Roll Call Present 3 - Board Member Dean Eller, Chair Michael McDonald, and Board Member Elba Gomez Absent 2 - Vice Chair Jack Tracy, and Board Member Lynda Snauffer Board Counsel, Dan McCloskey, was present and represented the Board. Acting Secretary Designee, Karnell Grijalva, was also present. Approval of Minutes The Board convened into Closed Session at 9:07am. A. October 9, 2018 On motion of Board Member Gomez, seconded by Board Member Eller, that the October 9, 2018 minutes be approved. Schedule Meeting(s) to Conduct a Public Employee Discipline Appeal Hearing [Pursuant to Fresno Municipal Code Section 3-284] City of Fresno ***Subject to Mayoral Veto Page 1 Civil Service Board Meeting Minutes October 30, 2018 Deputy City Attorney III, Jennifer DeRuosi, was present on behalf of the Appointing Authority. Labor Representative, Marina Magdaleno, was present on behalf of the Appellant. Hearing on Appeal was scheduled for January 7, 2019. 3. Old Business A. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Board Member Eller, seconded by Board Member Gomez, that the above Action Item be Approved and Returned Signed. The motion carried by the following vote: Aye: 3 - Board Member Eller, Chair McDonald and Board Member Gomez Absent: 2 - Vice Chair Tracy and Board Member Snauffer B. Labor Representative, Marina Magdaleno, and the Appellant were also present. Witnesses were sequestered and the reading of the Order was waived by the parties. Exhibits of evidence were presented during testimony and they were filed and moved into the record. At 1:26pm, following summaries and closing remarks from the parties, the Board convened into Executive Session to deliberate the matter. At 2:08pm, the Board reconvened into Closed Session and voted on the charges as ready by Acting Secretary Designee, Karnell Grijalva. The charge of violation of Fresno Municipal Code Section 3-286(a) as set forth in the Order was sustained with a 3-0 vote. The charge of violation of Fresno Municipal Code Section 3-286(b)(4) as set forth in the Order was sustained with a 3-0 vote. The charge of violation of Fresno Municipal Code Section 3-286(b)(7) as set forth in the Order was sustained with a 3-0 vote. The charge of violation of Fresno Municipal Code Section 3-286(b)(8) as set forth in the Order was sustained with a 3-0 vote. The charge of violation of Street Maintenance Division Policies and Procedures and Work Place Conduct Section 1.3 as set forth in the Order was sustained with a 3-0 vote. The charge of violation of Street Maintenance Division Policies and Procedures and Work Place Conduct Section 1.4 as set forth in the Order was sustained with a 3-0 vote. The charge of violation of Street Maintenance Division Policies and Procedures and Work Place Conduct Section 1.5 as set forth in the Order was sustained with a 3-0 vote. The charge of violation of Street Maintenance Division Policies and Procedures and Work Place Conduct Section 1.8 as set forth in the Order was sustained with a 3-0 vote. The charge of violation of Street Maintenance Division Policies and Procedures and Work Place Conduct Section 2. as set forth in the Order was sustained with a 3-0 vote. At 2:13pm, the Board reconvened into Open Session and the decisions of the Board were announced in accordance with the Brown Act. 5. Unscheduled Public Communications None 6.
