howe, Fitchburg Police department addressed an Incident Report 22-33832 pertaining to video obtain of Kingston Island Cuisine. He noted that these incident took place after the establishment closed. The commission will review the provided video and will discuss at the October 3, 2022 License Commission Meeting.
