Also present were: Acting Secretary Designee, Karnell Grijalva, Deputy City Attorney III, Jennifer DeRuosi and Stephanie Snyder, Assistant Director of Personnel Services, Marissa Gonzales. 2. Approval of Minutes A. February 10, 2020 On motion of Vice Chair Tracy, seconded by Board Member Moreno, that the February 10, 2020 Minutes be approved. Labor Representative, Tony Silva, was present on behalf of the Appellant. The Hearing on Appeal was scheduled for September 14-15, 2020. B. Schedule Meeting(s) to Conduct a Public Employee Discipline Appeal Hearing [Pursuant to Fresno Municipal Code Section 3-284] Deputy City Attorney III, Jennifer DeRuosi, was present on behalf of the Appointing Authority. Labor Representative, Tony Silva, was present on behalf of the Appellant. The Hearing on Appeal was scheduled for September 29-30, 2020. C. Schedule Meeting(s) to Conduct a Public Employee Discipline Appeal Hearing [Pursuant to Fresno Municipal Code Section 3-284] Attorney at Law, Joseph Rubin, was present on behalf of the Appointing Authority. Attorney at Law, E. Marshall Hodgkins, was present on behalf of the Appellant. The Hearing on Appeal was scheduled for December 3-4, 2020. F. Labor Representative, Ruben Zarate, was present on behalf of the Appellant. The Hearing on Appeal was scheduled for November 4, 2020. 5. New Business A. Closed Session - Review of Director Removal From Eligibility List [Pursuant to Fresno Municipal Code Section 3-249] Statements were provided by the Applicant and Deputy City Attorney III, Jennifer DeRuosi. The Board convened into Executive Session at 9:45am to deliberate the matter. The Board reconvened into Closed Session at 9:48am. On motion of Vice Chair Tracy, seconded by Chair McDonald, that the Board uphold the decision of the Director be approved. The motion carried by the following vote: Aye: 3 - Vice Chair Tracy, Chair McDonald and Board Member Montalvo No: 1 - Board Member Moreno B. Closed Session - Inquiry of Director Review Applicant Disqualification Appeal [Pursuant to Fresno Municipal Code Section 3-249] Statements were provided by the Applicant and Deputy City Attorney III, Jennifer DeRuosi. The Board convened into Executive Session at 10:17am to deliberate the matter. The Board reconvened into Closed Session at 10:23am. On motion of Vice Chair Tracy, seconded by Member Montalvo, that the Board uphold the decision of the Director be approved.
