FRYE, JR., WARD FOUR Fredericksburg, Virginia 22401 September 12, 2017 The Council of the City of Fredericksburg, Virginia, held a regular session on Tuesday, September 12, 2017, beginning at 7:30 p.m. in the Council Chambers of City Hall. City Council Present. Mayor Mary Katherine Greenlaw, Vice-Mayor William C. Withers, Jr. and Council members Kerry P. Devine, Dr. Timothy P. Duffy, Charlie L. Frye, Jr. and Matthew J. Kelly. City Council Absent. Bradford C. Ellis, out on business. Also Present. City Manager Timothy J. Baroody, Assistant City Manager Mark Whitley, Assistant City Manager Doug Fawcett, City Attorney Kathleen Dooley, Assistant City Attorney Robert Eckstorm, Planning and Building Development Director Charles Johnston, Zoning Administrator Michael Craig, Development Administrator Marne Sherman, Community Development Planner Susanna Finn, Public Works Director David King, Budget Manager Deidre Jett and Clerk of Council Tonya B. Lacey. Opening Prayer and Pledge of Allegiance. Council was led in prayer by Councilor Matthew J. Kelly followed by the Pledge of Allegiance led by Mayor Mary Katherine Greenlaw. Proclamation In Recognition of Ferris Belman, Sr. (D17-345). – Mayor Greenlaw presented Mrs. Belman and her children with a proclamation honoring Mr. 19761 Regular Session 09/12/17 Belman for his years of service on the City Council and his volunteer work throughout the community. Proclamation Recognizing Thomas Worthy for 25 years of Service (D17-346). – Mayor Greenlaw presented Mr. Worthy with a proclamation thanking and congratulating him for his dedicated contributions to the City and she extended him continued success in his future endeavors. Sheriff’s Department also presented a plaque for his service and the City Manager presented the City watch. The police department presented the City patch and a couple of gifts for Mr. Worthy. Mr. Worthy said it was his pleasure and honor to serve the City. Proclamation Celebrating the 45th Anniversary of the Fredericksburg Area Sickle Cell Association (D17-347). – Mayor Greenlaw presented Mr. Lewis Geter with a proclamation congratulating and thanking the members of the Fredericksburg Area Sickle Cell Association for 45 years of dedicated service to the Fredericksburg area. American Heart Association. – Dr. Rick Lewis informed the Council of the American Heart Association Heart walk that was being held on September 23 and he asked the Council to support. He said the City already supports advancing heart health and it showed by the heart safe designation the City received. Dr. Rick Lewis said it was great to see the trails because they allow people to get out and exercise. Public Hearings (D17-348 thru D17-357). The regular session was recessed in order to conduct the scheduled public hearings and immediately reconvened upon their conclusion. 19762 Regular Session 09/12/17 Citizen Comment. The following speakers participated in the citizen comment portion of this evening’s meeting. Kenneth Green, Dominion Cab, stated that he and all the taxi companies had met with Chief Nye about charges for the taxi companies and they all agreed that they like the idea of charging how they wish as long as the Police Department was aware of how they were going to charge. He was frustrated that the Police Department had again asked for their manifest logs. He wanted to know why the Police Department continues to ask for documents that had already been requested a couple years earlier but nothing had changed. He asked that Council approve allowing the taxi companies to charge how they want as long as they let the Police Department know. Jasee Law, Maui resident, suggested using the slave block as a seat to replace the missing bench at the Visitor Center. City Manager’s Consent Agenda Accepted for Transmittal as Recommended (D17-358 thru D17-__). Councilor Kelly moved approval of the City Manager’s consent agenda items; motion was seconded by Councilor Devine and passed by the following recorded votes. Ayes (6). Councilors Greenlaw, Withers, Devine, Duffy, Frye and Kelly. Nays (0). • Resolution 17-73, Second Read, Amending the Fiscal Year 2017 Budget for Final Adjustments (D17-358). • Resolution 17-80, Amending the Fiscal Year 2018 Budget Authorizing Additional Expenditures in the City Grants Fund (Fund 210) (D17-359). • Transmitting Board and Commission Minutes o Board of Social Services – June 8, 2017 (D17-360). 19763 Regular Session 09/12/17 Council Agenda Presented. The following item was presented to Council for discussion. 7A. Murder Free Fredericksburg/Mayfield – Councilor Frye Murder Free Fredericksburg/Mayfield – Councilor Frye spoke on the senseless loss of life that occurred in Mayfield and he reiterated that the City had a gun giveback program. He passionately spoke about how the media reports on the bad things that go on in Mayfield but he ran down a list of positive events that happen in the neighborhood and he listed people who do good things in Mayfield. Councilor Frye said most of the bad things that happen in the neighborhood were by people who were not residents of the neighborhood and he said that was not fair to the people who live there. Appointment of a School Board Representative to the Recreation Commission – Jonathan D. Russ (D17-361). Councilor Duffy moved to appoint Jonathan D. Russ as the school representative to the Recreation Commission; motion was seconded by Councilor Devine and passed by the following recorded votes. Ayes (6). Councilors Greenlaw, Withers, Devine, Duffy, Frye and Kelly. Nays (0). Resolution 17-81, First Read, Amending the Fiscal Year 2017 Budget for Final Adjustments for Schools (D17-362 thru D17-362.2). After staff presentation Councilor Duffy disclosed that he was a member of a business, profession, occupation or group of three or more members affected by the transaction but he was able to participate fairly, objectively and in the public interest. Councilor Frye disclosed that his spouse was a member of a business, profession, occupation or group of three or more members affected by the transaction but he was able to participate fairly, objectively and in the public interest. Councilor Devine made a motion to approve Resolution 17-81, on first 19764 Regular Session 09/12/17 read, amending the Fiscal Year 2017 budget for final adjustments for schools; motion was seconded by Councilor Duffy and passed by the following recorded votes. Ayes (6). Councilors Greenlaw, Withers, Devine, Duffy, Frye and Kelly. Nays (0). Amending the City and Public Utility Review Committee Review Authority and Procedures for the Location of Infrastructure in the Public Rights of Way in the Historic Fredericksburg District (D17-363). This item was withdrawn. Amending Chapter 66 of the City Code by Adopting an Ordinance Regulating Utility and Wireless Facilities, Poles, Lines and Structures in the Public Rights-of-Way (D17-364). This item was withdrawn. Fiscal Year 2017 Preliminary Year-End Financial Report (D17-365). Assistant City Manager Whitley presented preliminary results for fiscal year 2017. Overall the results were good and reflect stable economic conditions. The revenues had an increase of 2.41% over the prior year. The expenditures increased over the prior year by 0.74%. Overall there was a use of $1.27 million of the general fund balance but it was lower than the planned use of $6 million. Real Estate revenue showed growth of about 3%. Sales tax continue to grow by 1.8% increase. The meals tax exceeded $11 million for the first time and this was a growth of 4.31% from the prior year. The Business License Tax exceeded $6 million for the first time and that was an increase of 3%. Personal property tax increased by 1.41% over the prior year. He also covered other revenues and expenditures and said the full and final audit would be presented in December. City Manager’s Report and Council Calendar (D16-366 thru D16- 367). City Manager Baroody reviewed the Manager’s report and Council Calendar. Activities 19765 Regular Session 09/12/17 highlighted on the report were as follows: Upcoming 2019 Conference, Detective Pearce Receives Notable Recognition, Hurricane Harvey Donations, Parks & Recreation Fall Catalog, Fox 5 Zip Trip and Midnight Madness. Adjournment.
