Roll Call Present 3 - Chairperson Michael McDonald, Vice Chair Jack Tracy, and Board Member Lynda Snauffer Absent 2 - Board Member Al Smith, and Board Member Dean Eller Board Counsel, Dan McCloskey, was present and represented the Board. Acting Secretary Designee, Karnell Grijalva, was also present. 2. Approval of Minutes A. September 20, 2017 On motion of Board Member Snauffer, seconded by Vice Chair Tracy, that the September 20, 2017 minutes be approved. The motion carried by the following vote: Aye: 3 - Chairperson McDonald, Vice Chair Tracy and Board Member Snauffer Absent: 2 - Board Member Smith and Board Member Eller 3. Hearing on Appeal A. Closed Session - Continued Public Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Vice Chair Tracy, seconded by Board Member Snauffer, that the decision of the Appointing Authority be upheld. The motion carried by the following vote: City of Fresno ***Subject to Mayoral Veto Page 1 Civil Service Board Meeting Minutes September 27, 2017 Aye: 3 - Chairperson McDonald, Vice Chair Tracy and Board Member Snauffer Absent: 2 - Board Member Smith and Board Member Eller Jennifer DeRuosi, Deputy City Attorney, and Gregory Barfield, Assistant Director of Transportation, was present on behalf of the Appointing Authority. The Appellant was present without representation. Witnesses were sequestered and the reading of the Order was waived by the parties. Exhibits of evidence were presented during testimony and they were filed and moved into the record. At 12:25pm, following summaries and closing remarks from the parties, the Board convened into Executive Session to deliberate the matter. At 1:14pm, the Board reconvened into Closed Session and voted on the charges as read by Karnell Grijalva, Acting Secretary Designee. The charge of violation of Fresno Municipal Code Section 3-286(a) as set forth in the Order was sustained with a 3-0 vote. The charge of violation of FAX DOT Policy, testing for Alcohol as set forth in the Order was sustained with a 3-0 vote. At 1:16pm the Board reconvened into Open Session and the decisions of the Board were announced in accordance with the Brown Act. 4. Unscheduled Public Communications None 5.
