Roll Call Present 4 - Vice Chair Jack Tracy, Board Member Lynda Snauffer, Board Member Dean Eller, and Chair Michael McDonald Absent 1 - Board Member Elba Gomez Dan McCloskey, Board Counsel, was present and represented the Board. Karnell Grijalva, Acting Secretary Designee, was also present. Also in attendance was: Jeffrey Cardell, Director of Personnel Services, Tina Griffin, Assistant City Attorney, Jennifer DeRuosi, Deputy City Attorney III, and Deborah Gibson with Amalgamated Transit Union Local 1027 (ATU). 2. Approval of Minutes A. January 28, 2019 On motion of Board Member Eller, seconded by Vice Chair Tracy, that the January 28, 2019 minutes be approved. The motion carried by the following vote: Aye: 4 - Vice Chair Tracy, Board Member Snauffer, Board Member Eller and Chair McDonald Absent: 1 - Board Member Gomez The Board convened into Closed Session at 9:02am. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] Stephanie Snyder, Deputy City Attorney III, and Gregory Barfield, Director of Transportation were present on behalf of the Appointing Authority. The Appellant was present. During Opening Statements, the Appellant requested from the Board a 45 day continuance in the matter to further review investigative documents and obtain representation. The Appellant presented to the Board notification form ATU 1027's intent to determine if they will represent the Appellant's Civil Service matter at their scheduled Executive Board meeting on February 26, 2019. The City provided the Board with a Bench Brief regarding Appellant's allegations of due process and alleged Skelly violations and in support of City's opposition to Appellant's motion to continue. At 9:23am, the Board convened into Executive Session to deliberate the matter. At 9:37am, the Board reconvened into Closed Session and approved the Appellant's request for a continuance until March 20, 2019 and March 21, 2019 with the condition of Appellant waiving any opportunity for back-pay from February 5, 2019, original Hearing on Appeal date, to conclusion of rescheduled Hearing on Appeal date. The Appellant agreed to condition set by the Board and the Hearing on Appeal was rescheduled for March 20, 2019 and March 21, 2019. At 9:38am, the Board reconvened into Open Session and the decisions of the Board were announced in accordance with the Brown Act. 4. Unscheduled Public Communications None 5.
