Roll Call Present 4 - Chairperson Michael McDonald, Vice Chair Jack Tracy, Board Member Lynda Snauffer, and Board Member Al Smith Absent 1 - Board Member Dean Eller Board Counsel, Dan McCloskey, was present and represented the Board. Acting Secretary Designee, Karnell Grijalva, was also present. 2. Approval of Minutes A. September 27, 2017 On motion of Vice Chair Tracy, seconded by Board Member Smith, that the September 27, 2017 minutes be approved. The motion carried by the following vote: Aye: 4 - Chairperson McDonald, Vice Chair Tracy, Board Member Snauffer and Board Member Smith Absent: 1 - Board Member Eller October 2, 2017 On motion of Board Member Smith, seconded by Vice Chair Tracy, that the October 2, 2017 minutes be approved. Old Business A. Closed Session - Continued Public Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Vice Chair Tracy, seconded by Board Member Snauffer, that the above Action Item be approved as amended. The motion carried by the following vote: Aye: 4 - Chairperson McDonald, Vice Chair Tracy, Board Member Snauffer and Board Member Smith Absent: 1 - Board Member Eller The Appointing Authority Representative, Attorney at Law, Joseph Rubin and Appellant Representative, Tony Silva was present. The Appointing Authority and Appellant were not present. B. Closed Session - Continued Public Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Board Member Snauffer, seconded by Vice Chair Tracy, that the above Action Item be approved. The motion carried by the following vote: Aye: 4 - Chairperson McDonald, Vice Chair Tracy, Board Member Snauffer and Board Member Smith Absent: 1 - Board Member Eller Appointing Authority, Deputy Chief Robert Nevarez, and Representative, Attorney at Law, Joseph Rubin, were present. The Appellant and Representative were absent. 4. Hearing on Appeal A. Closed Session - Continued Public Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Vice Chair Tracy, seconded by Board Member Snauffer, City of Fresno ***Subject to Mayoral Veto Page 2 Civil Service Board Meeting Minutes October 11, 2017 that the decision of the Appointing Authority be upheld. The motion carried by the following vote: Aye: 4 - Chairperson McDonald, Vice Chair Tracy, Board Member Snauffer and Board Member Smith Absent: 1 - Board Member Eller Jennifer DeRuosi, Deputy City Attorney, and Deputy Chief Robert Nevarez, was present on behalf of the Appointing Authority. The Appellant and Labor Representative, Tony Silva, were both present. Witnesses were sequestered and the reading of the Order was waived by the parties. Exhibits of evidence were presented during testimony and they were filed and moved into the record. At 2:18pm, following summaries and closing remarks from the parties, the Board convened into Executive Session to deliberate the matter. At 2:55pm, the Board reconvened into Closed Session and voted on the charges as read by Karnell Grijalva, Acting Secretary Designee. The charge of violation of Fresno Municipal Code Section 3-286(a) as set forth in the Order was sustained with a 4-0 vote. The charge of violation of Fresno Municipal Code Section 3-286(b) as set forth in the Order was sustained with a 4-0 vote. The charge of violation of Fresno Police Department Policy 341.2.5(a) as set forth in the Order was not sustained with a 3-1 vote. The charge of violation of Fresno Police Department Policy 341.2.5(n) as set forth in the Order was sustained with a 4-0 vote. At 2:57pm, the Board convened into Open Session and the decisions of the Board were announced in accordance with the Brown Act. 5. Schedule Administrative Meeting The Board scheduled the next Civil Service Board Administrative meeting for November 14, 2017 at 2:00pm. 6. Unscheduled Public Communications City of Fresno ***Subject to Mayoral Veto Page 3 Civil Service Board Meeting Minutes October 11, 2017 None Members of the public may address the Civil Service Board regarding items that are not listed on the Agenda and within the subject matter jurisdiction of the Board. Each person is limited to a three (3) minute presentation. Board action on unscheduled items, if any, shall be limited to referring the item to staff for a report and possible scheduling on a future Civil Service Board agenda. 7.
