The meeting was preceded by publicized notice in the Fremont Tribune and the agenda displayed in the Municipal Building. The meeting was open to the public. A continually current copy of the agenda was available for public inspection at the office of the City Administrator, 400 East Military Avenue. The agenda was distributed to the Citizens Advisory Review Committee on August 25, 2022 and posted, along with the supporting documents on the City’s website. Background: The Film Incentive Program is funded through the Local Option Economic Development Fund (LB840) and allows for applicants to receive a rebate based on qualified local expenditures. The Film Incentive Guidelines state that rebates may not exceed thirty percent (30%) of the moneys in LB840 and may not exceed 30% of the qualified local expenditures. Film Incentive Program Grants are calculated and paid once local expenditures have been submitted and verified. I Am A Man The Film, LLC applied to the Film Incentive Program requesting a rebate in the amount of 30% of local expenditures. Local expenditures have been estimated at $885,640. The estimated rebate amount is $265,692, which is currently more than 30% of the moneys available in LB840. The LB840 plan does not prohibit committing future LB840 funds. I Am A Man The Film, LLC has received national support and recognition. The production company agrees to meet the Film Incentive Rebate program requirements. The requirements include, but are not limited to, submitting a Film Incentive Application, showing proof of funding, providing the anticipated Motion Picture Association of America (MPAA) rating, and providing a copy of the movie script. WITNESSETH: WHEREAS, Applicant has requested the City to investigate the feasibility of obtaining a Local Option Economic Development Plan Grant in connection with the financing of a project to be undertaken by Applicant. Andrew Troy and his company Troy Entertainment developed, wrote, and owns the screenplay for I Am a Man. Producers are Paul Green, long time Anonymous Content executive and its former President, and Andrew Troy who will also direct the film. Supporting Troy will be 5-time Emmy Nominated and 4-time Emmy winning Action Stunt Director Eddie Perez, and 11-time nominated and 4-time World Stunt Award winner Tad Griffith, a Nebraska native, who will handle all horse related action stunt directing. Logline: I Am a Man tells the story of Ponca Chief Standing Bear, who escapes U.S. government forced relocation in order to honor his dead son’s last wish to be buried in the Ponca’s ancestral land. The chief is captured. Standing Bear soon learns the fight for the freedom to bury his son means challenging an Army general, Brig. General Crook, and the U.S. government in a court of law. By taking the stand on his own behalf, he establishes legal rights for all Native Americans and sets the precedent for many major civil rights cases to come. With such cinematic predecessors as Dances With Wolves, Amistad, Lincoln, and 12 Years a Slave, this epic, historical drama will encompass both the sweeping vistas of the Great Plains, as well as the legendary halls of justice, in which the future of all Native Americans hung in the balance. Inspector E.C. Kemble supervises as U.S. soldiers force Ponca Indians from their ancestral homes along Nebraska’s Niobrara River. The government inspector marches the Indians 600 miles south to Indian Territory, in what is now Oklahoma. For 55 days, the Ponca endure disease and exposure to the elements without medicine or shelter. Many people die on the march, known as the Ponca Trail of Tears. This is the true story of a hero that rose from this trail and changed the course of history. Once in Indian Territory, things grow worse. There are no houses, no food rations, no farm equipment. A thick cloud of disease carrying mosquitos hangs over the barren prairie and kills one-quarter of the Ponca tribe. Shortly after Christmas 1878, disease claims the only son of chief Standing Bear. The boy’s dying wish is for his father to bury his remains in the land where he was born. The father looks down at the son and promises that it will be done. In January 1879, leading a small group of mostly women and children, Standing Bear flees north across the frozen plains to honor his son’s last request. Inspector Kemble calls in the venerated “Indian fighter” Brigadier General George Crook, who relentlessly pursues the escaped Ponca. He captures and holds the escapees at Fort Omaha until they can be marched back to Indian Territory. Sometime in March 1879, a secret source leaks the news of the Ponca prisoners, causing a specialized group of supporters to quickly coalesce. Thet are newspaper editor, Thomas Tibbles; Constitutional lawyer, John Webster; trial lawyer, Andrew Poppleton; and an Omaha Indian woman translator, Bright Eyes. Standing Bear and his small team know that to free the Ponca, they will have to face in a court of law the U.S. government. They need a bold move, something never before attempted. They decide to sue General Crook in U.S. Federal Court. It is risky, as Native Americans were not considered U.S. citizens and therefore had no rights under U.S. law. However, with the issuance of a writ of habeas corpus General Crook would be required to produce Standing Bear in court and justify why he and the other Ponca are being detained. If the General cannot, Standing Bear and the other Ponca captives must be released, but all they need is a Judge with the courage to hear the case. So, Tibbles and Bright Eyes track down legendary Judge Elmer Dundy in the middle of a bear hunt with his companion Buffalo Bill Cody. Tibbles convinces Judge Dundy to sign the writ, and the landmark human rights case goes to trial. Meanwhile, Inspector Kemble — constantly embroiled in conflict with the Lakota, Cheyenne and other Indian nations — is determined to make an example of Standing Bear and the Ponca. He starts a smear campaign against Standing Bear and gets his superiors in Washington to close ranks around General Crook. To derail the case, Kemble and his allies falsify reports and forge the General’s signature. With a vigorous attack in court and unlimited resources on the government’s side, the outcome for the Ponca chief and his people looks bleak. On May 2, 1879, during the final moments of the trial, Standing Bear unexpectedly speaks. Gathering his courage, he finds his voice and reaches into the hearts of the Judge, the General, and the Nation — showing them that an Indian is a PERSON that bleeds red just as any man. He utters the words that carry all the way to Martin Luther King: “I am a man.” Captivated by his presence and feeling the power of his every word, the entire courtroom is brought to their feet cheering. Then, Judge Dundy delivers the historic ruling in favor of Standing Bear. The Ponca chief will never forget the strange turn of events that led him down this road to justice — especially the mysterious informant role played by General Crook, who first leaked the story of the Ponca’s plight to the local press. To General Crook, Standing Bear and his dedicated team will always be grateful. Standing Bear is now in control of his destiny. He is free to take his people home. Finally, the father will lay his son to rest in the land of their ancestors. The Ideal of Freedom (Stephen Roberts 1996) depicts the trial of Standing Bear. During his tenure at GWC, Adelman won ten ACE Awards and numerous medals at international film festivals and was nominated for an Emmy Award. Off that success, Adelman became a senior line producer and director for Delilah Films. In the mid-90s, Adelman stepped into the role of President of Production for Cineville, overseeing the development and production of over ten award- winning independent films. He left Cineville in the late 90s to work as an independent producer of Film and TV. He worked on films such as “Murder in the First” and “The Usual Suspects”. In 2002, Adelman settled down as Vice President of feature production at Handmade Films. He oversaw the development and production of their entire slate, including being a producer on “Planet 51”. Most recently, Adelman launched his development, packaging and financing company called TDA Pictures. In 2019, Adelman co-authored a book on the making of the Chuck Berry movie “Chuck Berry: Hail Hail Rock N’ Roll” which he was the line producer on and which was directed by Taylor Hackford and musically produced by Keith Richards. He has also just written his memoirs which will be published in 2022. He is a member of the Producers Guild of America and resides in Los Angeles, CA. Paul Green - Producer Paul is a film and television producer and executive at Anonymous Content, a premiere production and talent management company. Although you may not recognize his name, Troy has been collaborating with some of our greatest contemporary artists, musicians, and filmmakers for well over three decades. In 2021, the Academy of Motion Picture Arts & Sciences recognized Troy’s screenplay “I Am a Man – The True Story of Chief Standing Bear” as a Semifinalist in their prestigious Nicholls Screenplay Writer’s Competition. Troy is currently in pre-production on a new independent feature length drama film titled “Midnight in the Orange Grove”. Based on true events, the Midnight in the Orange Grove screenplay was written by Troy and the film will be his feature film directorial debut. Furthermore, Troy is currently the subject of a documentary film titled “Tripping Corpse” about his lost art and music collaboration with world renown artist Raymond Pettibon. In 1999, Troy parlayed his lifelong music career into filmmaking. He was a member of the seminal Los Angeles based electronic rock groups “Polarbear” with Jane’s Addiction co-founder Eric Avery and “Maven” with Nitzer Ebb’s Bon Harris. During this time period, Troy owned and operated two popular recording studios including “Revolver Recordings” and “Icon Recording Studios”, the latter being the original Hanna Barbera Studios located on Seward Street in Hollywood, California. Throughout my 20-year career as a film producer and business owner, and over the course of my life as a minority and Native American, this fact of American life and history never escapes my mind. Since discovering this story of Chief Standing Bear, it has become my mission to develop his story as a film. After the Civil War was fought to confirm that in a more perfect union “all men are created equal,” Native Americans were still not considered men or human beings, not until this long-suffering Chief fought out this issue in the media and in a Nebraska court of law in 1879. This fight created lasting change, an essential block in the legal foundation of equality – a foundation that we must always fight to maintain. The great progress prompted by Chief Standing Bear underpin the values of Western democracy, and the freedom it represents, as a beacon of hope for the rest of the World. I’ve had the great fortune of a lengthy film career, including having had direct partnerships with and having worked directly for many great filmmakers. I have learned from their experiences and been inspired by their accomplishments. These inevitably guided me toward seeking out something meaningful that I believed in, and that I could produce and direct. I AM A MAN is that story. Although not widely known or taught in school, this story affords some small recognition of the plight of the “First Nations.” The trial of Standing Bear and its outcome would help establish rights for all Native people and laid the foundation for many future civil rights cases within the U.S. courts. In addition to dealing with the topic of basic human rights, it also deals with the essential human response to the death of a child and underscores the importance of a “free-press.” In this regard the story highlights the positive impact on society when injustice is met with a healthy legal system, engaged citizens, and the unyielding perseverance of a free and open press. From the onset of creating this screenplay, I insisted that the story be told from the perspective of Chief Standing Bear. His story organically introduces other Native characters and many important U.S. historical figures that present a unique opportunity for an ensemble cast that will equally combine Native actors with prominent Hollywood actors. When the screenplay was completed in 2017, I contacted the Ponca Tribe of Nebraska to notify them of this project. The Ponca Tribe invited me to meet with them in Lincoln, Nebraska in July 2017 where I met 32 Tribal Members and their entire Tribal Council. At our meeting, I shared information about my company, discussed my production partners, and shared my vision for the film. They were enthusiastic to hear about my endeavors in making this film possible because it is based on the life of their greatest leader. Upon reading my screenplay, the Ponca conducted a formal Tribal Council meeting to discuss this project. When I was invited to the Nebraska State Capitol and the Governor’s office, I was informed by the Governor’s Chief of Staff Matt Miltenberger that “it is one of Governor Ricketts most important goals while he is still in office to spread the story of Chief Standing Bear.” In March of 2018, a Bill was passed in Nebraska to send Standing Bear to Washington D.C. On August 17, 2018 the Architect of the Capitol sent an approved and signed letter stating that the Bill to send Standing Bear to Washington D.C. is Approved. On September 18, 2019 a new Chief Standing Bear statue was unveiled in Statuary Hall in Washington D.C., the first native person to ever be inducted into Statuary Hall. The statue stands beside the founders and leaders of the United States of America, a symbol of justice that will echo throughout the U.S. and to the World. While I do have a deep love and appreciation for classic Hollywood films, and also the many filmmakers of the past 40 years who have made tremendous advances in the art and technology of filmmaking, since the time I started this project, several films have been made within the historical drama genre that I feel are good representations of the type of film I would strive to create: Lincoln, 12 Years a Slave, The Revenant, Darkest Hour, The Kings Speech, and specific elements of Woman Walks Ahead and Hostiles. My film will also recognize its predecessor films like Dances with Wolves, Last of the Mohicans, The New World, and Amistad. This event signifies the "first" Native American person to ever be inducted into Statuary Hall, now the largest statue in our most cherished hall in the United States of America.
