Roll Call Present 3 - Vice Chair Jack Tracy, Chair Michael McDonald, and Board Member Linda Moreno Absent 1 - Board Member Julian Montalvo Board Counsel, Dan McCloskey, was present and represented the Board. Also present was Acting Secretary Designee, Karnell Grijalva. 2. Approval of Minutes A. September 29, 2020 On motion of Vice Chair Tracy, seconded by Chair McDonald, that the minutes for September 29, 2020 be approved. The motion carried by the following vote: Aye: 3 - Vice Chair Tracy, Chair McDonald and Board Member Moreno Absent: 1 - Board Member Montalvo At 9:03 AM the Board convened into Closed Session 3. Old Business A. Reschedule Meeting to Conduct a Public Employee Discipline City of Fresno ***Subject to Mayoral Veto Page 1 Civil Service Board Meeting Minutes October 12, 2020 Appeal Hearing [Pursuant to Fresno Municipal Code Section 3-284] Deputy City Attorney III, Jennifer DeRuosi, informed the Board that the City and the Appellant have reached an agreement in this matter; no action necessary. The Board agreed unanimously to dismiss the matter. B. Joint Stipulation and Order To Continue Hearing Dates - Schedule Meeting to Conduct a Public Employee Discipline Appeal Hearing [Pursuant to Fresno Municipal Code Section 3-284] The Board unanimously approved Joint Stipulation to continue Hearing on Appeal until January 13, 2021 and January 15, 2021. Appellant agreed to waive backpay from October 12, 2020 to first day of the continued appeal hearing. 4. New Business A. Closed Session - Continued Public Employee Discipline/Dismissal/Release - Findings of Fact and Decision by Hearing Officer [Pursuant to Government Code Section 54954] On motion of Vice Chair Tracy, seconded by Board Member Moreno, that the Findings of Fact and Decision by Hearing Officer be rejected and to uphold the decision of the Appointing Authority. The motion carried by the following vote. Aye: 3 - Vice Chair Tracy, Chair McDonald and Board Member Moreno Absent: 1 - Board Member Montalvo Deputy City Attorney III, Stephanie Snyder, was present on behalf of the Appointing Authority. Neither the Appellant or Appellant's Representative were present. At 9:15 AM the Board convened into Executive Session to deliberate the matter. At 9:30 AM the Board reconvened into Closed Session and the Board voted on the above matter. At 9:31 AM the Board reconvened into Open Session and the decisions of the Board were announced in accordance with the Brown Act. 5.
