Roll Call Board Counsel, Dan McCloskey, was present and represented the Board. Also present were Acting Sectary Designees, Karnell Grijalva and Yvonne Teixeira. 2. Approval of Minutes A. October 12, 2020 On motion of Vice Chair Tracy, seconded by Board Member Montalvo, that the minutes for October 12, 2020 be approved. The motion carried by the following vote: At 9:02 AM the Board convened into Closed Session. 3. Old Business A. Closed Session - Findings of Director Decision Review of Applicant Disqualification [Pursuant to Fresno Municipal Code Section 3-249] On motion of Vice Chair Tracy, seconded by Board Member Moreno, that the above Action Item be Approved and Returned Signed. The motion carried by the following vote: Deputy City Attorney III, Jennifer DeRuosi, was present on behalf of the Appointing Authority. The Applicant was not present. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Vice Chair Tracy, seconded by Board Member Montalvo, that the above Action Item be Approved and Returned Signed. The motion carried by the following vote: Attorney at Law, Joseph Rubin and Christina Roberson, Assistant City Attorney, were present on behalf of the Appointing Authority. Neither the Appellant or Representative were present. C. Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Vice Chair Tracy, seconded by Board Member Montalvo, to uphold the decision of the Appointing Authority. The motion carried by the following vote: City of Fresno ***Subject to Mayoral Veto Page 2 Civil Service Board Meeting Minutes November 4, 2020 Deputy City Attorney III, Jennifer DeRuosi and Director of Public Utilities, Michael Carbajal were present on behalf of the Appointing Authority. Labor Representative, Ruben Zarate and the Appellant were present. Witnesses were sequestered and the reading of the Order was waived by the parties. Exhibits of evidence were presented during testimony and they were filed and moved into the record. At 11:38am, following summaries and closing remarks from the parties, the Board convened into Executive Session to deliberate the matter. At 12:41pm, the Board reconvened into Closed Session and voted on the charges as read by the Acting Secretary Designee, Karnell Grijalva. The charge of violation of the Fresno Municipal Code Section 3-286(a) as set forth in the Order was sustained by a 4-0 vote. The charge of violation of the Fresno Municipal Code Section 3-286(b)(8) as set forth in the Order was sustained 4-0 vote. The charge of violation of the Department of Public Utilities Policy Admin - A000 of Ethics III.A. as set forth in the Order was sustained 4-0 vote. At 12:53 pm, the Board reconvened into Open Session and the decisions of the Board were announced in accordance with the Brown Act. 4. Unscheduled Public Communications None 5.
