MINUTES OF A REGULAR FLORA ZONING BOARD MEETING AUGUST 8TH, 2017 I. CALL TO ORDER -Chairman Rick Slaughter called the meeting to order at 8:05 p.m. in the council chambers of City Hall. II. ROLL CALL -Those members answered roll call were: Bill Kitley, Larry Rinehart, Alan Huff and Rich Herring. Absent was Dr. Corey Walker and Bob Johnson. -Others present were: Chad Bayles & Kaci O’Dell. The guest was Cathrine Osterholtz. III. APPROVE MINUTES of meeting held July 11, 2017 There being no additions/corrections to the minutes of the meeting held on July 11th, 2017 Rich Herring made the motion to approve the minutes as presented. Alan Huff seconded the motion. The minutes were approved by unanimous voice vote. IV. HEARING ON PETITION – Cathrine Osterholtz (Owner) 421 W North Ave Petitioner requests a Variance to open a doggie day care and boarding business. Zoned C-2, Neighborhood Commercial District. V. NEW PETITIONS FILED – Nyal Dickey & Vicki Dickey (Owners) & Loy Hosselton (Purchaser). Petitioner desires to rezone the property to C-2 to build a veterinary clinic. Property is presently zoned A-2 Corporate Agricultural District. Rich Grubaugh (Owner) 1118 Granger Blvd. Petitioner desires to request a variance to extend his fence into front yard. Property is zoned R-2 Single-Residence District. VI. OTHER BUSINESS - None, at this time VII. OLD BUSINESS - None, at this time VIII. ADJOURN- There being no further business to discuss. Bill Kitley made the motion for adjournment. Rich Herring seconded the motion. Members concurred. Rick Slaughter declared said meeting adjourned at approximately 8:20 p.m. __________________________________ Kaci O’Dell, Secretary __________________________________ Chad Bayles, Zoning Administrator Page 1 Cathrine Osterholtz (Owner) 421 W North Ave– Petition for Variance The petition taken before the Zoning Board by Cathrine Osterholtz is to request a Variance to open a doggie day care and boarding business at 421 W North Ave. Chairman Rick Slaughter asked the petitioner to tell the board what she would like to do. Ms. Osterholtz stated she would like to open a doggie day care and boarding business for dogs and cats. The business will be called Camp Fur Babies. The kennels would all be indoors. If the business did well and she saved money she would like to eventually have an outdoor play area. The outdoor area would have to be all concrete. Ms. Osterholtz did go through the State of Illinois Agricultural Department for her Kennel Operating License. There will be specific drop off and pick up times or by appointment. Ms. Osterholtz would like to put in a security system and will have a “No cash on premises” sign. Eventually, she would like to get an App that makes it possible for pet owners to check in on their pets. A camera would be installed into each kennel. The animals will be walked, fed, and picked up after in the morning, middle of day and evening. They will be walked around the property and around town. Ms. Osterholtz asked that it be recommended with the property instead of the person in case she decided to sell the business in the future. With no other questions from the board, Chairman Rick Slaughter read the findings of fact on page 71. The Zoning Board recommends that the petition for Special Use be granted with the owner on the following findings of fact: a. the proposed variance is consistent with the general purposes of this Title; and b. strict application of the district requirements would result in great practical difficulties or hardship to the applicant, and prevent a reasonable return on the property; and c. the proposed variance is the minimum deviation from such requirements that will alleviate the difficulties/hardship, and allow a reasonable return on the property; and d. the plight of the applicant is due to peculiar circumstances not of his own making; and e. the variance, if granted, will not alter the essential character of the area where the premises in question are located nor materially frustrate implementation of the City’s Comprehensive Plan. Larry Rinehart made the motion to recommend the Variance with the owner. Alan Huff seconded the motion. Motion did pass by roll call vote with (5) of the (5) attending Zoning Board Members voting “Aye”. Dr. Corey Walker and Bobby Johnson were absent. The Board will be passing it to the City Council as a positive recommendation on August 21st.
