City Council Present. Mayor Mary Katherine Greenlaw, Vice-Mayor William C. Withers, Jr. and Council members Kerry P. Devine, Dr. Timothy P. Duffy, Bradford C. Ellis, Charlie L. Frye, Jr. and Matthew J. Kelly. Also Present. City Manager Timothy J. Baroody, Assistant City Manager Mark Whitley, Assistant City Manager Doug Fawcett, City Attorney Kathleen Dooley, Economic Development Director Bill Freehling, Tourism Services Manager Danelle Rose, Director of Planning and Building Services Charles Johnston, Community Development Planner Susanna Finn, Budget Manager Deidre Jett and Clerk of Council Tonya B. Lacey. Notice of Public Hearings (D18-59 thru D18-61). The Clerk read the notice of the public hearings as they appeared in the local newspaper, the purpose being to solicit citizen input. 2018-2019 Community Development Block Grant Annual Action Plan (D18-59). no speakers. The Annual Action Plan outlines projects that address housing and homeless needs for qualified individuals. The eligibility threshold for community development programs, as defined by HUD, is persons and families whose household incomes are 80 percent of the area median income or below. The total number 19889 Public Hearing 02/27/18 of households in Fredericksburg that could be classified as low and moderate income is 6,305 or 64.5 percent of the City’s households. Previous plans directed funds to various non-profit organizations lending services to eligible applicants to include emergency rental/mortgage assistance, legal services, health counseling, financial counseling and food assistance. Services that are directly managed by the Planning Department include Direct Homeownership Assistance Program, Removal of Architectural Barriers Program and Emergency Home Repair Program. Ordinance 18-04, First Read Approved, Approving a Non- Exclusive Franchise to Fredericksburg Tours, LLC, to Provide Walking Tours of Fredericksburg (D18-60). no speakers. Staff gave a brief overview and Councilor Kelly made a motion to approve Ordinance 18-04, on first read, approving a non- exclusive franchise to Fredericksburg Tours, LLC, to provide walking tours of Fredericksburg; motion was seconded by Councilor Devine and passed by the following recorded votes. Ayes (7). Councilors Greenlaw, Withers, Devine, Duffy, Ellis, Frye and Kelly. Nays (0). Resolution 18-23, First Read Approved, Amending the Fiscal Year 2018 Budget for a Re-Appropriation for the Fredericksburg City Public Schools (D18-61). no speakers. Staff gave a brief overview. Councilor Duffy disclosed that he was a member of a business profession, occupation or group of three or more members affected by the transaction and Councilor Frye disclosed that his spouse was a member of a business profession, occupation or group of three or more members affected by the transaction, but that were able to participate in the transaction fairly, objectively and in the public interest. 19890 Public Hearing 02/27/18 Councilor Kelly made a motion to approve Resolution 18-23, on first read, amending the Fiscal Year 2018 Budget for a re-appropriation for the Fredericksburg City Public Schools; motion was seconded by Councilor Ellis and passed by the following recorded votes. Ayes (7). Councilors Greenlaw, Withers, Devine, Duffy, Ellis, Frye and Kelly. Nays (0). Adjournment. Mayor Greenlaw recognized the presence of Sergeant Chris Reyes, Officers Sang Kim, Andrew Ralston and Melanie Schafer at this evening’s meeting. 19893 Regular Session 02/27/18 Public Hearings (D18-59 thru D18-61). The regular session was recessed in order to conduct the scheduled public hearings and immediately reconvened upon their conclusion. Citizen Comment. There were no speakers participating in the citizen comment portion of this evening’s meeting. Council Agenda Presented. The following items were presented to Council for discussion. 7A. Murder Free Fredericksburg – Councilor Frye Murder Free Fredericksburg – Councilor Frye announced that to date the City was murder free. He said he also had the opportunity to talk to the Governor and Lieutenant Governor and he discussed some of the initiative the City had such as the gun giveback program and he was awaiting some sort of response or inquiry from them. City Manager’s Consent Agenda Accepted for Transmittal as Recommended (D18-62 thru D18-73). Councilor Kelly moved approval of the City Manager’s consent agenda items; motion was seconded by Vice-Mayor Withers and passed by the following recorded votes. Ayes (7). Councilor Devine moved approval of the June 13, August 22, September 12, and December 12, 2017 Work Session minutes and January 9 and February 13, 2018 Public Hearing and Regular Session minutes; motion was seconded by Councilor Frye and passed by the following recorded votes. Ayes (7). Councilors Greenlaw, Withers, Devine, Duffy, Ellis, Frye and Kelly. Nays (0). Rappahannock Area Agency on Aging – Councilor Timothy Duffy (D18-78). Councilor Devine made a motion nominating Councilor Duffy to serve as the Council representative on the Rappahannock Area Agency on Aging; motion was seconded 19895 Regular Session 02/27/18 by Vice-Mayor Withers and passed by the following recorded votes. Ayes (7). Councilors Greenlaw, Withers, Devine, Duffy, Ellis, Frye and Kelly. Nays (0). Resolution 18-27, Approved, Authorizing the City Manager to Enter into a Contract with International Coalition of Sites of Conscience (D18- 79 thru D18-80). Sarah Pharaon with International Coalition of Sites of Conscience (ICSC) presented a PowerPoint presentation and in her presentation she discussed the background of the ICSC, what is a site of conscience, the number of members, she showed pictures of some of the sites they have worked with, she introduced the team that would be working with Fredericksburg and she discussed phases 1, 2 and 3 of the project. Councilor Duffy thanked the City’s working group for bringing the ICSC to the Council. He said the City encompasses so much of the history of America and telling that story was challenging. He said he was encourage by the presentation and look forward to the perspectives. Councilor Frye echoed Councilor Duffy but he said this was a great beginning. He said the City was receptive and responsive as a Council and focused on telling a broader story of the history in the City. Councilor Frye said the City was moving on a level it has never moved before. Councilor Kelly said the City had been talking about this for a long time and he was glad that the City was moving forward. He noted that being open to what was being said would help in the dialog. He said the history was about the good, the bad and the ugly and he was looking forward to robust conversations with the Community. Councilor Kelly said he hoped the City would set an example of how to have dialog with people who have different views in order to advance history. 19896 Regular Session 02/27/18 Vice-Mayor Withers reiterated Councilor Duffy’s comments and said he was in full support of the process and he looked forward to a good outcome. Mayor Greenlaw said she was proud of the community but there was so much that was unknown and she relished in the opportunity to understand the community better. She said the power of place was amazing and what would come out would be amazing. Mayor Greenlaw said she was looking forward to the dialog and she believes the ICSC was the right organization to help the City. Councilor Frye moved to approve Resolution 18-27, authorizing the City Manager to enter into a contract with International Coalition of Sites of Conscience; motion was seconded by Councilor Devine and passed by the following recorded votes. Ayes (7). Councilors Greenlaw, Withers, Devine, Duffy, Ellis, Frye and Kelly. Nays (0). City Manager’s Report and Council Calendar (D18-81 thru D18-82). City Manager Baroody reviewed the Manager’s report and Council Calendar. Activities highlighted on the report were as follows: Bass-Ellison Building Rededication Ceremony, Tri- County/City Soil and Water District Local Government Breakfast, City Government Facebook Page Reaches 1,000 Followers, FPD Releases New Recruitment Video about LawFit Course, Rappahannock Canal Update and Recent Accolades of Outstanding Citizens. Closed Meeting Approved (D18-83). Upon a motion Councilor Ellis, moved approval of a closed session under Virginia Freedom of Information Act section 2.2- 3711(A)(39) for the discussion of confidential information prepared by the City, related to the attraction of a multipurpose outdoor and recreational venue, where competition or bargaining is involved, and where disclosure of the information would adversely affect the financial interest of the City of Fredericksburg; motion was seconded by Councilor Devine and passed 19897 Regular Session 02/27/18 by the following recorded votes. Ayes (7) Councilors Greenlaw, Withers, Devine, Duffy, Ellis, Frye, and Kelly. Nays (0). Return to Open Meeting Approved. Upon the motion of Councilor Duffy seconded by Councilor Devine and passed by the following recorded votes, Council approved a return to an open meeting. Ayes (7) Councilors Greenlaw, Withers, Devine, Duffy, Ellis, Frye, and Kelly. Nays (0). Resolution 18-28, Approved, Certifying Closed Meeting. Upon the motion Councilor Duffy approved Resolution 18-28 certifying the closed meeting; seconded by Councilor Devine and passed by the following recorded votes.
