Soria Councilmember Mike Karbassi President Luis Chavez Councilmember Garry Bredefeld Vice President Nelson Esparza CLOSED SESSION The below item was removed from the agenda. ID 21-049 CONFERENCE WITH LEGAL COUNSEL - PUBLIC SECURITY - Government Code Section 54957(a): Matters posing a threat to the security of public buildings, the security of essential public services, and to the public's right of access to public services and public facilities, and related actions pertaining to the Declaration by Governor Newsom of a State of Emergency to Help State Prepare for Broader Spread of COVID- 19, and related local concerns. OPEN SESSION ID 21-048 Resolution - Declaring A State Of Emergency Due To Insufficient Intensive Care Unit Beds And Medical Personnel In The City And County Of Fresno, And Requesting Immediate Relief From Governor Newsom The above item was introduced to Council by Councilmember Chavez, District 5 and Councilmember Soria, District 1. Upon call, the following members of the public addressed Council: Brandi Villegas and Lisa Flores. Councilmember Karbassi motioned to vote separately on Section 1 and Section 2 of the resolution. Councilmember Bredefeld seconded the motion. Discussion was held between Councilmembers regarding Section 2 of the resolution "The City reserves the right to pursue enforcement against those in violation of state and local emergency orders including mass gatherings and illegal concerts/events if COVID-19 numbers in the City intensify." and City of Fresno ***Subject to Mayoral Veto Page 2 City Council Meeting Minutes - Final December 10, 2020 the availability of ICU beds in the City of Fresno. Councilmembers agreed to take vote on the sections separately. Councilmember Chavez motioned to approve Section 2 as presented. Councilmember Esparza seconded the motion. Motion PASSED 4/3 Councilmember Karbassi, Councilmember Bredefeld and Council Vice President Caprioglio voted no. Councilmember Karbassi motioned to approve Section 1 as presented. Council Vice President Caprioglio seconded the motion. Motion PASSED 7-0. RESOLUTION 2020-327 ADOPTED AS AMENDED On motion of Councilmember Karbassi, seconded by Vice President Caprioglio, that the above Action Item be adopted as amended. The motion carried by the following vote: Aye: 7 - Arias, Caprioglio, Soria, Karbassi, Chavez, Bredefeld and Esparza ADJOURNMENT City Council adjourned the special emergency open and closed session meeting at 3:26 P.M.
