Roll Call Present 4 - Chairperson Michael McDonald, Vice Chair Jack Tracy, Board Member Lynda Snauffer, and Board Member Dean Eller Absent 1 - Board Member Al Smith Board Counsel, Dan McCloskey was present and represented the Board. Acting Secretary Designee, Karnell Grijalva, was also present. 2. Approval of Minutes A. August 17, 2017 On motion of Vice Chair Tracy, seconded by Board Member Snauffer, to approve the minutes of August 17, 2017. The motion carried by the following vote: Aye: 4 - Chairperson McDonald, Vice Chair Tracy, Board Member Snauffer and Board Member Eller Absent: 1 - Board Member Smith The Board convened to Closed Session at 9:02am. Board Chair Mike McDonald resequenced agenda to address item 4.A. The Board convened to Closed Session at 9:54am. 3. Old Business A. Closed Session - Continued Public Discipline/Dismissal/Release [Pursuant to Government Code Section 54957] Joseph Rubin, Attorney at Law, and Deputy Chief Robert Nevarez, was present on behalf of the Appointing Authority. The Appellant and Representative, Roger Wilson, Attorney at Law, were also present. On motion of Board Member Snauffer, seconded by Vice Chair Tracy, the Hearing Officer Recommendation was affirmed by the following vote: Aye: 4 - Chairperson McDonald, Vice Chair Tracy, Board Member Snauffer and Board Member Eller Absent: 1 - Board Member Smith 4. Hearing on Appeal A. Closed Session - Continued Public Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] Jennifer DeRuosi, Deputy City Attorney, and Deputy Chief Robert Nevarez, was present on behalf of the Appointing Authority. Appellant Representative, Tony Silva c/o Goyette & Associates, was present. The Appellant was not present. Due to Appellant Family Tragedy the City and Appellant Representative requested a continuance of Hearing on Appeal. October 11, 2017 was set by the Board and agreed to by all parties present. At 9:55am, the Board convened into Open Session and the decisions of the Board were announced in accordance with the Brown Act. 5. Unscheduled Public Communications None 6. Adjournment There being no further business to come before the Board, the meeting was adjourned at 9:56am.
