BOARD OF LICENSE COMMISSIONERS City Hall, 718 Main Street Fitchburg MA 01420 FITCHBURG CITY CLERK (978) 829-1820 Nov 14 2024 9:46 am Daniel Sarefield, Chairman Richard Boscardin Glenn Fossa MINUTES OF MEETING A regular meeting of the Board of License Commissioners was held on Monday, October 21, 2024 in person and called to order by Commissioner Sarefield at 6:00 PM. Commissioner Boscardin was present, Commissioner Fossa was absent. FPD Officer Sevigny, City Clerk Joanna Bilotta and Assistant City Clerk Elizabeth McNiff were present. I. REVIEW AND APPROVAL OF MINUTES OF PRIOR MEETING(S) Regular Minutes of October 7, 2024 The Regular Meeting Minutes of October 7, 2024 were approved by roll call vote 2/0. II. NEW APPLICATIONS Please note that the Commission may enter into Executive Session pursuant to G.L. c. 30A, sec. 21(a) (5) (Discussion of CORI results), if required during this portion of the agenda, and will return to regular session upon completion. Solicitor Applications Ryan Immerman – Power Home Remodeling James McDermott – Power Home Remodeling Tyler Brassard – Power Home Remodeling Christine Malchiodi – Power Home Remodeling Sergio Zacarias – Power Home Remodeling Kyle Kennedy – Power Home Remodeling Mr. Kennedy was present at the meeting. They informed the Commission that they will start the door-to- door solicitation at 9:00 AM and ending at 5:00 PM. Mr. Kennedy explained he was the supervisor over this group of workers. He has been involved with this company for the past five years Commissioner Sarefield advised they need to wear Identification and the City of Fitchburg Solicitation hours are Monday – Saturday 9:00 AM - 5:00 PM, no Sundays or Holiday hours. Officer Sevigny informed all the applicants they are responsible to notify the police department of what areas of the city they will be working each day. Page 1 Applications approved by unanimous roll call vote 2/0. Special One Day Wine & Malt Beverages Jeff McVoy, Athletic Football Game Beer Garden & President’s Box, 0 Pearl Hill Road, Saturday, October 26th and Saturday, November 9, 2024 from 10:00 AM to 3:00 PM, for approximately 100 people. Mr. McVoy was present at the meeting. Commissioner Sarefield stated for the record that while he is an employee at Fitchburg State University, he has no financial stake or connection to this event. Commissioner Sarefield reviewed application and verified all servers have TIP certifications. Mr. McVoy confirmed there will be a roped off area and wrist bands for people 21 years or older. Campus police will also be present. Officer Sevigny had no concerns. Amended application approved by unanimous roll call vote 2/0. III. PUBLIC HEARING Application for New General On-Premises Restaurant All Alcoholic Beverages Liquor License Marcellos Restaurant Corporation DBA Marcellos Restaurant, 27 Airport Road Ms. Petricca was present at the meeting and shared they are opening up a Greek/Italian restaurant. Commissioner Sarefield asked about her experience. Ms. Petricca explained she owner and ran three restaurants while she was in Alaska and has dealt with all of the liquor licenses for those establishments. Ms. Petricca stated that she is both safe/tip certified. Commissioner Sarefield open the public hearing at 6:31 PM Mary Jo Bohart from Community and Development spoke in favor of the business. Public Hearing was closed at 6:33 PM Application approved by unanimous roll call vote 2/0 Application for New General On-Premises Restaurant All Alcoholic Beverages Liquor License Tacos Don Juan Inc., 356 Main Street Mr. Luna and Mr. Berthet were present at the meeting. Mr. Luna shared that he wanted to add alcohol to the menu for customers. Mr. Luna explained as he current manager of Espressos he has experience in liquor licenses and that he is safe/tip certified. Commisoner Sarefield expressed some concern as to be being the manger on record for two estblishments. Mr. Luna explained he could have someone else become the manager on record if needed. City Clerk Joanna Bilotta will reach out to the ABCC regarding this matter. Commissioner Sarefield open the public hearing at 6:45 PM Mary Jo Bohart from Community and Development spoke in favor of the business. Page 2 Public Hearing was closed at 6:47 PM Application approved by unanimous roll call vote 2/0 Review of Taxi Rules and Regulations changes. Section 3.10 removing Section 2C number 6-8 Commissioner Sarefield open the public hearing at 6:54 PM No one from the public spoke for or against these changes. Public Hearing was closed at 6:57 PM Taxi Rules and Regulation changes approved by unanimous roll call vote 2/0. IV. CORRESPONDCE V.
