Lacey. Notice of Public Hearings (D22-39 thru D22-43). The Clerk read the notice of the public hearings as they appeared in the local newspaper, the purpose being to solicit citizen input. 21279 Public Hearing 02/08/22 Ordinance 22-01, Second Read Approved, Adopting Local Redistricting “Modified Citizen Plan, Version 2” and Amending City Code Chapter 30, “Elections,” Section 30-1 “Election Districts” to Adjust District Boundaries in Accordance with the Adopted Redistricting Plan (D22-39 thru D22-40). No speakers. After Mr. Johnston’s PowerPoint presentation Councilor Graham moved to approve Ordinance 22-01, on second read, adopting local redistricting “Modified Citizen Plan, Version 2” and amending City Code Chapter 30, “Elections,” Section 30-1 “Election Districts” to adjust district boundaries in accordance with the adopted Redistricting Plan; motion was seconded by Councilor Gerlach and passed by the following recorded votes. Ayes (7). Councilors Greenlaw, Frye, Devine, Duffy, Gerlach, Graham and Kelly. Nays (0). Resolution 22-07, First Read Approved, Amending the Fiscal Year 2022 Budget to Appropriate Funds for the Purchase of a Fire Ladder Truck and Police Vehicles (D22-41). No speakers. Assistant City Manager Whitley presented this item to the Council and Councilor Kelly moved to approve Resolution 22- 07, on first read, amending the Fiscal Year 2022 budget to appropriate funds for the purchase of a fire ladder truck and police vehicles; motion was seconded by Councilor Graham and passed by the following recorded votes. Ayes (7). Councilors Greenlaw, Frye, Devine, Duffy, Gerlach, Graham and Kelly. Nays (0). Resolution 22-08, First Read Approved, Amending the Fiscal Year 2022 Budget to Appropriate Funds in the General Fund and the Public 21280 Public Hearing 02/08/22 Works Capital Fund for the Learning Lane Culvert Replacement Projects (D22-42). No speakers. Assistant City Manager Whitley presented this item along with the Environmental Programs Manager Rae who presented a PowerPoint presentation. Council Kelly asked for clarification on the process because of a comment the Council received from a citizen and Mr. Whitley assured him that they were following the process. Councilor Graham moved to approve Resolution 22-08, on first read, amending the Fiscal Year 2022 budget to appropriate funds in the General Fund and the Public Works Capital Fund for the Learning Lane Culvert replacement projects; motion was seconded by Councilor Duffy and passed by the following recorded votes. Ayes (7). Councilors Greenlaw, Frye, Devine, Duffy, Gerlach, Graham and Kelly. Nays (0). Resolution 22-09, First Read Approved, Fiscal Year (FY) 2022 Budget Amendment Authorizing the Appropriation of FY 2021 Carryovers and Approving Additional Appropriations for Certain capital Projects (D22-43). Assistant Finance Director Lawrence presented this item to the Council and Councilor Graham moved to approve Resolution 22-09, on first read, Fiscal Year (FY) 2022 budget amendment authorizing the appropriation of FY 2021 carryovers and approving additional appropriations for certain capital projects; motion was seconded by Councilor Duffy and passed by the following recorded votes. Lacey. Opening Prayer and Pledge of Allegiance. Council was led in prayer by Councilor Matthew J. Kelly followed by the Pledge of Allegiance led by Councilor Jason N. Graham. 21283 Regular Session 02/08/22 Officer Recognized. Mayor Greenlaw recognized the presence of Lt. Rashawn Cowles, at this evening’s meeting. COVID-19 Update. Chief Jones reported that that the numbers were trending downward. The total new cases in the health District dropped by 4,000. The average per day was cut in half and the number in the hospital had dropped significantly. He noted that the number in the hospital were very sick and many died causing the death rate to go up. The percent positivity was down by 7-8% but it was still above the State. The number in the hospital statewide was down by 1,000 and discharges were up by 5,000. He said these were all good indicators. The number of new cases dropped to 24 and it was previously 47. Chief Jones said the case rates were declining across the state accept in two health districts in the southwest region. The community transmission was still considered high and mitigation standards needed to stay in effect. Chief Jones said there was a new variant called Omicron Subvarient BA2 that they expect to take over as the dominant strain and it was expected to slow the decline. He said vaccination was the best way to protect from the virus. Vaccinations in the Commonwealth were up, 15 million have been vaccinated, 6.5 million with the first dose, 6 million with the second and 2.5 million boosters. Council had a brief discussion on the transmissions and when there may be a booster for children under 5. Consent Agenda Accepted for Transmittal as Recommended (D22- 38). Councilor Kelly moved approval of the City Manager’s consent agenda; motion was 21284 Regular Session 02/08/22 seconded by Councilor Graham and passed by the following recorded votes. Ayes (7). Nays (0). • Resolution 22-05, Second Read, Amending the Fiscal Year 2022 Budget to Appropriate Funds in the City Grants Fund for Department of Criminal Justice Services Grant Funds (D22-38). Public Hearing (D22-39 thru D22-43). The regular session was recessed in order to conduct scheduled public hearings and immediately reconvened upon their conclusion. Citizen Comment. There were no comments given and/or submitted to be read during the citizen comment portion of this evening’s meeting. Council Agenda Presented. There were no items presented to Council for discussion. Adoption of Minutes. Councilor Duffy moved approval of the January 25, 2022 Public Hearing and Regular Session minutes; motion was seconded by Councilor Graham and passed by the following recorded votes. Ayes (7). Councilors Greenlaw, Frye, Devine, Duffy, Gerlach, Graham and Kelly. Nays (0). Ordinance 22-02, First Read Approved, Revising Taxicab Regulations Relating to Certificate of Public Convenience and Necessity, Motor Vehicle Safety, Driver Safety, and Fares and Charges, and Dissolving the Taxicab Board (D22-44). Police Chief Layton stated that in response to a citizen comment in May 2021 they reviewed the taxi ordinance and conducted a keep/change analysis and 21285 Regular Session 02/08/22 they met with the cab owners that operate in 22401. Staff reviewed those changes with the cab owners and they were in agreement with the changes which were presented to the Council. As Council discussed in the earlier work session they would like to include students to Section 58-443(b). Chief Layton said he could make that change for the second reading. Councilor Duffy moved to approve Ordinance 22-02, on first read, revising Taxicab Regulations relating to certificate of public convenience and necessity, motor vehicle safety, driver safety, and fares and charges, and dissolving the Taxicab Board to include the amendment of Section 58-443(b) to add students; motion was seconded and passed by the following recorded votes. Ayes (6). Councilors Greenlaw, Devine, Duffy, Gerlach, Graham and Kelly. Nays (1). Councilor Frye. Councilor Frye said he would like to know more about the change before giving his support. City Manager’s Report and Council Calendar (D22-45 thru D22-46). City Manager Baroody directed the Council’s attention to the Manager’s Update: City to Unveil Historical Panel Recognizing the 1950 Walker-Grant High School Graduates, Fredericksburg Art Lovers!, COVID-19 Vaccines and New Testing Center Opens, Tree Debris Cleanup, Update on Delinquent Utility Accounts, Local Redistricting Process Update, Stormwater Infrastructure Rehabilitation, Traffic Safety Initiative, Board and Commission Openings, Winter Programs, Parks, Recreation and Events Newest Activity Catalog and Fred Focus. 21286 Regular Session 02/08/22 Adjournment.
