The Council of the City of Fredericksburg, Virginia, held a regular session on
Tuesday, June 27, 2017, beginning at 7:30 p.m. in the Council Chambers of City Hall.
City Council Present. Mayor Mary Katherine Greenlaw, Vice-Mayor William C.
Withers, Jr. (9:09 arrival) and Council members Kerry P. Devine, Dr. Timothy P. Duffy,
Bradford C. Ellis, Charlie L. Frye, Jr. and Matthew J. Kelly.
Also Present. City Manager Timothy J. Baroody, Assistant City Manager Mark
Whitley, City Attorney Kathleen Dooley, Planning and Building Development Director
Charles Johnston, Transportation Administrator Erik Nelson, Economic Development
Director Bill Freehling and Clerk of Council Tonya B. Lacey.
Opening Prayer and Pledge of Allegiance. Council was led in prayer by
Councilor Bradford C. Ellis followed by the Pledge of Allegiance led by Mayor Mary
Katherine Greenlaw.
Officer Recognized. Mayor Greenlaw recognized the presence of Officer
Amber Hoaglund at this evening’s meeting.
Citizen Comment. The following speakers participated in the citizen comment
portion of this evening’s meeting.
Jasee Law, Maui Resident, spoke about how much the visitors spend in Maui a
month and he requested more benches in the City especially in front of the visitor center.

Council Agenda Presented. The following item was presented to Council for
discussion.
7A. Virginia Municipal League Committee Recommendation – Vice-Mayor Withers
7B. D.A.R.E. Program – Councilor Frye
Virginia Municipal League Committee Recommendation – Vice-
Mayor Withers stated he was on the VML Legislative Committee and there were several bills
coming forward and he wanted to be sure his vote was a reflection of how Council wanted
him to vote. He reviewed each of the bills and Council was in support of the direction Vice-
Mayor was going.
D.A.R.E. Program – Councilor Frye request that City Manager Baroody contact
the schools to see what the status is of the D.A.R.E. Program. He said in light of the opioid
epidemic he thought this would be a great program for the school kids. He said this program
had made an impact on kids in other jurisdictions.
City Manager’s Consent Agenda Accepted for Transmittal as
Recommended (D17-241 thru D17-251). Councilor Kelly moved approval of the
City Manager’s consent agenda items; motion was seconded by Councilor Duffy and passed
by the following recorded votes. Ayes (7). Councilors Greenlaw, Withers, Devine, Duffy,
Ellis, Frye and Kelly. Nays (0).
• Resolution 17-44, Second Read Approved, Amending the Fiscal Year 2017
Budget by Appropriating $460,023 of Fund Balance in the Education Debt
Service Fund (D17-241).
• Transmitting of Small Unmanned Aircraft Systems Program (D17-242).

Resolution 17-48, Approved, Amending the Fiscal Year 2017 Budget
by Using $75,000 of General Fund Contingency for a Contribution to the
Other Post-Employment Benefits Fund (D17-252). After staff presentation
Councilor Devine made a motion to approve Resolution 17-48, amending the Fiscal Year
2017 budget by using $75,000 of general fund contingency for a contribution to the other
Post-Employment Benefits Fund; motion was seconded by Vice-Mayor Withers and passed
by the following recorded votes. Ayes (7). Councilors Greenlaw, Withers, Devine, Duffy,
Ellis, Frye and Kelly. Nays (0).
Amending the Fiscal Year 2017 Budget by Recognizing $75,000 of
Revenues in the General Fund (Fund 100) and Authorizing a Transfer to
the Fredericksburg Opportunity Fund (Fund 226) (D17-253). This item was
withdrawn from the agenda for discussion at a later date.
Resolution 17-49, Approved, Amending the 2015 Comprehensive
Plan to Adapt to Proffer Reform Legislation Adopted by the 2016 General
Assembly (D17-254). After staff presentation and some discussion Councilor Kelly

made a motion to approve Resolution 17-49, amending the 2015 Comprehensive Plan to
adapt to proffer reform legislation adopted by the 2016 General Assembly; motion was
seconded by Councilor Devine and passed by the following recorded votes. Ayes (7).
Councilors Greenlaw, Withers, Devine, Duffy, Ellis, Frye and Kelly. Nays (0).
Resolution 17-50, Approved, Authorizing the City Manager to
Execute a Funding Agreement for a Bicycle/Pedestrian Bridge Project
(D17-255). After staff presentation and some discussion Councilor Duffy made a motion
to approve Resolution 17-50, authorizing the City Manager to execute a funding agreement
for a bicycle/pedestrian bridge project; motion was seconded by Councilor Kelly and passed
by the following recorded votes. Ayes (7). Councilors Greenlaw, Withers, Devine, Duffy,
Ellis, Frye and Kelly. Nays (0).
Adoption of Minutes (D17-251). Councilor Devine moved approval of the
May 9, 2017 Work Session minutes and the June 13, 2017 Public Hearings and Regular
Session; motion was seconded by Vice-Mayor Withers and passed by the following recorded
votes. Ayes (7). Councilors Greenlaw, Withers, Devine, Duffy, Ellis, Frye and Kelly. Nays
(0).
City Manager’s Report and Council Calendar (D16-256 thru D16-
257). City Manager Baroody reviewed the Manager’s report and Council Calendar. Activities
highlighted on the report were as follows: Midnight Madness Begins Friday, June 23, Soap
Box Derby, Soap Box Derby Car from 1960, Annual Photography Show, Fredericksburg
Police Department Participates in Annual Torch Run for Special Olympics, New Pedestrian
Crossings on Blue Gray Parkway, Decommissioning of Traffic Signal at Fall Hill Avenue and

Germania Street, Update on Caroline Street Infrastructure Project and Building Statistics
Reports.
Closed Meeting Approved (D17-258). Upon the motion of Councilor
Devine, seconded by Councilor Duffy and passed by the following recorded votes, Council
approved a closed session under Virginia Freedom of Information Act section 2.2-3711(A)(3)
to discuss acquisition of real property, of a portion of the Liberty Place property at 608
Amelia Street/605 William Street for public parking and section 2.2-3711(A)(1) to discuss the
performance of specific appointees of the City Council, specifically, the Clerk of Council, City
Attorney, and City Manager. Ayes (7) Councilors Greenlaw, Withers, Devine, Duffy, Ellis,
Frye, and Kelly. Nays (0).
Return to Open Meeting Approved. Upon the motion of Councilor
Devine seconded by Councilor Ellis and passed by the following recorded votes, Council
approved a return to an open meeting. Ayes (7) Councilors Greenlaw, Withers, Devine,
Duffy, Ellis, Frye, and Kelly. Nays (0).
Resolution 17-51, Approved, Certifying Closed Meeting. Upon the
motion Councilor Devine approved Resolution 17-51 certifying the closed meeting; seconded
by Councilor Ellis and passed by the following recorded votes. Ayes (7) Councilors Greenlaw,
Withers, Devine, Duffy, Ellis, Frye, and Kelly. Nays (0).
Adjournment. There being no further business to come before the Council at this
time, Mayor Greenlaw declared the meeting officially adjourned at 9:00 p.m.
