This Action Item was approved on the Consent Calendar. 1-B ID17-902 ***RESOLUTION - Adopt the Fiscal Year 2018 Salary Resolution. The above item was moved to the Contested Consent Calendar by Councilmember Brandau for further discussion. 1-C ID17-887 Appoint and authorize certain Finance Officers of the City of Fresno (“City”) to sign City checks and various investment and commercial banking documents, and to provide verbal instruction required for the prudent financial administration and safekeeping of City funds RESOLUTION 2017-177 APPROVED City of Fresno ***Subject to Mayoral Veto Page 2 City Council Meeting Minutes - Final-revised June 26, 2017 This Action Item was approved on the Consent Calendar. 1-D ID17-893 Designate and authorize certain Finance Officers of the City of Fresno (“City”) to sign various investment and commercial banking documents, and to provide verbal instruction required for prudent financial administration and safekeeping of Fresno Joint Powers Finance Authority (“JPFA”) funds and property RESOLUTION 2017-178 APPROVED This Action Item was approved on the Consent Calendar. 1-E ID17-933 Approve the reappointments of Lynda Snauffer and Michael McDonald to the Civil Service Board and appointment of Susan Coulter to the Disability Advisory Commission - Mayor Brand; and appointment of Linda East to the District 2 Plan Implementation Committee - Councilmember Brandau APPROVED. This Appointment was approved on the Consent Calendar. 1-F ID17-938 Action relating to marijuana cultivation within the City of Fresno 1. Adopt a finding of No Possibility pursuant to Section 15061(b)(3) of the California Environmental Quality Act (CEQA) Guidelines 2. ***BILL NO. B-35 - (Intro. 6/22/2017) (For adoption) - The adoption of an amendment to sections 12-2104 and 12-2105 of the Fresno Municipal Code relating to the cultivation of marijuana. CONTINUED TO JULY 20, 2017 This Action Item was approved on the Consent Calendar. 1-G ID17-931 Approve an amendment to Software License and Maintenance Agreement to add Trapeze General Transit Feed Specification (GTFS) real-time data module and associated maintenance fees from Trapeze Software Inc., of Ontario Canada, in the amount not to exceed $136,524. The above item was moved to the Contested Consent Calendar by Councilmember Soria for further discussion. CONTESTED CONSENT CALENDAR 1-B ID17-902 ***RESOLUTION - Adopt the Fiscal Year 2018 Salary Resolution. The above item was introduced by Personnel Director Cardell. Upon call, there was no public comment. City of Fresno ***Subject to Mayoral Veto Page 3 City Council Meeting Minutes - Final-revised June 26, 2017 Councilmembers spoke regarding Sick Leave, changes to Exhibit Z, Changes to the Salary Ranges and if the item was presented to Council during budget hearings. RESOLUTION 2017-176 ADOPTED. On motion of Councilmember Caprioglio, seconded by Councilmember Baines III, that the above Action Item be adopted. Councilmember Soria spoke regarding local people to create a phone application for FAX fixed route and Handy Ride. APPROVED On motion of Vice President Soria, seconded by Councilmember Caprioglio, that the above Action Item be approved. ID17-746 (HEARING CONTINUED TO JULY 20, 2017 AT 10:10 A.M.) Actions pertaining to the City of Fresno 2017-2018 Annual Action Plan: 1. CONTINUED HEARING to obtain public comments regarding implementation of the City’s proposed activities with federal grant funding; and (Continued from 5/11/2017) 2. RESOLUTION adopting the 2017-2018 Annual Action Plan; approving submission to the U.S. Department of Housing and Urban Development (HUD) for application of Community City of Fresno ***Subject to Mayoral Veto Page 4 City Council Meeting Minutes - Final-revised June 26, 2017 Development Block Grant (CDBG), Home Investment Partnerships (HOME), Emergency Solutions Grant (ESG), and Housing Opportunities for Persons With Aids/HIV (HOPWA) Program Funds; providing for sub recipient agreements; and authorizing the City Manager to sign all implementing documents required by HUD as approved to form by the City Attorney The above item was continued to July 20, 2017. 3. GENERAL ADMINISTRATION 3-A ID17-945 Approve in substantial form the Third Amendment to the Amended and Restated Stadium Sublease Agreement between the City of Fresno and Fresno Baseball Club, LLC. The above item was introduced to Council by City Manager Rudd. Mayor Brand gave thanks to the Staff and Fresno Grizzlies for all their hard work. Upon call, the following members from the public spoke in support of the above item, Nathan Alonzo, Fresno Chamber of Commerce and Derek Franks, Fresno Grizzlies General Manager. Councilmembers spoke regarding the following: support of the new ownership, the amount City contributes to the sinking fund, go out for a RFP for a promoter, has City met their obligations, three different LLC's ownership groups, 100 event goal to be met, and non relocation pledge agreement, general fund money, free events for non-profits and amount to maintain the stadium. APPROVED. On motion of Councilmember Caprioglio, seconded by Councilmember Baines III, that the above Action Item be approved. The motion carried by the following vote: Aye: 7 - Olivier, Soria, Baines III, Brandau, Bredefeld, Caprioglio and Chavez 3-B ID17-944 Actions pertaining to the Fresno Police Officers Association (FPOA) for Unit 4 1. ***Adopt a Memorandum of Understanding between the City of Fresno and the Fresno Police Officers Association (FPOA) for Unit 4 - Non-Management Police 2. ***RESOLUTION: Adopt the First Amendment to FY 2018 Salary Resolution No. 2017-176, amending salaries in Exhibit 4, Unit 4 - Non-Management Police (FPOA), as required by the Memorandum of City of Fresno ***Subject to Mayoral Veto Page 5 City Council Meeting Minutes - Final-revised June 26, 2017 Understanding between the City of Fresno and the Fresno Police Officers Association 3. *** Approve a Side Letter of Agreement with the Fresno Police Officers Association (FPOA), for Unit 4 - Non-Management Police, regarding Lateral Hire Incentives The above item was introduced to Council by Labor Relations Manager Phillips. Upon call, the following member of the public, Fresno Police Officers Association (FPOA) Kurtz spoke regarding the Memorandum of Understanding (MOU) and the membership division. City Manager Rudd and Mayor Brand thanked Fresno Police Officers Association (FPOA) Kurtz for all his hard work. RESOLUTION 2017-179 ADOPTED On motion of Councilmember Caprioglio, seconded by Councilmember Chavez, that the above Action Item be adopted. The motion carried by the following vote: Aye: 7 - Olivier, Soria, Baines III, Brandau, Bredefeld, Caprioglio and Chavez 3-C ID17-910 ***RESOLUTION - of the Council of the City of Fresno, California, concerning Measure C Extension Local Transportation Purposes Pass-Through Projects and Program Funds annual allocation for Fiscal Year 2017-2018 The item was introduced to Council by Budget Manager Sumpter. Upon call, there was no public comment. RESOLUTION 2017-180 APPROVED. On motion of Councilmember Baines III, seconded by Councilmember Caprioglio, that the above Action Item be approved. Upon call, there was no public comment. RESOLUTION 2017-181 APPROVED. On motion of Councilmember Brandau, seconded by Councilmember Bredefeld, that the above Action Item be approved. The motion carried by the following vote: Aye: 7 - Olivier, Soria, Baines III, Brandau, Bredefeld, Caprioglio and Chavez Members of the public shall have an opportunity to address the City Council concerning this matter. Upon call the following member(s) of the public addressed Council during Unscheduled Communicaiton: Gary Dawcicle spoke regarding Manchester Mall security and transportation. ADJOURN City Council Adjourned at 3:21 P.M. The above minutes were approved at the July 20, 2017 meeting with a motion from Councilmember Brandau and a second by Councilmember Soria. On a vote of 6-0 with Councilmember Caprioglio absent. The minutes were re-approved at the August 17, 2017 meeting due to an error with a motion from Councilmember Caprioglio and a second by Vice President Soria. On a 5-0 vote with Councilmembers Baines and Bredefeld absent. The error was as follows: Resolution number 2017-179 was issued to item 1-B erroneously (item 1-B should have been issued Resolution 2017-176) and Resolution number 2017-176 was erronneously issued to item 3-B (item 3-B should have been issued Resolution 2017-179).
