The City of Fremont reserves the right to adjust the order of items on this agenda.  STAFF REPORT TO: Mayor and City Council FROM: Kimberly Volk, City Clerk/Treasurer DATE: February 1, 2013 SUBJECT: Fremont Transit Lines Background: The City of Fremont Transit Lines is operated under the supervision of the Street Department Su- perintendent of Public Services. It utilizes two part time bus drivers who are eligible for medical insurance and paid leave time. The two buses are maintained by the Street Department mechanics. The bus route is a fixed route servicing the needs of the elderly, handicapped and general public. Periodic review of the route is made with a few slight changes over the past couple of years in an effort to increase ridership. The most recent change in the route was to include Splash Station and Ronin Pool. There was no notable increase in ridership with the route change however. I have attached the current route as additional backup. The majority of the funding for this program comes from Federal and State assistance. Federal dollars comprise 50% of the budget with 25% from the State and 25% subsidy from the general fund property taxes. The fiscal year for the funding of the bus is from July 1st to June 30th. The grant application is due to the State by March 29, 2013. The State of Nebraska has announced three new requirements as follows: 1. Operate a minimum of 16-20 hours per week (effective July 1, 2013) 2. Charge a set fare - minimum of $1.00 per boarding in town (effective July 1, 2013) 3. Have a minimum fare box recovery of 10 percent of operating costs (effective July 1, 2014) The City of Fremont Transit Lines currently meets requirement the first requirement. Elderly and handicapped individuals are currently charged only .75 cents per fare. This will need to be increased to at least $1.00 to com- ply with requirement number two. The third and final requirement will be harder to meet. A synopsis of the budget revenues versus expenses is included as backup. Included in the backup material is a review of ridership and miles driven from 2008 thru 2012. There has been a notable decrease in ridership in 2012 compared to the previous four years. Analysis suggests the decrease can be attributed to the change of resident demographics at the Towers. I do not issue dumpster permits. Each truck is issued a license card with the make of the vehicle, the plate and the vin number. The license card is issued as proof that the truck is currently licensed. Fremont Municipal code for licensing garbage haulers: §4-309 LICENSE REOUIRED; LICENSE FEE AMOUNT; DEFINITIONS. (1) Every owner, operator, lessee or licensee and every hauler or other solid waste collection and transporta- tion enterprise to hereby required to be licensed by the City of Fremont, for the collection and transport of solid waste. For the purpose of sections 4-309, 4-310, 4-311 and 4-312, the following definitions shall apply: CONTAINER shall mean every device having a capacity in· excess of 500 pounds or 250 gallons in which solid waste may be collected or stored pending transport. HAULER shall mean any individual, company, partnership, corporation, or enterprise providing the transport of solid waste for hire. SOLID WASTE shall include waste materials as defined by section 81-1502 RS Neb; VEHICLE shall mean every device in, upon, or by which any solid waste is or may be transported upon the public streets except devices moved solely by human power. (2) This license requirement shall be applicable to each hauler or other solid waste collection and transporta- tion enterprise that collects and transports solid waste for hire, whether hired by a singular source/generator of refuse, or multiple sources/generators, and whether collection and transportation is on a daily, weekly, other periodic or irregular basis. (3) There is hereby levied a license fee on each hauler or other solid waste collection and transportation enter- prise licensed to transport solid waste for hire of one hundred twenty-five dollars ($125.00) per year for each three vehicles or portion thereof to be used within the City for the collection of solid waste. Every vehicle and container used for the storage or transport of solid waste shall be required to visibly display the name of the licensed hauler owing and operating such vehicle or container. (4) Additionally, the owner of any vehicle, container, roll-off or drop box, exceeding eight (8) cubic yards in capacity left at any location within the City for the collection or accumulation of refuse pending transportation shall be required to uniquely identify each container used within the corporate limits of the City by permanently marking at least three (3) sides of the container with the name of the owner of the container and a number unique to each such container. Said markings shall be at least six (6) inches in height and legible from a distance of thirty (30) yards. Any person or firm placing or utilizing a container or vehicle for the collection or accumula- tion of solid waste pending transportation within the City in violation of this section shall be subject to a fine in the amount of fifty dollars ($50.00) per day and each day of violation shall constitute a separate offense. (5) As a condition of licensing, the owner of each vehicle, operated or utilized to provide for the transport for hire of solid waste shall be required to certify his knowledge and understanding of the provisions of sections 13- 2001 et seq. RS Neb. as it relates to the handling, transportation and disposal of refuse. §4-310 LICENSE; TRANSPORT; VERIFICATION; CLASSIFICATION; TRANSFER STATION. All residents and licensed haulers for hire of solid waste shall be required to transport all solid waste as defined by section 81-1502(26) RS Neb. to the Fremont area recycling center and transfer station sited by Fremont in Dodge County, Nebraska for disposal unless such solid waste is to be taken to a landfill or other disposal facil- ity outside the State of Nebraska or to be taken to any recycling center or material recovery facility. Solid waste which will be taken to a landfill or other disposal facility outside of the State of Nebraska or to be taken to any recycling center or material recovery facility, shall be transported to the Fremont Area recycling center and transfer station for classification as to the type of waste material and the licenses issued pursuant to FMC sec- tion 4-309 shall be verified. Records shall be made of such classification and ultimate destination. It shall be unlawful for such vehicle to be utilized for the transfer or transport for hire of solid waste without the license fee delineated in section 4-309 having been paid and evidence of payment being presented upon demand by the driver or operator of the vehicle. §4-311 LICENSE FEE; FEE PERIOD, REFUNDS; APPLICABILITY OF OTHER ORDINANCES; PENALTY. The license fee provided in section 4-309 shall be paid on an annual basis without pro-ration. Fee to be paid on or before December 31, in advance for the entire next year. There shall be no refund on such fee once the same has been paid. Provisions of sections 4-309 through 4-312 shall be supplemental to, and be subject to, the additional provisions of the ordinances of the City of Fremont relative to Health and Sanitation under the Fremont Code, and such other and additional ordinances as effect garbage, trash and waste as therein defined. Any person who violates the provisions of sections 4-309 through 4-312 shall be guilty of a misdemeanor. The penalty for such violation shall be in an amount not to exceed five hundred dollars ($500.00). Persons violating sections 4-309 through 4-312 shall be deemed guilty of a misdemeanor; the person against which this misde- meanor penalty may be imposed, shall be that person then operating the unlicensed vehicle, and that person’s inability to immediately provide proof of license under this provision. In addition, the City Council, following a public hearing, may suspend for up to one (1) year any and all licenses issued pursuant to section 4-309 for repeat violations of sections 4-309 through 4-312. §4-312 CONSTRUCTION, WASTE, REQUIREMENT. It shall be unlawful for any person to carry, cart, haul or convey any refuse or wastes as defined by section 13-2001 RS Neb. or construction wastes generated within the corporate limits of the City for disposal outside the corporate City limits without having such refuse classified by the authorities at the Fremont area recycling center and transfer station. §4-313 LICENSE TAX; COSTS AND FEES; MAY BE RECOVERED BY CIVIL ACTION. Any person whose duty it is pay a license tax as provided in section 4-309 who shall fail to pay the same shall be liable to an action for the recovery of the amount of such license tax, together with costs and attorney fees; provided, that the remedy by action shall not be deemed exclusive but concurrent with other remedies provided for such violation. §4-314 RESTRICTIONS ON HOURS OF GARBAGE AND TRASH PICKUP. No garbage or trash hauler shall commence operations in residential areas and commercial areas adjacent to residential areas before five-thirty (5:30) A.M. All such operations shall cease by nine (9:00) p.m. For the pur- pose of this section, “residential areas” and “commercial areas” shall be those general residential and specific commercial zoning districts so designated on the City’s Official Zoning District Map. Penalty - Any person who violates the prohibitions or provisions of this section shall be deemed guilty of a misdemeanor. The penalty for such violation shall be in any amount not to exceed one hundred ($100.00) dollars and/or imprisonment for any length of time not to exceed three (3) months, in the discretion of the court. In addition, the City Council fol- lowing a public hearing, may suspend for up to one year any and all licenses issued pursuant to section 4-309 of this code for violation of this section.
