Laurel Avenue City of Foley, AL Foley, AL 36535 Meeting Minutes - Final City Council Monday, December 16, 2019 4:00 PM Conference Room Work Session Call to Order Council President Wayne Trawick called the December 16, 2019 Work Session to order at 4:00 p.m. Roll Call All Council Members were present with the exception of Council Member Vera Quaites who was absent due to illness. Also present: City Clerk Katy Taylor, Kate Embry, David Wilson, David Thompson, Pam Harris, Rachel Keith, Don Dukemineer, Suzanne Kellams, Shawn Miller, Jessica Vaughn, Gary Deisner, Sue Steigerwald, Logan Eberly, Taylor Davis, LaDonna Hinesley, Donna Watts, Ed Bushaw, Sally Westendorf, Sue Sumner, Paul Kostelecky, Francis Holk-Jones, Sherry Sullivan, Charles Weber, and Press Representative Jessica Vaughn. Discussion Items 19-0670 A Resolution Approving A Firefighter Cancer Policy Fire Chief Joey Darby reported to the Council that the state has now passed an act that requires municipalities to provide full time, career firefighters with a cancer policy. Chief Darby reported to the Council that policies are now available through Alabama First Responders Benefit Program and the policies must be in place by January 1, 2019. Chief Darby reported to the Council that this act does not require the policies to be provided to volunteers but does allow for that. Chief Darby reported to the Council that the funds to provide cancer policies to both full time, career firefighters and active volunteers has been budgeted. There was a consensus to add item 19-0670 to the December 16, 2019 Council Meeting Agenda for consideration. Enactment No: 19-1395-RES 19-0671 Discuss Environmental Impacts of Coal Ash Nolan White with Do2E Wastewater Treatment, LLC reported to the Council that just north of Mobile Alabama Power has a 600 acre coal ash pond in an unlined lagoon. Mr. White reported to the Council that if this pond were to City of Foley, AL Page 1 City Council Meeting Minutes - Final December 16, 2019 overflow it would be worse than the BP Oil Spill due to the waste that is in these ponds. Mr. White reported to the Council that Southern Company has cleaned out the ponds in Georgia and it is important to get them to do more than just capping the pond near Mobile. Mr. White requested that the Council send letters to Alabama Power to request the company to do more to clean out the pond than just capping it off. 19-0677 Gateway Initiative Team Update Sally Westendorf reported to the Council that the South Baldwin Chamber of Commerce has developed an accountability plan that will revision and be more specific for the Gateway Initiative Plan. Ms. Westendorf reported to the Council that all five chambers have met to put together a 2020 agenda plan. Ed Bushaw reported to the Council that in 2019 Workforce Development was a big concentration for the Chamber of Commerce. Mr. Bushaw reported to the Council that the apprenticeship program model is working and that the Chamber is working with many area businesses. Mr. Bushaw reported to the Council that the Chamber has begun meeting with Columbia Southern University to potentially address the summer housing shortages and a potential 24 hour daycare service. Donna Watts reported to the Council that the Chamber is also helping to kick off a community garden with Foley High School. Ms. Watts reported to the Council that WAS Design and a Master Gardener are helping to get this project started. There was no further discussion on this item. 19-0679 Discuss Traffic Signal Preemption System Fire Chief Joey Darby reported to the Council that phase one of preemptive light signal systems have been installed and they are working well to assist the Fire Department in navigating through traffic. Chief Darby reported to the Council that Orange Beach Fire Department has reached out and would like to discuss providing equipment for two light signal upgrades to assist them with their transport services to South Baldwin Hospital; these lights include Foley Beach Express at Highway 98 and Foley Beach Express at Fern Avenue when it is open. Chief Darby reported to the Council that a decision is not needed at this time but it will be brought back for the Council to decide whether to accept the donation. Discuss Council Meeting Agenda of December 16, 2019 19 0577 A Resolution Approving the Purchase of a New Generator Base Shawn Miller reported to the Council that the base fuel tank of the generator is eroding and needs to be repaired. There was no further discussion on this item, it remained on the agenda. 19 0638A Resolution to Waive the Fees for the Foley Civic Center for G.U.M.B.O. There was no discussion on this item, it remained on the agenda. 19 0641 A Resolution to increase the budget for a new website for Foley Sports City of Foley, AL Page 2 City Council Meeting Minutes - Final December 16, 2019 Tourism. Recreation and Sports Tourism Director David Thompson reported to the Council that an upgrade to the website will address rights holders and tourists. Mr. Thompson reported to the Council that the project was budgeted previously but they were unable to complete in time so it has been postponed to this fiscal year. There was no further discussion on this item, it remained on the agenda. 19 0644 A Resolution Requesting to Memorialize the Application for the FY2020 Baker & Taylor Summer Reading Program Grant Logan Eberly reported to the Council that this grant application has been sent in. Ms. Eberly reported to the Council that the grant will award $3,000 with no match required. There was no further discussion on this item, it remained on the agenda. 19 0648 A Resolution to Approve the Mel Roberts Bathroom Building Project Parks Superintendent Gary Deisner reported to the Council that this project will add restrooms, storage, and a picnic area, however; the existing concrete may not be usable. There was no further discussion on this item, it remained on the agenda. 19 0649 A Resolution to Approve the Inmate Calling Services Bid Recommendation Police Chief David Wilson reported to the Council that NCIC was the only bidder to provide calling services for the fifty-five bed jail. Logan Eberly reported to the Council that ALDOT has recommended the application to focus on signalization updates rather than the County Road 12 improvements. There was no further discussion on this item, it remained on the agenda. 19 0654 A Resolution Accepting an Unbudgeted Donation from Ascend Performance Materials for the Foley Fire Department 12 19 Fire Chief Joey Darby reported to the Council that Ascend has donated $5,000 (minus the credit card fee) to the Fire Department. Chief Darby reported to the Council that last year this sponsorship allowed the Fire Department to provide a smoke alarm for every family receiving meals from Turkey Take Out and 120 Fire extinguishers at Let It Snow in Heritage Park. There was no further discussion on this item, it remained on the agenda. 19 0655 A Resolution to Approve Centennial Fountain Area Upgrades and Rose Trail Walking Connector Projects City of Foley, AL Page 3 City Council Meeting Minutes - Final December 16, 2019 Taylor Davis reported to the Council that after receiving the design for this project the Engineering Department recommends bidding the both projects together. There was no further discussion on this item, it remained on the agenda. 19 0657 A Resolution approving the cut off dates for Annexations and Certificates of Occupancies for the purpose of Redistricting There was no discussion on this item, it remained on the agenda. 19 0658 A Resolution Establishing The Use Of Electronic Vote Counting Devices There was no discussion on this item, it remained on the agenda. 19 0661 A Resolution Authorizing Employees to Enter Upon the Property at 500 South Hickory Street for the Purpose of Abating the Public Nuisance. There was a consensus to remove item 19-0661 from the December 16, 2019 Council Agenda due to the property being abated. There was no further discussion on this item, it was removed from the agenda. 19 0663 A Resolution Authorizing Employees to Enter Upon the Property along Peachtree Ave fence line of Live Oak Subdivision for the Purpose of Abating the Public Nuisance. There was a consensus to remove item 19-0663 from the December 16, 2019 Council Agenda due to the property being abated. There was no further discussion on this item, it was removed from the agenda. 19 0667 A Resolution Approving the Senior Center Roof Replacement Project Pam Harris reported to the Council that the Senior Center has several roof leaks and needs to be replaced. Ms. Harris reported to the Council that three requests for bids have been sent out and two responses were received. There was a consensus to allow Ms. Harris to come back to Council for any extra funds that may be needed to receive extra services from the bidder. There was no further discussion on this item, it remained on the agenda. 19 0668 A resolution modifying a job title within the Human Resources Division of the General Government Department Suzanne Kellams reported to the Council that this is a housekeeping item that will mend the pay plan title but not the pay. There was no further discussion on this item, it remained on the agenda. 19 0672 A Resolution Approving the Application for a Highway Safety Improvement Program Grant for Foley Beach Express Safety Improvements Logan Eberly reported to the Council that this grant will provide $180,000 with a 10% match required. There was no further discussion on this item, it remained on the agenda. 19 0676 A Resolution Authorizing Residential Sanitation Write Offs as Uncollectible in the Amount of $256.24 City of Foley, AL Page 4 City Council Meeting Minutes - Final December 16, 2019 There was no discussion on this item, it remained on the agenda. 19 0678 A Resolution Requesting Approval for Ecumenical Ministries, Inc. Advertisement Banner Placement There was no discussion on this item, it remained on the agenda. Council President Wayne Trawick turned the Work Session over to Council Member Ralph Hellmich. 19 0680 A Resolution Approving the Facade Grant for Gulf Coast Occupational, Sports and Pain Medicine Council Member Ralph Hellmich reported to the Council that this building is currently not in operation and the project improvements have been approved by the Historical Commission. There was no further discussion on this item, it remained on the agenda. Council Member Ralph Hellmich turned the Work Session over to Council President Wayne Trawick. 19 0675 ABC License: 011 Lounge Retail Liquor Class II (PACKAGE) for Jeanna Foote Smith, applicant operating under the trade name Gulf Liquor located at 7525 HWY 59 Suite B Foley, Alabama. Police Chief David Wilson reported to the Council that the Police Department recommends moving forward. Fire Chief Joey Darby reported to the Council that the Fire Department could not recommend moving forward at this time. Chief Darby reported to the Council that the inspectors have tried to make contact with the owners but they have not been able to at this time through visits and phone calls. There was a consensus to carry item 19-0675 over to the January 6, 2020 Council Meeting agenda for consideration. Mayor's Comments Mayor John Koniar reported to the Council that they have met with the Department of Transportation Director in Mobile to discuss Foley Beach Express Maintenance assistance and a potential third lane from Tanger Outlets to Gulf Shores. Mayor Koniar reported to the Council that the Director has agreed to write letters of support for any grant the City of Foley wishes to apply for. Visitor's Comments There were no comments to report.
