Roll Call Present 4 - Chairperson Michael McDonald, Vice Chair Jack Tracy, Board Member Maryann Rogozinski, and Board Member Lynda Snauffer The Board convened into closed session at 1:37pm. 2. New Business B. Closed Session - Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54957]) Deputy Chief Robert Nevarez was present on behalf of the Appointing Authority, and was represented by Joseph Rubin, Esq. Tina Griffin, Assistant City Attorney, and Jeff Cardell, Director of Personnel Services, were also present. The Appellant was present and was represented by Roger Wilson, Esq. The Board convened into executive session at 1:37pm to discuss the matter and reconvened into closed session at 2:55pm. A motion was made by Member Rogozinski and seconded by Vice Chair Tracy to uphold the Hearing Officer's recommendation with modifications. Schedule Meeting(s) to Conduct a Public Employee Discipline Appeal Hearing [Pursuant to Fresno Municipal Code Section 3-284] The Appointing Authority was not present, but was represented by Deputy Chief Robert Nevarez. Deputy City Attorney III, Felicia Espinosa, was also present. Neither the Appellent nor her Representative, Heather Phillips, Esq., were present; however, Ms. Phillips had provided her availability to Ms. Espinosa, and the Board then scheduled the hearing date of October 12, 2016 beginning at 9:00am. 3.
