CITY COUNCIL STUDY SESSION OCTOBER 2, 2012 5:30 P.M. After the Pledge of Allegiance, the Mayor called the meeting to order and stated a copy of the open meeting law is posted continually for public inspection located near the entrance door by the agendas. Roll call showed Council Members Stange, Navarrette, Eairleywine, Anderson and Hoppe present, Council Member Bixby and Gitt absent – 6 present, 2 absent. Bar owners were present to speak for and against extending the hours of sale of alcoholic beverages to 2:00 a.m. as allowed by State statute. Moved by Council Member Navarrette, seconded by Council Member Stange to adjourn the meeting. Roll call vote: 6 ayes. Motion carried. Meeting adjourned at 6:13 p.m. I, Kimberly Volk, the undersigned City Clerk, hereby certify that the foregoing is a true and correct copy of the proceedings had and done by the Council President and Council; that all of the subjects included in the foregoing proceedings were contained in the agenda for the meeting, kept continually current and available for public inspection at the office of the Clerk; that such agenda items were sufficiently descriptive to give the public reasonable notice of the matters to be considered at the meeting; that such subjects were contained in said agenda for at least twenty-four hours prior to said meeting; that at least one copy of all reproducible material discussed at the meeting was available at the meeting for examination and copying by members of the public; that the said minutes were in written form and available for public inspection within ten working days and prior to the next convened meeting of said body; that all news media requesting notification concerning meetings of said body were provided advance notification of the time and place of said meeting and the subjects to be discussed at said meeting and that a current copy of the Nebraska Open Meetings Act was available and accessible to members of the public, posted during such meeting in the room in which such meeting was held. Agenda distributed to the Mayor and City Council on September 27, 2012. The official current copy is available at City Hall, 400 East Military, City Clerk’s Office. The City Council reserves the right to go into Executive Session at any time. A copy of the Open Meeting Law is posted in the City Council Chambers for review by the public. The City of Fremont reserves the right to adjust the order of items on this agenda. STAFF REPORT TO: HONORABLE MAYOR AND CITY COUNCIL FROM: KIM VOLK, CITY CLERK/TREASURER DATE: September 27, 2012 SUBJECT: FMC 10-120 Hours of sale for alcoholic beverages Background: Council Member Hoppe, at the request of bar owner, Wayne Loock (RD’s) has requested the Council consider amending 10-120 to allow consumption of alcohol on premise until 2:00 a.m. as allowed by state statute. In summer 2010, City Council considered an ordinance to extend the hours of sale for alcoholic beverages as permitted by State Statute. Council Members at that time were: Kuhr, Gilfry, Eairleywine, Navarrette, Gitt, Getzschman, Bixby and Anderson. Below is an excerpt from the minutes of August 31, 2010: The City Clerk gave the third reading, by title only, of an ordinance amending FMC 10-120 relating to hours of sale for alcoholic beverages. Citizens were present to support and protest the proposed change. Roll call vote showed Council Member Anderson voting aye, all other Council Members voting nay – 1 aye, 7 nays. There- upon the Mayor declared the Ordinance failed.
