Roll Call Present 2 - Vice Chair Jack Tracy, and Chair Michael McDonald Absent 2 - Board Member Lynda Snauffer, and Board Member Elba Gomez Board Counsel, Dan McCloskey, was present and represented the Board. Also present were Acting Secretary Designee, Karnell Grijalva, and Deputy City Attorney III, Stephanie Snyder. 2. Approval of Minutes A. April 24, 2019 On motion of Vice Chair Tracy, seconded by Board Member Eller, that the April 24, 2019 minutes be approved. May 1, 2019 On motion of Board Member Eller, seconded by Vice Chair Tracy, that the May 1, 2019 minutes be approved. May 15, 2019 On motion of Board Member Eller, seconded by Vice Chair Tracy, that the May 15, 2019 minutes be approved. Hearing on Appeal A. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Vice Chair Tracy, seconded by Board Member Eller, that the above Action Item uphold the decision of the Appointing Authority. The motion carried by the following vote: Aye: 3 - Vice Chair Tracy, Eller and Chair McDonald Absent: 2 - Board Member Snauffer and Board Member Gomez City of Fresno ***Subject to Mayoral Veto Page 2 Civil Service Board Action Summary May 29, 2019 Deputy City Attorney III, Jennifer DeRuosi, and Personnel Manager, Andreia Cuevas, were present on behalf of the Appointing Authority. The Appellant, Attorney at Law, Sarah Tobias, and Labor Representative, Tony Silva, were also present. Witnesses were sequestered and the reading of the Order was waived by the parties. Exhibits of evidence were presented during testimony and they were filed and moved into the record. At 2:03pm, following summaries and closing remarks from the parties, the Board convened into Executive Session to deliberate the matter. At 2:33pm, the Board reconvened into Closed Session and voted on the charges as read by Acting Secretary Designee, Karnell Grijalva. The charge of violation of Fresno Municipal Code Section 3-286(a) as set forth in the Order was sustained with a 3-0 vote. The charge of violation of Fresno Municipal Code Section 3-286(b)(4) as set forth in the Order was sustained with a 3-0 vote. The charge of violation of Fresno Municipal Code Section 3-286(b)(7) as set forth in the Order was sustained with a 3-0 vote. At 2:35pm, the Board reconvened into Open Session and the decisions of the Board were announced in accordance with the Brown Act. 4. Unscheduled Public Communications Due to the fact there are no scheduled Civil Service Board meetings and pending Findings and Decisions Following Civil Service Board Hearing items are forthcoming from Board Counsel, the Board decided to have Acting Secretary Designee, Karnell Grijalva, poll the Board for scheduling when items are received. Personnel Director, Jeff Cardell, and the present Board members thanked exiting Board member, Dean Eller, for his service. 5.
