CALL TO ORDER [00:00:24] Chairman Durham called the meeting to order at 6:30 p.m. in Council Chambers and explained meeting procedures for the public. Members of the public were invited to attend or access this meeting by public access television Cox Channel 84, Verizon Channel 42, or online at https://www.regionalwebtv.com/fredpc. 2. PLEDGE OF ALLEGIANCE 3. DETERMINATION OF A QUORUM [00:03:15] There were seven members in attendance of the meeting at the call to order. 4. APPROVAL OF AGENDA [00:03:33] There were no changes to the agenda. Ms. Whitehead moved to approve the agenda, Ms. McDonald seconded. Motion passed 7-0. 5. DISCUSSION OF POTENTIAL POLICIES, ORDINANCES, OR APPLICATIONS 6. DECLARATION OF CONFLICTS OF INTEREST OR DISCLOSURES OF CONTACT [00:03:57] Audio lost 00:04:27 – 00:08:44 Planning Commissioner Dugan Caswell submitted a “Disclosure of Personal Interest in a Transaction” in relation to Agenda Public Hearing item 8. A. SUP2500-0010 Mis Ojos 1600 Princess Anne Street. After the disclosure was noted, Mr. Caswell excused himself from the Dais for the public hearing portion of the meeting. (Attachment) 7. OLD BUSINESS 8. PUBLIC HEARING – New [00:08:45] (Attachment) A. Special Use Permit SUP2503-0010 – Mis Ojos Restaurante requests a Special Use Permit to permit alcohol sales at 1600 Princess Anne Street Kelly Machen presented. Ms. Machen explained that the previous tenant, Haley’s Honey Meadery, had a SUP for a winery. The new tenant, Mis Ojos Restaurante, has requested a change to the SUP to allow for general alcohol sales. Staff recommended approval with conditions of the SUP for alcohol sales:  Hours of operation are limited to the hours of 11:00 am to 10:00 pm.  Outdoor food and beverage service shall be limited to the hours of 11:00 am to 9:00 pm Sunday through Thursday, and 11:00 am-10:00 pm on Friday and Saturday.  Outdoor live music shall not have amplified sound. Elimary Perez Bonilla presented for the applicants, Maritza Bonilla and Orssy Hernandez. The name of the restaurant is in honor of Ms. Bonilla’s grandmother. The menu would be a fusion of Dominican & Italian cuisine with an offering of mixed cocktail drinks, beer, and wine. Mr. Durham opened the floor to the Dais for questions. Topics of discussion were hours of operation, employee street parking, and possible uses of the upper floor of the restaurant. Mr. Durham opened the floor for public comment. No in-person comments were made. Mr. Durham requested that the public comment letters be read into the record (Attachment): Staff read into the record electronically received letters. Timothy Bornholtz, 303 Canal Street, Fbg, VA 22401 is directly adjacent to the property and wrote in favor of the SUP submission. Mr. Durham declared public hearing closed and asked the Dais if there were any questions for staff. There were none. Mr. Durham entertained a motion on the proposed SUP. Ms. Marshall motioned to recommend to City Council approval of the SUP to permit alcohol sales at 1600 Princess Anne Street subject to the proposed conditions. Ms. Whitehead seconded. Mr. Durham polled the Dais. The motion passed 6-0. Mr. Caswell rejoined the Dais for the rest of the meeting. 9. OTHER BUSINESS [00:22:41] A. FXBG Forward! Comprehensive Plan Update and Discussion (Attachment) Mr. Durham noted that the FXBG Forward! Comprehensive Plan Update and Discussion is work session and not a public hearing item. Josh Crump noted that this is the third work session of the Comprehensive Plan. The consultant representatives from the firms of Stantec and Summit Design presented the changes to the Comprehensive Plan Update. The changes made are in an effort to unify the framework that binds the neighborhoods and communities together through transportation, open space, public facilities, and walkable centers. Some change highlights to the plan are:  Adding community centers and bike/pedestrian corridors to the Walkable Centers Map  Adding language that links walkability and housing with community health access by prioritizing bicycle and pedestrian considerations in the regulation development process.  Adding language to incentivize desired housing types.  New strategies for Economic Development  Linking natural systems maps to the T-1 Transects in the Small Area Plans to better integrate stormwater plans.  New strategies for interactions between rail, industrial, and residential areas. The next scheduled public hearing on this item will be held on May 28, 2025. The consultants concluded their presentation. Mr. Durham opened the floor to the Dais for questions. Ms. Whitehead and Mr. Craig discussed the housing definition of the term “Missing Middle” used in certain sections of the document. Mr. Caswell thanked the consultants for their work on the Comprehensive Plan Update. Ms. McDonald appreciated the additional language for aging populations to be able to house in place and the new strategies of the rail corridors. Ms. Whitehead requested that the concept of Community Health point be integrated into essential services. Mr. Durham and the consultant team discussed aspects of the process of how this plan was put together through small area plans, community input, expansion of concepts, and interactive story maps. Ms. Whitehead and Mr. Craig discussed refining some of the attributes of the story maps to include side-by-side comparisons. Mr. Craig said the process timeline is: Planning Commission City Council Discussion Public Hearing Public Hearing & Adoption Public Hearing & Adoption 23-Apr-25 14-May-25 28-May-25 Late June/ Early July Mr. Durham and Mr. Craig discussed changes to the plan including changes to the Gateway Boulevard Trail, cell tower locations, a potential river crossing, and better use of database technology. Mr. Durham closed the Planning Commission question period. 10. GENERAL PUBLIC COMMENT [00:53:34] Mr. Durham opened the floor for the General Public Comment period. Dennis Lister, 1108 Rappahannock Avenue, Fbg, VA 22401, spoke in opposition to the Neighborhood Commercial Overlay District as it relates to the College Heights neighborhood. Sue Sargeant, 1318 William Street, Fbg, VA 22401, represents the College Heights Civic Association. Ms. Sargeant spoke in opposition to the Neighborhood Commercial Overlay District as it relates to the College Heights neighborhood and the ongoing problems in the area. Anne Little, 726 William Street, Fbg, VA 22401, spoke about the negative effects on the College Heights neighborhood due to the neighborhood’s proximity to commercial sites. Mr. Durham requested that the public comment letters be read into the record (Attachment): Staff read into the record electronically received letters. Rebecca Eaton, 811 Weedon Street, Fbg, VA 22401, wrote in opposition to the Commercial Overlay District in the Area 5 Comp Plan. Matthew Kelly, 1309 Hanover Street, Fbg, VA 22401, wrote in opposition to the Commercial Overlay District in the Area 5 Comp Plan. Rachel Sargeant, 812 Daniel Street, Fbg, VA 22401, wrote in opposition to the Commercial Overlay District in the Area 5 Comp Plan. Mr. Durham closed the General Public Comment period. 11. ADOPTION OF MINUTES [01:14:04] (Attachment) A. Minutes - January 22, 2025 Joint Planning Commission Meeting with City Council Mr. Durham asked if any commissioner had comments that would preclude the minutes being adopted. None responded. Mr. Durham declared the minutes adopted. 12. PLANNING COMMISSIONERS COMMENTS [01:14:32] A. Chairman Comments Mr. Durham noted that the Comprehensive Plan Area 5 Plan is with the City Council for action. The next Planning Commission Public Hearing on the new Comprehensive Plan is scheduled for May 14, 2025. Mr. Durham explained that the Planning Commission meets on the second and/or fourth Wednesday of each month. Tonight’s meeting is called a Supplementary Meeting. Supplementary Meetings are scheduled when the Planning Commission has additional business. Mr. Durham noted that the previous Planning Commission Public Hearing on the Area 5 Plan was attended by the public and televised as part of the public record. B. Commissioner Comments Mr. Caswell noted that the actual wording in the Comprehensive Plan is “Commercial Outlook”. The “Neighborhood Commercial Overlay District” occurs earlier in the document. The future land use plans for College Avenue do not contain an overlay district. Mr. Craig and the Dais discussed the attributes of a “Neighborhood Commercial Overlay District” and the processes involved in implementing an Overlay District. Mr. Craig reviewed the areas of the city that currently have Overlay Districts. Ms. Whitehead, Mr. Durham, and Mr. Craig discussed what the term “determine appropriateness” means in the Planning Commission’s reviewing and recommendation processes. The term is not meant as a requirement step, rather, it is meant to reflect the considerations of current issues that are before the Planning Commission and City Council at the time. 13. I have received several calls regarding the Area 5 plan allowing commercial operations within College Heights. An issue that has not been directly discussed during the public engagement process to date. If this is the case, it is a discussion that needs to take place with the residents of College Heights before any action is taken. A few points in this regard: 1. College Heights is already close to, and impacted by, commercial development. 2. College Heights is already dealing with the impacts from traffic, parking, and other issues related to UMW and some of the larger churches in the area that have operations that go beyond just Sunday services. 3. Allowing commercial operations in College Heights was NOT a proposal that came from the neighborhood. Before any action is taken, an explanation needs to be made on how this proposal came forward and what it is trying to achieve as it relates to College Heights. An explanation that needs to be made directly to the residents of College Heights in a setting where they can participate in the discussion. I have read the staff report on the Area 5 Plan for tonight's supplementary meeting, which is unclear and makes little sense to anyone not directly involved in the points referenced, i.e., city residents. This and the fact that this discussion is taking place outside the normal meeting schedule are concerning. My apologies if the information I have received is in any way inaccurate, but as noted, the presentation of materials does not paint a clear picture. My name is Rachel Sargeant. I live at 812 Daniel St. 22401. I am writing about the Neighborhood COMMERCIAL Overlay District that is in the Small Area 5/Comprehensive Plan. It says, 'College Ave is a highly utilized pedestrian corridor and creates the opportunity for neighborhood-serving commercial uses through the conversation of residential buildings to COMMERCIAL uses". Please remove this statement out of the Plan. College Heights residents do NOT agree with it. 1. College Heights is a healthy, vibrant neighborhood. Neighborhood COMMERCIAL Overlay District is for neighborhoods that need revitalization. 2. This is a Top down decision. This statement did not come from College Heights members. 3. This statement was not verbally 'highlighted' in public presentations at Planning Commission or Council meetings. It is in small font at the bottom of a page. It is definitely controversial and affects entire neighborhoods in the city. 4. College Heights has a diversity of housing options: duplex, triplex, apts and a diversity of people, 18-24 yrs old UMW students. Protect our housing. Not sacrifice it to 'retail'. 5. College Heights has 'workforce housing'. College Ave must remain residences for teachers, firefighters, police, rescue, local govt employees, and our students and neighbors 6. City's crumbling Water/sewer pipes under College Ave can't support a commercial kitchen or toilets in the business 7. We College Heights residents won't sacrifice the essence of our community for the sake of the city's need for retail income. 8. Small 'retail' is struggling to make ends meet. Many are closing because they can't find the workers. Don't replace our homes with 'retail'. 1 9.This is not 'low impact' on our neighborhood. It opens the door to destruction of our neighborhood, by developers who will pick us apart with 'encroachment', making a 'killing' in their COMMERCIAL spaces. 10. Outdoor live music shall not have amplified sound. 1600 Princess Anne Street Special Use Permit Planning Commission Regular Meeting April 23, 2025 Welcome to Mis Ojos Restaurante Co-Owners: Maritza Bonilla and Orssy Hernandez Background Mis Ojos Restaurante is a cozy and inviting restaurant blending the bold, vibrant flavors of Dominican cuisine with some influences of Italian cooking. The restaurant is named after Maritza’s grandmother, who raised her and taught her everything she knows about cooking. She comes from a family of restaurant owners so it’s something that she grew up with and is passionate about. We hope to see you soon at Mis Ojos Restaurante FXBG FORWARD COMPREHENSIVE PLAN UPDATE PLANNING COMMISSION MEETING APRIL 23, 2025 Walkable Centers Map Update • Two new Community/City centers were added: Alum Springs Maker District and Canal Quarter Maker District (see page 17 of map and pages 20-23 of text). • The representation of the Downtown and Celebrate Virginia South Regional centers was adjusted. • The two main independent bike-ped corridors (Motts Run to Dixon Park, and VCR Trail) were added to illustrate connections and relationship between Walkable Centers, corridors, and open space networks (see additional text added on page 16). Walkable Centers Map Update Community Health Integration • Language was added to incorporate considerations for essential services and community health outcomes linked to walkability and housing access (see page 8, 16 and strategy 5.f on page 71). Mobility Updates • A new strategy was added to review development regulations around Walkable Centers to prioritize pedestrian/bicycle connectivity and safety (see strategy 2.b on page 28). • Language was modified to clarify that all travel modes should be balanced city-wide but non-automobile modes (pedestrians, bikes, transit) should be prioritized within designated Walkable Centers and connecting corridors (see strategy 1.g on page 42). • The strategy to prioritize proactive traffic calming implementation in specific locations like Walkable Centers, Corridors, and near schools/parks was expanded (see strategy 2.b on page 42). • A new strategy was included to integrate traffic calming projects into the CIP, budget, and maintenance schedules to ensure implementation (see strategy 2.e on page 43). Housing Updates • Language regarding incentivizing desired housing types (e.g., smaller units, condos) and removing regulatory barriers was strengthened (see strategy 1.d & 3.a on pages 70-71). • General language encouraging the exploration of innovative housing strategies such as land trusts/banks, was included (see strategy 3.c on page 71). • A new policy and strategies were added for monitoring housing production based on Housing Advisory Committee input (see Policy 6 and strategies 6.a,6.b,6.c on page 71) Adobe Stock Economic Development • Language was added about the recently adopted Technology Overlay District was added to the context section as well as the Economic Development area map (see page 95 & 97). • A new strategy to review existing industrial zones as part of the Small Area Plan process was included (see strategy 4.d on page 99). • A new strategy to engage major employers about workforce housing needs was developed (see strategy 9.e on page 100). • A policy and strategy to facilitate targeted redevelopment efforts in the city, including exploring a community-based development corporation or similar entity for the long-term vision for Central Square was (7) FXBG Forward included (see policy 11 and strategy 11.a on page 100). pg.53 Environment • New context language was developed in a paragraph called "Physical Constraints to Development" linking natural systems maps 14 and 15 to the T-1 Transect designation process in the small area plans as well as City Code requirements (see page 109) • A new strategy regarding mitigation of conflicts between rail corridors, industrial uses, and residential areas was added (see strategy 8.d on page 120).
