Roll Call Present 4 - Vice Chair Jack Tracy, Board Member Dean Eller, Chair Michael McDonald, and Board Member Elba Gomez Absent 1 - Board Member Lynda Snauffer Board Counsel, Dan McCloskey, was present and represented the Board. Also present was Acting Secretary Designee, Karnell Grijalva, Assistant City Attorney, Tina Griffin, Deputy City Attorney III, Jennifer DeRuosi and Assistant Director of Personnel Services, Marissa Gonzales. 2. Approval of Minutes A. February 26, 2019 On motion of Vice Chair Tracy, seconded by Board Member Gomez, that the February 26, 2019 minutes be approved. The motion carried by the following vote: Aye: 4 - Vice Chair Tracy, Board Member Eller, Chair McDonald and Board Member Gomez Absent: 1 - Board Member Snauffer B. March 6, 2019 On motion of Board Member Eller, seconded by Vice Chair Tracy, that the March 6, 2019 minutes be approved. New Business A. Schedule Administrative Meeting of the Civil Service Board Administrative Meeting of the Civil Service Board was scheduled for April 3, 2019 at 9:00am. The Board convened into Closed Session at 9:15am. 4. Old Business A. Closed Session - Continued Pubic Discipline/Dismissal/Release [Pursuant to Government Code Section 54957] On motion of Vice Chair Tracy, seconded by Board Member Gomez, that the above Action Item be approved as amended accepting the Appellant's decision to withdraw their Binding Arbitration appeal filed on October 31, 2018 with the City. The motion carried by the following vote: Aye: 4 - Vice Chair Tracy, Board Member Eller, Chair McDonald and Board Member Gomez Absent: 1 - Board Member Snauffer Attorney at Law, Joseph Rubin, was present on behalf of the Appointing Authority. Neither the Appellant or Representative were present. 5. Hearing on Appeal A. Closed Session - Continued Public Discipline/Dismissal/Release [Pursuant to Government Code Section 54957] City of Fresno ***Subject to Mayoral Veto Page 2 Civil Service Board Meeting Minutes March 20, 2019 Deputy City Attorney III, Stephanie Snyder, and Director of Transportation, Gregory Barfield, were present on behalf of the Appointing Authority. Martha Figueroa of Bennett, Sharpe & Bennett, Inc. and the Appellant were present. The Board members were presented a Declaration of Thomas M. Sharpe regarding Request to Reschedule Hearing. At 9:37am, following remarks from the parties, the Board convened into Executive Session to deliberate the matter. At 9:55am, the Board reconvened into Closed Session and granted the Appellant's request to reschedule the Hearing on Appeal with the Appellant's agreement to waive any opportunity for back-pay from February 5, 2019 to the rescheduled Hearing on Appeal date of May 10, 2019. At 10:12am, the Board reconvened into Open Session and the decisions of the Board were announced in accordance with the Brown Act. Members of the public may address the Civil Service Board regarding items that are not listed on the Agenda and within the subject matter jurisdiction of the Board. Each person is limited to a three (3) minute presentation. Board action on unscheduled items, if any, shall be limited to referring the item to staff for a report and possible scheduling on a future Civil Service Board agenda. None 6.
