PLANNING COMMISSION
REGULAR MEETING
JANUARY 16, 2012 – 5:00 P.M.
CITY COUNCIL CHAMBERS
PRESENT: Chairman Sookram, Members, Barton, Fooken, Emanuel, Ridder, Sawyer,
Synovec, Wiese and Winter, City Engineer Clark Boschult and Secretary Deb

Chairman Sookram called the meeting to order and read a statement that a copy of the Open
Meeting Law is posted continually for public inspection located near the agendas in the City
Council Chambers and a Public Notice of this meeting was given in advance by publicized
notice in the Fremont Tribune, a copy of which is attached to these minutes and made a part
thereto, and on radio KHUB. Also, the agenda was displayed in the lobby of the Municipal
Building, Police Station and the Dodge County Courthouse on January 11, 2012 and is open to
the public. Moved by Fooken, seconded by Sawyer, to approve the Chairman's Statement that
this meeting is now determined to be a legal meeting. Roll Call Vote showed all members
present voting aye – 9 ayes. Motion Carried.
It was moved by Fooken, seconded by Sawyer, to dispense with the reading of the Minutes of
the December 12, 2011 Regular Meeting and approve as received. Roll Call Vote showed all
members present voting aye – 9 ayes. Motion Carried.
Chairman Sookram stated the general public is invited to address the Planning Commission
regarding any item on this agenda at this time or wait until discussion of their request is taking
place. No public comments were received.
Consider request for City of Fremont to rezone part of the SE ¼ Section 7, SW ¼
Section 8, NW ¼ Section 17 and NE ¼ Section 18, Township 17 North, Range 9 East of
the 6th P.M., Dodge County, Nebraska from AG – Agricultural District to GC – General
Commercial District (US 275/US 30 Interchange).
Chairman Sookram stated in November 2010, the Planning Commission recommended
approval of a request to rezone an 8 acre triangular tract of land at County Road “U” Blvd. (16th
Street) and US 275 in the southeast quadrant of the US 30/US 275 interchange. The Ordinance
recommended for approval by the Planning Department to the City Council rezoned the entire
160 acre parcel in the southeast quadrant of the interchange from AG – Agricultural to GC –
General Commercial.
The City Council in December 2010 approved the Planning Department’s recommended 160
acre Ordinance rezoning the entire southeast quadrant, extending from US 30 (23rd Street) one
half (1/2) mile south to County Road “U” Blvd. (16th Street) and from US 275 east one half (1/2)
mile. This included rezoning the existing farmstead acreage on County Road “U” Blvd. to GC –
General Commercial, making the residence nonconforming.

In January 2011, the City Council following the recommendation of the Planning Department
amended the rezoning Ordinance to include only the 8 acre triangular tract and exclude the
existing farmstead acreage and 152 acres.
The December 2010 Ordinance and January 2011 amended Ordinance did not include any
property in the northeast, northwest or southwest quadrants of the interchange. The January
2011 and current City zoning map shows these three (3) remaining quadrants as GC – General
Commercial.
The proposed rezoning will provide for GC Zoning of the entire US 30/US 275 Interchange
within the current City Limits.
Chairman Sookram stated the recommendation is to approve.
City Engineer, Clark Boschult, stated since the annexation in January, 2011 this entire
interchange has been shown as Commercial zoning on the zoning map but there is not an
Ordinance that rezoned it so to make the map coincide with the records, an Ordinance will need
to be considered to rezone the interchange.
Moved by Emanuel, seconded by Winter to recommend approval of the request. Roll Call Vote
showed all members present voting aye – 9 ayes. Motion Carried.
