Roll Call Present 3 - Chairperson Michael McDonald, Vice Chair Jack Tracy, and Board Member Maryann Rogozinski Absent 1 - Board Member Lynda Snauffer Board Counsel, Dan McCloskey, was present and represented the Board. Acting Secretary Designee, Stephanie Martinez, was also present. 2. Approval of Minutes A. October 26, 2016 A motion was made by Member Rogozinski, seconded by Vice Chair Tracy, to approve the October 26, 2016 minutes. The motion was carried by the following vote: Aye: 3 - Chairperson McDonald, Vice Chair Tracy and Board Member Rogozinski Absent: 1 - Board Member Snauffer The Board convened into closed session at 9:02am. 3. Old Business A. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] A motion was made by Vice Chair Tracy, seconded by Board Member City of Fresno ***Subject to Mayoral Veto Page 1 Civil Service Board Meeting Minutes November 29, 2016 Rogozinski, to direct the Chair to sign the findings. The motion was carried by the following vote: Aye: 3 - Chairperson McDonald, Vice Chair Tracy and Board Member Rogozinski Absent: 1 - Board Member Snauffer B. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] The item was withdrawn and no action was taken. C. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Board Member Rogozinski, seconded by Vice Chair Tracy, that the above Action Item be approved. The motion carried by the following vote: Aye: 3 - Chairperson McDonald, Vice Chair Tracy and Board Member Rogozinski Absent: 1 - Board Member Snauffer The Board reconvened into open session at 9:15am. 4. New Business A. Schedule Meeting (s) to Conduct a Public Employee Discipline Appeal Hearing [Pursuant to Fresno Municipal Code Section 3-284] The Appointing Authority was not present, but was represented by Jennifer DeRuosi, Deputy City Attorney. Assistant City Attorney Tina Griffin was also present. The Appellant was present and was not accompanied by a representative. A hearing was scheduled for January 24, 2016 and January 25, 2016 at 9:00am. The Board reconvened into closed session at 9:21am. 5. Hearing on Disciplinary Appeal A. Closed Session - Continued Public Employee City of Fresno ***Subject to Mayoral Veto Page 2 Civil Service Board Meeting Minutes November 29, 2016 Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] The Appointing Authority, Brian Marshall, was present and was represented by Assistant City Attorney Tina Griffin and Deputy City Attorney Jennifer DeRuosi. The Appellant was present and was represented by Scott Boghosian. Witness were sequestered and the reading of the Order was waived by the parties. Witness testimony was heard and breaks were taken as needed. Exhibits of evidence were presented during testimony, and they were filed and moved into the record. At 2:15pm, following summaries and closing remarks from the parties, the Board convened into executive session to deliberate the matter. At 2:40pm, the Board convened into closed session and voted on the charges as ready by Stephanie Martinez, Acting Secretary Designee. The charge of violation of Fresno Municipal Code Section 3-286(a) as set forth in the Order was sustained on a 3-0 vote with Member Snauffer absent. The charge of violation of California Vehicle Code Section 21453 as set forth in the Order was sustained on a 3-0 vote with Member Snauffer absent. The charge of violation of Transportation Department General Rules Section 1(A) as set forth in the Order was sustained on a 3-0 vote with Member Snauffer absent. The charge of violation of Transportation Department General Rules Section 1(B) as set forth in the Order was sustained on a 3-0 vote with Member Snauffer absent. The charge of violation of Transportation Department General Rules Section 3(D) as set forth in the Order was sustained on a 3-0 vote with Member Snauffer absent. A motion was made by Vice Chair Tracy, seconded by Member Rogozinski, to modify the Appointing Authority's decision and increase City of Fresno ***Subject to Mayoral Veto Page 3 Civil Service Board Meeting Minutes November 29, 2016 the Appellant's suspension from 20 hours to 30 hours. The motion was carried out by the following vote: Aye: 3 - Chairperson McDonald, Vice Chair Tracy and Board Member Rogozinski Absent: 1 - Board Member Snauffer At 2:43pm, the Board convened into open session and the decisions of the Board were announced in accordance with the Brown Act. 6.
