MINUTES PLANNING COMMISSION REGULAR MEETING June 17, 2013 – 5:00 P.M. CITY COUNCIL CHAMBERS PRESENT: Chairman Sookram, Emanuel, Fagan, Fooken, Sawyer, Wiese and Winter, Planning Director Rian Harkins, Chief Building Inspector Don Simons and Secretary Deb Pruss ABSENT: Members Barton and Ridder Chairman Sookram called the meeting to order. Roll Call Vote was taken – 7 present. Chairman Sookram read a statement that this meeting was preceded by publicized notice in the Fremont Tribune and the agenda displayed in the lobby of the Municipal Building and posted online at www.fremontne.gov; and distributed to the Planning Commission, Mayor and City Council on June 13, 2013 and is open to the public. Chairman Sookram also stated a copy of the agenda was kept continually current and available to the public at 400 East Military, 3rd floor and a copy of the open meeting law is posted continually for public inspection located near the Council Chambers entrance door by the agendas. It was moved by Emanuel, seconded by Sawyer, to dispense with the reading of the Minutes of the May 20, 2013 Regular Meeting and approve as received. Roll Call Vote showed all members present voting aye – 7 ayes. Motion Carried. Chairman Sookram stated the general public is invited to address the Planning Commission regarding any item on this agenda at this time or wait until discussion of their request is taking place. No public comments were received.  Consider request of Donald E. and Carole A. Coughlin to rezone the west half of Block 183, Original Town, Fremont, Dodge County, Nebraska from LI – Limited Industrial to DC – Downtown Commercial District. Planning Director Harkins stated this was a request for zoning from Limited Industrial to Downtown Commercial for a half block on the east side of Main street to the alley between 2nd and 3rd. Surrounding properties to the north in terms of zoning are Downtown Commercial. There is some GI and LI south as well as the other surrounding directions. This area is a mix in terms of land uses of service commercial. There is some residential on some upper stories as well as adjacent blocks close by. There is also a mix of industrial bearing industrial uses. Aside from trying to match current land uses that are there on that half block, the applicant has the potential to rent space or sell space to tenants that cannot operate in a LI District. Hence, the other part of the request and the other reason for the request for the zoning change. Just as a reminder, it was put in the staff report that there is no off-street parking requirement in the Downtown Commercial. Staff is not seeing at this point from what we know of the application any impacts relating to any other things there so it is part of the reason why staff is recommending approval. 1 Robert Richardson approached the Commission and stated he was curious how long ago the zoning changed to Industrial. Harkins stated his indication was that happened in 2001 when the current ordinance was originally adopted. At that time, the typical practice is when you adopt a new code you adopt a new map with it. That would have been the likely time so 2001 in terms of the timeframe and that’s what we have been working with since then. Moved by Emanuel, seconded by Sawyer to recommend approval of the request. Roll Call Vote showed all members present voting aye – 7 ayes. Motion Carried.  Consider request of Erin Lake/Will Lake Corporation and Deane and Cheryl Gacke to erect single family residence on Site #14, 440 South Ridge Road, all in Section 22, Township 17 North, Range 8 East, Fremont, Dodge County, Nebraska as part of a permitted conditional use at a Residential Cluster Housing Site. RL – Lake and River Residential District. Planning Director Harkins states this is at Erin Lake. This is south of West Military and Ridge. The CUP proposal is for a single family residence. Because this is a residential cluster development, that qualifies for having to have the CUP, which is before you. Staff has recommended approval basically because of what we foresee as very few, if any, impacts upon the surrounding property. There are a number of residential structures around the lake right now so this is just really part of the continued residential use of the lake either as a primary residential structure or secondary one. Moved by Winter, seconded by Wiese to recommend approval of the request. Roll Call Vote showed all members present voting aye – 7 ayes. Motion Carried. Meeting adjourned at 5:08 p.m. 2
