PAOLUCCI, WARD FOUR Fredericksburg, Virginia 22401 Council Work Session November 8, 2011 Courts – Review of Comprehensive Agreement and Exhibits The Council of the City of Fredericksburg, Virginia held a work session on Tuesday, November 8, 2011, beginning at 5:30 p.m. in City Hall Conference Room. Council Present. Mayor Thomas J. Tomzak, Presiding. Vice-Mayor Mary Katherine Greenlaw. Councilors Kerry P. Devine, Bradford C. Ellis, Frederic N. Howe, III, Beatrice R. Paolucci and George C. Solley. Also Present. City Manager Beverly R. Cameron, Assistant City Manager Mark Whitley, City Attorney Kathleen Dooley, Director of Parks, Recreation and Public Facilities Robert Antozzi, Budget Manager Amanda Lickey, Planning Director Ray Ocel and Clerk of Council Tonya B. Lacey. Others Present. Warren Walker, ARCADIS. Courts Comprehensive Agreement. Mr. Walker overviewed what was included in the Comprehensive agreement. The agreement included the price, payment terms, incentives, schedule, the design build process, termination rights, performance and payment bonds, insurance, and disputes. It also included exhibits on the general conditions, supplemental conditions and other exhibits. Exhibit one included the First Choice Detailed proposal (architectural style and materials, preliminary site plans, building plans, interior finishes, 707 Princess Anne Street property acquisition, and LEED Silver). Exhibit C Clarification and Assumptions include the Benchmark (Young-Laine Courts and Isle of Wight). The design guidelines are included in Exhibit K and there is a separate agreement for the Renwick Renovations. Exhibit G included the project schedule. Mr. Walker reviewed the cost of the courts, the cost limit is $31,865,831. There were also other features of the agreement that include an open book contracting, liquidated damages equaling $3,000 per day, 1 shared saving 80% City; 20% Design Builder, if the building is not completed on time the City would get 100% of the shared savings. Mayor Tomzak asked Council if Council was satisfied with the proposal and whether they thought the design benefited the City residents. He also asked if anyone thought the process did not protect the citizens. Vice-Mayor Greenlaw said the process was carefully thought out and it offers the City protection in the interest of the taxpayers. She felt the process was beneficial to citizens and that it was a transparent process. Councilor Devine agreed, she said the agreement had many safeguards and that it was a very competitive price and because of the many safeguards it should be a painless process. Councilor Howe asked whether the agreement had been reviewed by another City or County to see if there is something that needs to be added. He says their experience could be valuable. Mr. Walker said it had not been reviewed by any other locality, but it was a collaborative effort with City staff, City Attorney, and outside council who had also worked on other court projects including Spotsylvania’s new court. Mr. Walker also noted that he does consulting 10% of the time and the other 90% is spent as a project manager and that he has had 25-30 years of experience in this type of work. Adjournment.
