Call to Order
Council President Wayne Trawick called the December 4, 2017 Work Session
to order at 4:00 p.m.
Roll Call
All Council Members were present with the exception of Council Member
Charlie Ebert and Mayor John Koniar. Also present: City Administrator Mike
Thompson, City Clerk Katy Taylor, Sandra Pate, Kate Embry, Miriam Boutwell,
Sue Steigerwald, LaDonna Hinesley, Randy Kurtts, Thurston Bullock, David
Wilson, Joe Bouzan, Chad Christian, Pam Harris, Darrell Russell, Taylor Davis,
Tom DeBell, David Vosloh, Francis Holk-Jones, and Press Representative

17-0618 A resolution to accept the donation of H.M. Hamburg & Sons, Inc
property made by Helen Hamburg Williams.

H.M. Hamburg & Sons Map and Tax Appraisal
Randy Kurtts reported to the Council that he has taken additional steps in
determining what would be needed for the preservation of the Hamburg
property. The first phase would include replacement of the roof, cutting of
trees, and termite bait stations. Phase two would include siding and wall
rebuilding work on the building, which would cost approximately $40,000.00.
Mr. Kurtts reported that without knowing the general purpose goal of the
building it is hard to generate an exact estimate of how much this project
could cost the City. Council Member Ralph Hellmich reported to the Council
that it is hard to get exact pricing without a use in mind and that the City
should reach out to the Hamburg family and request flexibility with the use and
timing of this project, if it were to be accepted. City employees will reach out
and meet with the Hamburg family for the potential of this project. There was a
consensus to carry this item over to the December 18, 2017 Work Session
Agenda. There was no further discussion on this item.

17-0678 Discuss Offer to Purchase Railroad Right-of-Way Below Appraised
Value

Appraisal
Joe Bouzan reported to the Council that there is a citizen who has requested to
purchase a piece of railroad right-of-way property located in Loxley that is
currently owned by the City. Mr. Bouzan reported to the Council that the
property appraisal value is $140,000 and the citizen has offered $40,000 for the
purchase. Mr. Bouzan reported to the Council that the City has been selling
property for the appraised value and his recommendation is to turn the offer
down. There was a consensus that the City Council is not interested in selling
the property for less than the appraised value. There was no further discussion
on this item.
17-0686 PUBLIC PROJECT RECOMMENDATION

Miriam Boutwell reported to the Council that the Planning Commission
recommends moving forward with the 9th Avenue Extension Public Project.
Ms. Boutwell reported that action from the Council was not necessary, this item
was for informational purposes. There was no further discussion on this item.
Discuss Council Meeting Agenda of December 4, 2017
17 0666 Street Dept. requests permission to purchase a 2018 John Deere 310SL
Backhoe.
Public Works Superintendent Darrell Russell reported to the Council that this
resolution will allow for the replacement of a 1999 loader. Mr. Russell reported
that the bids came in under budget. There was no further discussion on this
item, it remained on the agenda.
17 0684 Approval to purchase hydraulic rescue tools for FFD
Chief Joey Darby reported to the Council that during the last budget year the
Fire Department was able to purchase the first budgeted set of hydraulic
rescue tools and this will be the second set that the Fire Department needs to
purchase. There was no further discussion on this item, it remained on the
agenda.
Council President Wayne Trawick turned the December 4, 2017 Work Session
meeting over to President Pro Tempore Ralph Hellmich.
17 0687 Fern Avenue Extension Wetland Mitigation

City Engineer Chad Christian reported to the Council that this resolution allows
for the purchase of wetland credits for the Fern Avenue Extension project. Mr.
Christian reported that Volkert has worked closely with the City Engineering
Department to minimize wetland impacts in this project but some were
unavoidable. This purchase is not to exceed $48,700.00 and will be purchased
through the only bank with enough credits for the full project from one single
bank. There was no further discussion on this item, it remained on the agenda.
President Pro Tempore Ralph Hellmich turned the meeting back over to
Council President Wayne Trawick.
17 0688 Appropriating funds and Approving the Purchase of a Trackless Train
Finance Director Sue Steigerwald reported to the Council that during the last
Council meeting an item to purchase the trackless train was approved,
however; the item had a 60% down payment. Ms. Steigerwald reported to the
Council that Bonnie Donaldson has negotiated the down payment to 55% so the
resolution needs to be approved again. There was no further discussion on this
item, it remained on the agenda.
17 0689 Approving OptumHealth Contract as the City's reinsurance/stop loss
provider for the 2018 Calendar Year.
Human Resources Director Sandra Rate reported to the Council that this
resolution is a renewal for the reinsurance for the City due to being self
insured. The HR Department received eight quotes and four of the quotes were
disqualified due to requiring lasers. Ms. Pate reported that OptumHealth has
the best quote and this item is budget neutral. Ms. Pate reviewed health care
costs savings since the City went self insured in 2009. Based on Blue Cross Blue
Shield premiums the City of Foley has had a cumulative savings of $3.8 million
since going self insured. There was no further discussion on this item, it
remained on the agenda.
17 0692 Residential Sanitation Write Offs as Uncollectible in the Amount of
$204.37
There was no further discussion on this item, it remained on the agenda.
17 0693 Request to purchase new vehicle for Municipal Complex Department.
Municipal Complex Director Pam Harris reported to the Council that this
resolution will allow for the purchase of a 2015 ford fusion for the department.
Ms. Harris reported to the Council that the department has been without a
vehicle for almost a year. The vehicle the department will purchase has 35,000
miles and will cost approximately $14,500.00 with the decal additions. There
was no further discussion on this item, it remained on the agenda.
17 0683 ABC License Transfer: 020 Restaurant Retail Liquor for Ichiban Foley,
Inc., applicant operating under the trade name Ichiban Hibachi & Sushi
transfer from Dong Zhang Ichiban, Inc. to Ichiban Foley, Inc.
Police Chief David Wilson reported to the Council that the Police Department
recommends moving forward. Fire Chief Joey Darby reported to the Council
that the Fire Department recommends moving forward. There was no further

17-0697 A Resolution to Approve Opening a New Court Bond Checking Account
Finance Director Sue Steigerwald reported to the Council that the City has
been hacked for the first time. An individual has been creating their own
checks using the City Court Bond Checking Account. Ms. Steigerwald reported
that the City will not be out any amount due to being insured and the Police
Department knows who the individual is. There was no further discussion on
this item, it remained on the agenda.
