Roll Call Present 4 - Vice Chair Jack Tracy, Board Member Dean Eller, Chair Michael McDonald, and Board Member Elba Gomez Absent 1 - Board Member Lynda Snauffer Board Counsel, Dan McCloskey, was present and represented the Board. Also present were Acting Secretary Designee, Karnell Grijalva, Assistant Director of Personnel Services, Marissa Gonzales, and Deputy City Attorney III, Jennifer DeRuosi. The Board convened into Closed Session at 10:04am. 2. Hearing on Appeal A. Closed Session - Continued Public Discipline/Dismissal/Release [Pursuant to Government Code Section 54957] On motion of Board Member Gomez, seconded by Vice Chair Tracy, that the above Action Item uphold the decision of the Appointing Authority. The motion carried by the following vote: Aye: 3 - Vice Chair Tracy, Chair McDonald and Board Member Gomez Excused: 1 - Board Member Eller Absent: 1 - Board Member Snauffer City of Fresno ***Subject to Mayoral Veto Page 1 Civil Service Board Meeting Minutes May 15, 2019 Deputy City Attorney III, Stephanie Snyder, and Director of Transportation, Gregory Barfield, were present on behalf of the Appointing Authority. The Appellant and Attorney at Law, Jacob Weisberg, were also present. Witnesses were sequestered and the reading of the Order was waived by the parties. Exhibits of evidence were presented during testimony and they were filed and moved into the record. At 1:55pm, following summaries and closing remarks from the parties, the Board convened into Executive Session to deliberate the matter. At 2:55pm, the Board reconvened into Closed Session. Board Chairman, Mike McDonald, announced that the decisions of the Board did not consider evidentiary phone text messages received from unknown phone numbers. The Board then voted on the charges as read by Acting Secretary Designee, Karnell Grijalva. The charge of violation of Fresno Municipal Code Section 3-286(a) as set forth in the Order was sustained with a 3-0 vote. The charge of violation of Fresno Municipal Code Section 3-286(b)(4) as set forth in the Order was sustained with a 3-0 vote. The charge of violation of Fresno Municipal Code Section 3-286(b)(6) as set forth in the Order was sustained with a 3-0 vote. The charge of violation of Fresno Administrative Order 2-16(2)(a) as set forth in the Order was sustained with a 3-0 vote. The charge of violation of Fresno Administrative Order 2-16(2)(b) as set forth in the Order was sustained with a 3-0 vote. The charge of violation of Fresno Administrative Order 2-16(2)(c) as set forth in the Order was sustained with a 3-0 vote. The charge of violation of Fresno Administrative Order 2-27(1) as set forth in the Order was not sustained with a 1-2 vote. The charge of violation of Fresno Administrative Order 2-27(2)(d) as set forth in the Order was not sustained with a 0-3 vote.
