Forty Fort Borough Council Meeting Minutes August 1, 2016 Call to Order The gavel strike of Vice President of Council, Rick Kamus, called tonight’s meeting to order. Invocation and Pledge of Allegiance Mayor Andy Tuzinski led those present in the Pledge of Allegiance. Roll Call Vice President Rick Kamus ordered Roll call. Members in attendance were: Vice President Rick Kamus, Dominic Butchko, Thomas Murray, Amy Craig, and Frank Michaels. Also present were, Borough Mayor, Andy Tuzinski, Chief of Police, Daniel Hunsinger, Borough Manager, Bonnie Arnone, Borough Secretary, Brandy Fuller, Borough Solicitor, Jack Haley, and Borough Engineer Representative of Quad 3 Rich Kresge. Visitors present numbered 9. A member of the press was not in attendance. Vice President Kamus confirmed a quorum. Consent Agenda for Administrative Issues Matters listed within the Consent Agenda have been referred to members of the Borough Council for reading and study, are considered to be routine and will be enacted by one motion of the Council. If separate discussion is desired, the item may be removed from the Consent Agenda by Council action The Resolutions listed below were submitted to the Borough Council for review and will be adopted by one motion. Motion made by Dominic Butchko to enact the following Consent Agenda: 1. Motion to approve the minutes of the Regular meeting held on July 5, 2016 2. Vice President Kamus asked Council if anyone would like any of the items removed for discussion from the Consent Agenda. No Council Member asked for any items to be removed from the Agenda. All were in favor. Motion passed without dissention. Report of Chief of Police and Mayor Chief of Police Daniel Hunsinger stated that National Night out was taking place August 2, 2016. Amy Craig has events scheduled for the children and there is free swim from 6p-8p. There will also be fingerprinting and Pizza. The Pill Drop off box which is placed at the door when you walk into the Borough Building is officially active. The pills are taken out of the box and placed into evidence until the District Attorney’s office picks it up. Mayor Andrew Tuzinski echo’s the Chiefs acknowledgement of National Night Out. Mayor Tuzinski added that Pizza Bella and Collarusso’s are supplying the pizza and Main Source is supplying the water. We will have lifeguards for an extra hour and Joe Lynn’s Band, Just US, will be performing from 6p- 8:30p. A meeting is also set with the new code enforcement officer to show him the problem properties that have been brought to council’s attention.  Forty Fort Borough Council Meeting Minutes August 1, 2016 Report of the Borough Manager Borough Manager Bonnie Arnone had nothing to report for this meeting. Report of Borough Engineer Sanitary Sewer Rehabilitation Project Mr. Rehab, Inc. has submitted final close-out documentation, including a waiver of mechanics lien. Quad Three forwarded the documentation to Jack Haley for his review, to determine if the release would cover sub-contractors. Mr. Haley responded by indicating he was concerned that it may not cover sub- contractors such as Holena Excavating, and requested Quad 3 ask Mr. Rehab directly if they had any communication with Holena regarding their acceptance of payment in full, or if they intended to make any claims for non-payment. Quad 3 contacted Mr. Rehab who inferred a via email message that they had given Holena opportunity to comment, but have received nothing from him. Quad 3 also clarified for Mr. Haley that the Borough received a maintenance bond covering work for a period of one year from the date of Substantial Completion. The maintenance period will expire on March 7, 2017. American Asphalt followed up with PennDOT to obtain a sign-off on pave work on River Street, however we do not believe PennDOT has issued the needed documentation as of today. Paving Project Work The project is approximately 80% complete with all ADA ramps, storm water inlets and manhole frames and covers constructed. Change Order No. 4 has been prepared for removing concrete sub-base material below the existing bituminous pavement structure on Owen Street. Only full depth bituminous pavement reconstruction remains for Owen Street. A substantial completion inspection will be scheduled immediately following the reconstruction of Owen Street, anticipated to be complete within the next two weeks. The contractor has recently submitted his second application for payment in the amount of $235,632.30. USDA Payment request No. 3 is also being submitted for Council’s approval. The amounts presented are: American Asphalt Pay Application No. 2 ($235,632.30); PA Department of Transportation Inspection ($744.60); and Quad Three Group, Inc. ($27,033.00) for a total USDA pay request of $263,209.90.  Forty Fort Borough Council Meeting Minutes August 1, 2016 Wesley Street Contract Documents (plans, technical specifications and project manual have been prepared and forward to Forty Fort Borough and the Luzerne County Redevelopment Authority for their review. They are ready for bidding barring comment. Multimodal Grant Project Quad Three has completed the topographic survey of the associated borough hall and alley areas, and they are approximately 70% complete with the alley drawings. Quad Three has also authorized their traffic consultant to begin evaluation of the traffic signal located for Wells and Slocum Street. Borough Pool Facility Quad Three will send engineers to the Borough pool to assist the Borough with ADA compliance and development of technical specifications concerning structural rehabilitation (surface preparation and coating application) and pool circulation/filtration system alternatives. A site visit will be arranged this week. Councilman Frank Michaels asked if missed curbing was possible to replace in town. Mr. Michaels was advised by Quad Three Engineer Rich Kresge that an estimate could be obtained, and brought back for discussion. Residents and Taxpayer Comments and Petitions Ellen Beck of 7 Tripp Manor is requesting that a gas line be put in for her house. Mrs. Beck was advised that there is a 6 year moratorium on cutting new paved roads. It can only be done in emergencies. Mrs. Beck would still like the council to consider allowing the gas line to go in. Council advised that it is an ordinance and to do for one, they would have to do for all. Councilman Dominic Butchko feels this is unfair, and assured Mrs. Beck that he would work on a new ordinance that would give Mrs. Beck this service. Mr. Butchko will submit his ordinance to council at the next work session on August 15, 2016. Rob Swaback of 15 Susquehanna Ave, questioned Engineer Rich Kresge regarding the no parking placements on River Street. He also spoke about the firefighter’s contract and the civil Service agreement in regards to the contract.  Forty Fort Borough Council Meeting Minutes August 1, 2016 General Business 1. Paving Pay request #3 - $263,409.90 A motion was made by Frank Michaels to accept the Paving Pay Request. It was seconded by Tom Murray. All were in favor. Motion passed. New Business and Open Discussion 1. Landlord – Tenant Ordinance Solicitor Jack Haley passed out a draft of a possible new Landlord – Tenant Ordinance. This was given to council for review and to be brought back for discussion. Executive Session There was no session needed for this meeting. Motion to Adjourn Motion to Adjourn was made by Dominic Butchko and seconded by Frank Michaels. All in Favor, meeting was adjourned at 8:25pm.
