Roll Call Present 4 - Chairperson Michael McDonald, Vice Chair Jack Tracy, Board Member Al Smith, and Board Member Dean Eller Absent 1 - Board Member Lynda Snauffer Board Counsel, Dan McCloskey, was present and represented the Board. Acting Secretary Designee, Karnell Grijalva, was also present. At 9:01am the Board convened into Closed Session Appellant Representative presented opening motion to Appeal Order of Removal and return to the Interactive Process. At 9:08am the Board convened to Executive Session. At 9:30am the Board reconvened to Closed Session and denied Appellant's opening motion and proceeded with the Hearing on Appeal. 2. Hearing on Appeal A. Closed Session - Continued Public Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Vice Chair Tracy, seconded by Board Member Smith, that the decision of the Appointing Authority be upheld. The motion carried by the following vote: City of Fresno ***Subject to Mayoral Veto Page 1 Civil Service Board Meeting Minutes October 2, 2017 Aye: 4 - Chairperson McDonald, Vice Chair Tracy, Board Member Smith and Board Member Eller Absent: 1 - Board Member Snauffer Tina Griffin, Assistant City Attorney, and Fire Chief, Kerri Donis, was present on behalf of the Appointing Authority. The Appellant and Representative, Eric LiCalsi, Attorney at Law, were also present. Witnesses were sequestered and the reading of the Order was waived by the parties. Exhibits of evidence were presented during testimony and they were filed and moved into the record. At 2:02pm, following summaries and closing remarks from the parties, the Board convened into Executive Session to deliberate the matter. At 2:24pm, the Board reconvened into Closed Session and voted on the charges as read by Karnell Grijalva, Acting Secretary Designee. The charge of violation of Fresno Municipal Code Section 3-286(a) as set forth in the Order was sustained with a 4-0 vote. The charge of violation of Fresno Municipal Code Section 3-286(c) as set forth in the Order was sustained with a 4-0 vote. At 2:33pm the Board reconvened into Open Session and the decisions of the Board were announced in accordance with the Brown Act. 3. Unscheduled Public Communications None 4.
